or two questions from the jury pertaining to what they should do if they can t come to a consensus on a single count. that was around 11:00 this morning and then that s when the judge gave them what is essentially an allen charge, termed here in virginia as a sawyer s charge. and the judge said to them you should go back into the courtroom, continue deliberations whether to this one count you can t come to consensus. we re unsure how many counts the jury may have had some question on. so that happened just past 11:00 a.m. they went back into the jury deliberation room at 11:58. here we stand at about 4:15, 4:20. about four and a half hours the jury has been there in deliberating so we ll wait to see, jake, what the note says. unclear if it s more clarification questions or if it could be a verdict here. so we re going to wait and see and get back to you as soon as
paul call as the judge is di this with attorneys for both sides, what are the attorneys saying in that discussion? what are the cases they are making as to how the judge should proceed and what should be said? what they are discussing is something lawyers call an allen charge. it s given when a jury is deadlocked and you want to send them back out and you want to get them to try to get back to work and milwaukake a decision. they call it sometimes the dynamite charge. there s not so much dynamite in it in my opinion. what it says essentially is, we want you to go back out and conscientiously examine your own views but compare those to the views of other jurors, be respectful of each other, try to reach a decision. if you don t reach a decision, another juror my may have to do. that s if you had no agreement. here you have 17 counts. i think what you are going to see is a modified allen charge. you will see a gentler approach
ellis, it is your duty to agree upon a verdict if you can do so. if you can t, he seems to be saying, move on. that is called an allen charge. it is named after a case that went to the supreme court many years ago. it basically tells the judge that if the judge wants to push them in the direction of anonymous verdict he or she is allowed to burst in. it is very soft language overall. don t abuse your own reality here. stay with it. it is a little bit of a mixed message. it is designed to get them to a mixed verdict, but it is not the end of the world if you can t reach account. it is one of the things that the judge does when they get a sense that the case might be hanging. whether it really works or not is a different question. we are heading towards some sort of verdict by the end of the day or first thing in the morning. neil: if you are found
the allen charge, where the judge will say listen, without doing violence to your judgment, can you foreperson, come to a conclusion, do you think further deliberations will be useful with respect to the counts that you cannot come to an agreement on. if the consensus is if they can t, if it is in fact the number of counts where they made a finding, guilty or not guilty, he will take a partial verdict and mistrial where the charges they couldn t come to a conclusion on. shepard: this is really the beginning for paul manafort. there s another trial coming. that has more to do with activities with the president. this has nothing to do with it. right. sure. they got manafort in a bind here. if he gets convicted, here s the play, shep. it will be interested if prosecutors or the defense comes knocking and says, hey, you know, maybe we should talk before that other trial. they have him in the breach at that point in time if he gets convicted on any of these offenses. he has all the reas
if we cannot come to a consensus on a single count, how should we fill in the verdict form for that count? so it suggests they re not deadlocked on all of the counts so they wouldn t have asked the question that way. there s also a possibility it s more than one count. if you substitute individual or particular for that word single, it could mean they re deadlocked on some of the counts and they re trying to fill out the jury form. the judge asked them to look at the form again. and then he also gave them what s known as an allen charge. which is language that you use when a jury is deadlocked on a particular issue to explain to them that, look, there s going to be no better jury, please go back and have at it again and try to come to some decision. then they sent them back to the jury room. danny, let me get your take on this. if the jury can t reach consensus on a single count, would this result in a hung jury? so they would be hung on whatever counts they can t reach an agreemen
