report is a wad that fixes everything, all we have to do is wait for mueller, is going to prove to be illadvised on the part of democrats. I think it would be more descriptive, more active, to quit calling it the cohen report when it comes out, but its more like a mueller dossier. We can put it next to the 2016 election, a little thing like barry bonds, will there
inadvertently violate the law themselves. bret: judge, standby, if you will, as we go through this step-by-step. we are getting new information. the doj not telling us much. asking how long is this report, the special counsel report, telling our producer they want tell us how many pages it is, but that it is comprehensive. also all this talk that the president throughout these two years was going to fire special counsel mueller or he was somehow going to be blocked from investigation. catherine herridge joins us again with more from that letter and the attorney general sending to capitol hill. this letter is very crisp and concise with its language and every time you read it, there s something else that comes to the fore, and a line has caught my attention. it s related to cfr 600.9 letter a3. that is a section of the code of federal regulations that relates
and which section in that that that requires barr to provide information from the confidential report? so i m just hearing all this now, so i don t have the regulations in front of me. but it s either 600.8 or 600.9. i think it s 600.9. we have the full screen. which requires a report in three instances. one, when a special counsel is appointed, when a special counsel is removed, and at the conclusion of the investigation. and yes, the white house is right to say there we did specify if the attorney general interfered with the investigation of the special counsel in any way, that triggered a specific report about that, about that piece of what he did. but overall, in the commentary that was published alongside it says the whole goal here is public confidence in the administration of justice. avoiding a cover-up, to put it simply. and if barr did something like this, which i can t imagine he d do, he obviously sounded a very different note at his hearings,
brown, chris, is their view they actually provide protection for presume. they said the plain language in the rules don t authorize or even contemplate a summary of the confidential report. it is not true. it is up to barr. if you want to look at it yourself, section 600.9 b. the notification requirement in the other paragraph about the confidential report, may be toll. what does that mean? tolled in law means held back, okay. held in abeyance for a period. time. the ag upon a finding that a legitimate investigative or privacy concern requires confidentiality, when that confidentiality is no longer needed the notification could be provided. however, in the next section it says, the ag may determine that public release of these reports would be in the public interest. so, you see, there s a point for or a point against. it comes down to the discretion of the ag. that s barr. remember this. if barr decides to be something less than those who speak well of him suggest about him,
