president obama has done by taking 98 or 99 provisions of the affordable care act and delaying them or postponing them or modifying them, my suspicion is the new york times would be there every day with editorials and democrats calling for his impeachment and so forth. the media won t do that with president obama. speaker boehner is thinking about using an entity put into existence by the democrats in 1993 called the bipartisan legal advisory group, which is leadership, democrat and republican, of the house. this group was set up to direct the office of general counsel and to direct him to take actions in legal cases. the blog was used to authorize a defense of the defense of marriage act by the house when the president refused to defend it when it was under a court
opposite of what most criminal defendants do. ch 90 to 95% of criminal cases end in guilty pleas. even innocents defendants would rather take a plea deal than the longer sentence if they lose at trial. joining us now is a san francisco public defender. nice to have you this morning. good morning, melissa. so talk to me about what it says about our system that 95% of defendants are pleading guilty and never having a trial. should that raise flags for us? one of the fundamental rights we have is the right to a jury trial. before a person can be convicted, a jury has to find beyond all reasonable doubt that the crime has been committed. 95% of people plead guilty. in some places it s as high as 98 or 99%. why is that? well, there s a couple l of things happening. first of all, prosecutors tend to charge every charge they can.
type of precedent does it make? it is horrible. my son wants to sing the answers to the test. my kid wants to write a brief. it is not burger king. and 98 or 99 parents will say take it and leave it at that. a small minority of parents and children. not even about the test. they are not good at attacking the standardized test. mart in other ways. obviously. it is catching the nation s headlines. and do you think that the school should have a provision set? georgia has no provision and we heard from the superintendant. they have an alternative assessment ininstrument and if the child is retakened and held back, then they have an option
me to be here because your show is one of the very few bright spots. essentially it s just gone flat since about 98 or 99. we looked at all the media platforms, at games, at movies, at directors, you know, just absolutely everything, and i think that part of it is that the resistance comes in the beginning to the first person. right. then when you get to be somewhere like a third it s like there goes the neighborhood. don t need anymore of that. yeah, right. so resistance comes again as it did in the beginning. right. we just have to plunge through that. do you think part of it is because we ve done a poor job of bringing up a generation of women in management who can actually make the hiring decisions so there s nobody there on that front end to make sure they re diversifying their own work force. we re not the people doing the hiring of women in management. right. people in management tend to hire people like them or people who won t make trouble so in my
