When the statute provides a further remedy by way of appeal against the award, the High Court ought not to have entertained a petition under Articles 226 of the Constitution of India, the Court said.
The Supreme Court observed that in a murder case, once it is proved that all accused gathered at the crime scene with a shared intention to kill, it is immaterial that some of them had not caused injury to the victim.
Amount of compensation to be awarded cannot be in a straight jacket formula, rather it shall depend upon the facts and circumstances of each case and shall vary from person to person who has suffered, the Court noted.
