Perjury. Were just learning the charges are perjury, false swearing and obstruction. Also abuse of office is another charge. We have reporters in this conference room. Were going to listen in to the News Conference as it begins. I think theyre just making sure everybody is in place. Ing at the d. A. In Montgomery County. Kathleen kane is 49 years old. Were seeing where and when theyre about to begin this News Conference. Here we go. Were here today to announce the filing of criminal charges against Pennsylvania Attorney general Kathleen Kane. The charges include obstruction of law and other offenses that relate to a scheme that we allege she original straighted to leak confidential investigative information and secret grand jury materials, and then lying to a grand jury to cover up and conceal her crimes. The genesis of this investigation is a referral we received in december of 2014 from judge William Carpenter of the Montgomery County court of common pleas who was also the supervising judge of the 35th statewide investigating grand jury. 9 referral from judge carpenter to Montgomery CountyDistrict Attorneys Office stem from a presentment that was issued by the investigating grand jury recommending criminal charges against attorney general Kathleen Kane. By virtue of the fact that the grand jury investigation was conducted not at a Law Enforcement investigation but as an investigation into a leak by a special prosecutor, the substance of the investigation was then referred to the d. A. s office. Before we had an opportunity to take action the Supreme Court of pennsylvania issued a stay in the matter which in effect prevented us from moving forward in any way. That stay was issued january 21st of 2015. The stay was in effect until the Supreme Court issued a decision on march 2015. First ruling judge carpenters appointment was appropriate and then lifting the stay. At that point in time we were free to proceed. Some of you will recall on april 1st of 2015, i issued a statement. And the statement promised a careful and thorough review of the presentments and if we determined an independent investigation was warranted, we would undertake that and we would review the entire matter with a commitment to fairness, integrity and justice. Over the next few weeks we began our review and on april 28th i had the occasion to issue another statement when another matter was referred to us from the court of common pleas. That matter related to potential retaliation against witnesses. And at that time again, i issued a statement and identified our process and that we would approach the investigation and the determination of whether charges should be filed, as any ethical prosecutor should that we would have an independent factual investigation, we would complete an independence analysis of the law and we would make charging decisions based upon the commonwealths proper burtd of proof at trial, which is beyond a reasonable doubt. And that is the process we have used. Standing with me here today is a team of career prosecutors who worked with a team of detectives career Law Enforcement professionals, to conduct an investigation to review the evidence that was gathered and to reach conclusions. These professionals have devoted their entire careers to the administration of justice. They are committed to fairness and to the operation of the system of justice that we have. We conducted an independent investigation and we reviewed the law. The investigators and prosecutors alike were meticulous, thorough detailed. And this investigation was as comprehensive as any we have ever done. We applied the law and we considered the commonwealths burden of proof at trial, which is beyond a reasonable doubt. We reached conclusions about whether charges should be filed. And yesterday at 10 30, i contacted the defendants counsel and advised him the charges would, in fact, be filed today. This Investigative Team determined the Pennsylvania Attorney general Kathleen Kane devised a scheme to secretly leak confidential investigative information and secret grand jury materials directly to political operatives in the hopes of embarrassing and harming former state prosecutors whom she believed whom she believed without evidence, had made her look bad. The affidavit of probable cause, our charging document you have before you, details how this scheme was accomplished and the crux of it was obtaining and compiling this confidential information, delivering it to a political operative with instructions to leak it to the press. All designed to make it look like a former prosecutor went soft on a corruption investigation. The motivation for these acts as exposed by the evidence we gathered and, quite sinkly in the attorney generals own words, this is war. This was her war, based upon the evidence conducted without regard to the rules, without regard to the law, and without regard to any Collateral Damage the battle might entail. The materials gathered and distributed in the course of this scheme were confidential investigative materials. And confidential information is protected in pennsylvania by a statute. In Law Enforcement we referred to it as chria, and it is detailed within the charges documents. What it does is prevents anyone from releasing confidential investigative material. So, when Law Enforcement has a file when they gather information, when they gather evidence, that information is protected. In addition to cria the materials were protected by grand jury secrecy. And its a separate act. A separate statute in the commonwealth of pennsylvania. That specifically protects materials that are collected by gathered by a grand jury in the context of a grand jury investigation. We allege that after illegally leaking this confidential information, the defendant then set on a path to conceal her actions and that culminated in her testimony before the grand jury here in Montgomery County last year. We allege at that time she lied repeatedly about her own actions, the law and about other matters simply to support her version of events. The charges we have filed today