California’s Safe Drinking Water and Toxic Enforcement Act of 1986, better known by its original name of Proposition 65, prohibits knowingly exposing any individual to a listed chemical without first providing a clear and reasonable warning to such individual.
Three significant actions by California with respect to PFAS; specifically, Prop 65 PFAS determinations that may have significant impact on businesses. Two determinations will further increase risks to businesses stemming from the sale of products that contain PFOS and PFNA.
California approved the listing of PFOS, one of the more prominent chemicals in the PFAS class, as a carcinogen under the California Proposition 65 Prop 65 laws. Carcinogenicity determination will further increase risks to businesses of enforcement actions.
