The Judicial Service Commission has allowed all nine commissioners to sit on the panel for the Chief Justice’s recruitment despite protests over legality of some members.
Judiciary Chief Registrar, who doubles as the secretary to the commission Anne Amadi, said nothing bars the members from participating in the interviewing process in the search for a Chief Justice.
Senior Counsel Philip Murgor, one of the CJ applicants, had written a letter to the JSC seeking to have the acting Chief Justice Philomena Mwilu stopped from sitting in the interview panel.

Senior Counsel Philip Murgor wants Deputy Chief Justice Philomena Mwilu stopped from sitting in the interviewing panel in the search for a new Chief Justice to replace David Maraga.
Mwilu is a member of Judicial Service Commission (JSC) and Murgor is one of the candidates. The latter, in a letter to JSC, claims that there might be bias and favouritism towards another candidate, Senior Counsel Fred Ngatia.
Murgor claims that Ngatia had at one time represented Justice Mwilu during her vetting on suitability to be a judge in 2012 and that their relationship would present a conflict of interest.

The Judicial Service Commission (JSC) has constituted a five-member selection panel to begin assessing 13 applicants seeking to fill the position of Chief Justice.
The commission embarked on the process as people wondered why top lawyers, legal scholars and senior judges failed to apply for the top judicial job.
It was widely thought that the current Supreme Court judges would top the list of those seeking the CJ’s position, but none of the five judges applied including DCJ Philomena Mwilu who has been acting as the CJ since Justice David Maraga’s retirement in January.
