robert mueller. now the judge has said don t tell me what to do and if i were a cooperator, i would say it s really not up to the judge, which is correct, but it s a reminder, it is up to the judge. not mueller or the prosecutors? absolutely. with the distance of time you can start to think these things. let s bring glenn kirschner in on that point. what motivated the judge to appear to be harsher on michael flynn than prosecutors were and, to julia s point, is that possibly bad news for guys like mueller or prosecutors when they go in for a deal and the judge wants to be tougher than the prosecutors were? it s not ideal. ordinarily what happens is when we bring in a substantial cooperating witness on board, the judge knows that it s the prosecutors who really appreciate the full nature, extent and value of a cooperating witness assistance. what we do is we try to bring that to the court s attention,
