CHARLESTON — A woman is suing The Cold Spot alleging for the death of her husband.
Waleed Smeedy, the owner and operator of The Cold Spot, also was named aa defendant in the suit, which was filed in Kanawha Circuit Court.
Michael Scarbrough was a patron of The Cold Spot on Oct. 11, where he was sold and/or served alcohol and the defendants did not offer him a ride home, failed to call a taxi, Uber or Lyft and/or failed to call his wife to advise her to pick him up, according to a complaint.
Cynthia Scarbrough, Michael Scarbrough's wife, claims after her husband left the bar he was too intoxicated to drive his vehicle and drove it off of a roadway and into a grass embankment. Michael Scarbrough ultimately died due to injuries he suffered from the accident.
