Chocolate, clothing helped police identify EastLink murder accused, court told

Two bags of clothing and a partly eaten chocolate bar helped police identify two men they believe murdered grocer Paul Virgona as he drove along the EastLink tollway, a court has heard.
Police and prosecutors allege Josh Rider and Aaron Ong used a semi-automatic handgun to fire 11 shots from a stolen Mercedes-Benz that drove alongside Mr Virgona’s van in Donvale about 2.15am on November 9, 2019.
Paul Virgona was shot dead while driving along EastLink.
Mr Virgona, 46, was hit at least seven times, lost control of his van and died at the scene. The father of two had been on his way to buy produce for work.

Police ordered to pay Mongolsâ court costs after abandoning gun charges

Victoria Police has been ordered to pay all legal costs in a failed prosecution of three Mongols bikie club members after the Office of Public Prosecutions dropped firearms charges connected to the alleged murder of Croydon fruiterer Paul Virgona.
Josh Rider, 30, Andrew Heil, 31 and Phillip Main, 48, were due to face a day-long committal hearing in Melbourne Magistrates Court on Wednesday when crown prosecutor Aggy Kapitaniak revealed firearms charges against the trio would be dropped.
