The State of Tennessee, including the Tennessee Bureau of Investigation (TBI) and the Shelby County District Attorney s Office (SCDAO) violated the Americans with Disabilities Act by enforcing the state s aggravated prostitution law and discriminating against people with HIV, the Department of Justice (DOJ) said in a press release on Friday, World AIDS Day.
The American Civil Liberties Union claimed a 1991 state law that charges HIV-positive people taking part in paid sex work with a class C felony is unconstitutional.
