Proposed ANC custodianship of land serious risk to SA s future

South Africans are warned to take note of the grave implications of the proposals put forward by the ANC for amending Section 25 of the Constitution, which would not only sideline the courts in expropriation cases, but would explicitly push nationalisation of land, says the Institute of Race Relations (IRR). The ruling party has proposed that the following words be introduced: ‘The state must take reasonable legislative and other measures, within its available resources, to foster conditions which enable state custodianship of land and for citizens to gain access to land on an equitable basis.’ The IRR warns in a statement today that the effect of this would be to entrench nationalisation of land within the Bill of Rights, with legislation to define the exact terms.

This follows President Cyril Ramaphosa s announcement on Monday night that the ban would be upheld during the extension of level 3 of the lockdown until February 15. He also announced some changes to restrictions including the curfew, which will now be between 9pm and 5am.

The state-owned bank, SA’s biggest agricultural lender, reported an annual loss of more than R2.8bn for the year ended March 31 2020, according to financials posted on its website shortly after the early 12pm market close on New Year’s Eve. The results showed nonperforming loans almost doubled to R8.18bn, accounting for 18.1% of the Land Bank’s total gross loan book of R45.142bn.
