the administration has now been totally void by the supreme court. well, when i learned in as a child, i practice in politics if at first you don t succeed, try and try again. if this were to be declared unconstitutional, i think that the congress and the president will take a look at what the decision says and see whether or not things can be done to fix it. and i would hope that that would be our approach. rather than sit around and agonize over it, we ought to consider exactly where we are as a country, where we should be in having everybody insured, and see whether or not the supreme court gives us a road map as to how to get there. just a quick follow-up, though. there s been talk about, you know, sort of going after the court as an activist court, as a conservative activist court. is that something that is entertainable, or is the court off limits in terms of politics? well, in terms of the congress, i believe that it would be off base for us to do that.
today s mass shooting at a religious university in california. at least seven people died and three others were wounded after a gunman opened fire at a classroom at oikos university. it is a religious vocational and technical school in oakland, california. police say they picked up a suspect several miles from the scene. dan simon is on the story for us there. dan, we know this is a breaking story. what s the latest that you know? reporter: hi, jessica. let me set the scene for you here. we are near the oakland airport. this is an industrial area. there is a car dealership next to me and behind me about 150 yards or so is oikos university. we know that at 10:30 a.m. they started firing as you said and seven people dead, three more people wounded, and police at this time do not have a motive. according to one person inside the building at the time, the shots seemed to be coming from either a classroom or near the office area. as you said, one suspect has been arrested. that
can win without him, he s openly skeptical and said there is something unprecedented about what the administration did here. i would say this, anyone who judges how the court is going to rule based on the questions hasn t looked at the history of the questions before and then the results. would you consider a 5-4 decision along ideological lines in either direction the result of an activist court, as you say? well, i would say this. to over turn this would be a very activist court. starting with bush v. gore and then with citizens united where they took 100 years of precedence and allowed corporations and others to put so much money into campaigns when they hadn t been allowed before. and to uphold it on those same ideological lines, is that just as activist in your mind? well, the bottom line is, there is a broad tradition of support for extension of the commerce clause as i mentioned. as recently as 2005, a very broad case. there are two cases in the 90s that reigned in
something the center for american progress, a left-leaning policy group they say if this is voted down by the supreme court that people will sight for what it is, an activist court rendering a partisan decision. does that term activist court get some people off the sofa to vote. they are predicting a supreme court opinion that s going to be close and they are predicting the national reaction to it. you know what i think the american people are going to say? that s why we have the supreme court. they determine constitution at of tough cases. sometimes you win, sometimes you lose. i will say this. they make this an issue and try to make the supreme court basically on trial, that s such a non-starter that as a republican i would love to see that happen. i can t believe they are going to be that naive to try the supreme court clearly on an issue that will be closely
think they can dictate to the rest of us. you heard speaker gingrich reference the 9th circuit court of appeals. that is one of the courts he has suggested abolishing. a left leaning court and as he has done before he believes it is an activist court. a decision that was reversed by the supreme court leader. do you agree that the ninth circuit should be apoll george w. bushed and if is what would then happen if a democratic president came into office and a dem rally controlled. where it needs to end is under the constitution of the united states. that is the real issue are the courts following the constitution or aren t they following the constitution. it isn t just congress that gets it wrong. it is the courts that get it wrong as well. what do you do about it? what we need to do about it
