Army to Review Thousands of 'Bad Paper' Discharges in Court Settlement

29 Apr 2021 A federal court has approved a settlement in a lawsuit that requires the U.S. Army to review thousands of other-than-honorable discharges issued in the past decade to soldiers with mental health conditions or traumatic brain injuries. Judge Charles Haight, with the U.S. District Court of Connecticut, approved the agreement Monday in the class-action suit formerly known as Kennedy v. McCarthy, which charged that the service wrongly discharged troops who engaged in misconduct but whose behavior may have been caused by a psychiatric condition or brain damage. The Army announced in January that it would review all other-than-honorable discharges since April 17, 2011, for eligible service members, an estimated 3,500 active-duty, Reserve and National Guard troops affected by post-traumatic stress disorder or other psychiatric conditions, trauma related to sexual assault, or brain injury.

It orders the Army Discharge Review Board to reconsider thousands of cases where upgrades were denied, despite evidence that veterans were struggling with post-traumatic stress disorder, traumatic brain injury or military sexual trauma when they separated from the military. The board will review decisions made between April 17, 2011, and April 26, 2021, that partially or fully denied relief to post-9/11 veterans with other-than-honorable discharges.

Army to review thousands of discharges of veterans who suffered from traumas

Kenney Jan 14, 2021 The Army will review thousands of discharge records of veterans affected by military sexual trauma, post-traumatic stress disorder and other behavioral health conditions following a class-action lawsuit, the service announced Tuesday. The review is part of a settlement reached in the lawsuit Kennedy v. McCarthy, which was preliminarily approved Dec. 28, according to the Army. The service will look at discharges of veterans affected by PTSD, traumatic brain injury, military sexual trauma or other behavioral health conditions. “Under the agreement, the Army will automatically reconsider certain discharge-status-upgrade decisions made by the Army Discharge Review Board between April 17, 2011, and the effective date of settlement that partially or fully denied relief to Iraq- and Afghanistan-era veterans with less-than-fully-honorable discharges,” the statement reads.
