The Constitution of a newly democratic South Africa was promulgated by President Nelson Mandela in 1996 and came into effect on 4 February 1997. Not only is it the highest law of our land, but it is also widely regarded as the most progressive Constitution in the world, with a Bill of Rights second to none. As the supreme law of our country, the Constitution provides the legal foundation for the existence of the Republic, sets out the rights and duties of its citizens and defines the structure of the Government. The effect of constitutional supremacy is that all other legislation and actions by government and the judicial system are subject to the provisions contained within the Constitution.
