substantial issue in or issues that we raised. he just did not feel sitting at the bench that the substantial issues would necessarily result in a reversal of the conviction. reporter: so mehserle will now serve out the rest of his sentence. with credit for time served he has about six months left. his attorney says after he is released next year they will continue appealing his involuntary manslaughter conviction. we asked him why. this conviction stands, it may send a signal to other district attorneys in this county or state that it s okay to prosecute a police officer for making this kind of mistake because that officer mistakenly drew and fired a firearm instead of a taser. reporter: mehserle s attorney told us they are going to ask the court of appeal to review judge perry s decision today. oscar grant s family said they are going to continue to fight for justice and make sure mehserle held accountable for what he did. i m rachel kim, allen, back to you. thank
