SACRAMENTO, Calif. (April 16, 2021) – Yesterday, a second California Senate committee passed a bill that would authorize the legal sale of food and food additives containing CBD within the state. This would not only open up markets in California, but it would also a crucial step given the FDA’s continued prohibition of the same. Sen. Benjamin Allen (D-Hollywood) introduced Senate Bill 235 (SB235) on Jan. 19. The legislation would allow cannabinoids and other hemp extracts to be added to dietary supplements, food, beverages, cosmetics and pet food. The bill declares that a dietary supplement, food, beverage, cosmetic, or pet food is not adulterated by the inclusion of industrial hemp or cannabinoids, extracts, or derivatives from industrial hemp as long as it meets state specifications.
