Print article Early results posted Tuesday night indicate that Midtown voters rejecting an initiative to recall Anchorage Assembly Chair Felix Rivera, though thousands of votes remain uncounted. Results show that about 60% of District 4 voters so far have voted “no” on the initiative to recall of Rivera, while 40% have voted “yes.” Just 1,636 District 4 ballots had been counted under 4% of the total registered voters in the district. Those percentages will likely change, as thousands of ballots remained uncounted Tuesday night and many more were expected to arrive by mail in the coming days, election officials said.

In late January, a state court ruled that the attempted recall of Anchorage Assembly Chair Felix Rivera can go forward. Using almost identical reasoning to the courts decisions in the lawsuit over the recall of Gov. Mike Dunleavy, Superior Court Judge Dani Crosby said that it s up to Midtown Anchorage voters to decide whether the grounds stated by recall proponents are sufficient cause to remove Rivera from office. It s not a coincidence that the decisions in the two cases were so similar under Alaska law, although recalls must have cause, there is no minimum threshold for that cause. And although under the Alaska Constitution, voters are meant to decide the recall on the legal grounds stated, in practice, it s a referendum on how voters feel about Rivera and Dunleavy.

Just more than a year ago on Jan. 10, 2020, Superior Court Judge Eric Aarseth ruled that the recall effort against Gov. Mike Dunleavy could proceed in a decision that was ultimately upheld by the state Supreme Court.
Now it turns out that Anchorage Assembly Chair Felix Rivera will face the voters first, and long before Dunleavy, if he does at all before 2022, with the effort against the governor attempting to regain its momentum still more than 20,000 signatures short of the minimum needed.