include obstruction of the administration of law, official oppression conspiracy, perjury and false swearing. The Prosecution Team that you see standing here with me is made up of the finest prosecutors in the commonwealth of pennsylvania. Led by First AssistantDistrict Attorney kevin steele, to my right. And First AssistantDistrict Attorney of bucks county Michelle Henry. Shes went sworn here in Montgomery County and the two First Assistants will lead the Prosecution Team. To my left antonetta, a special District Attorney here in Montgomery County, assistant District Attorney in bucks county and a former federal prosecutor. And she originally came to us as an employee here in this office before she began working in bucks county and worked with us in grand jury matters. To her left is deputy District Attorney tom chief of our trials district here in Montgomery County. To his left assistant District Attorney stuart ryan. These are the prosecutors who will be working on the case. And then to my far right, for those of you who are not familiar with them chief of county detectives sam gallon and chief of investigators. With the charges filed today, the defendant will at a time to be scheduled in the future surrender and be arraigned by imagine the straight district judge kathleen rebar. I do not have the specific information about that arraignment but i expect it to be within the next two days. It will be a public hearing and well notify you of when it will take place. Also filed today, we filed a a charge of indistrict criminal contempt against Patrick Rocco reese. Mr. Reese is the attorney generals special agent, a supervisory special agent on her protection detail. Hes also her driver. He is charged with indirect criminal content based upon the evidence we gathered which would prove that he secretly snuck into the grand jury files in violation of a protection order issued by judge carpenter. Judge carpenter issued this protection order on august 27th of 2014, amidreports that he received confidential information of the grand jury had been accessed inappropriately. After that protection order was issued, agent reese on a repeated basis snuck into the grand jury files and obtained confidential grand jury information. Arrangements will be made for mr. Reeses surrender. The investigation will continue. I have to thank a number of people for their work in this case. I need to thank the Investigative Team, those standing here with me as well as those not in the room right now. This team of investigators and prosecutors assumed a very heavy responsibility undertaking this task. They did it with a commitment to justice that is unparalleled. They were thoughtful strong very deliberate in what they did. They did not allow outside influences to impact their decisionmaking. Im very proud of the work they have done and the approach they brought to this effort. Ladies and gentlemen, this is a sad day for the citizens of pennsylvania and its a sad day for all of us in Law Enforcement. A prosecutor has the responsibility of administering justice. And when he or she does her job or his job honorably, as we should, we honor our oath we stand up and do what is right every day. When someone is entrusted with upholding the law, violates that oath and violates the law he or she is bound to uphold we are all victims. Every one of us. When an elected official violates the truth it is up to us to stand up and hold that person accountable. As prosecutors standing before you, we hold ourselves as we should to the highest standards. The laws of pennsylvania apply equally to all citizens. And we have the right as citizens to expect that those of us entrusted with upholding the law will follow the law. To arrive at the charges we filed today, we simply followed the evidence applied the law and made the decisions that were right under the circumstances. And our actions here today make one thing Crystal Clear beyond any doubt, that no one is above the law. Not even the chief Law Enforcement officer of the commonwealth of pennsylvania. Ill take any questions. Do you thank Kathleen Kane [ inaudible ] we completed this investigation following our responsibility and honoring our oath. And this was a very heavy burden that we had. Whether or not she should step down is a decision she will have to make and whether any action will be taken regarding that is something others outside of this room will have to address. Reporter why not arrest her today when you announce the filing of the charges . Certainly a possibility that we could have done but i was dealing with attorneys who are coming from out of town. As a courtesy to them, we coordinated to do it later. Since i called them yesterday, i expect she will be here within the next day or two. [ inaudible ] without question. Her attorneys were extremely cooperative. We are making those arrangements. Reporter there is no charge for contempt is that right . Im wondering why. Because the acts that gave right to the contempt were charged as the more substantive criminal offensive. In our judgment the act of contempt is really a lesser included offense. [ inaudible ] we have not filed anything related to mr. Barker today. But as i indicated the investigation is ongoing. [ inaudible ] i will correct you first. We did not investigate this case with a grand jury. Certainly, an investigation that was not investigated with the grand jury could not have been subject of leaks. I think it should be clear to everyone in this room that from the time this office took over the investigation, and during the time this team has worked on it there have not been leaks of information. Up until yesterday at 10 30 when i made the call to defense counsel and advised them information had not come out of this investigation. So we completed the investigation that was given to us and we have reached conclusion and taken action today. Do you suspect someone may have helped mr. Reese hack into emails . Im told he did not have the capability Technical Capability to do that so did he have assistant, conspirators that may have helped him get into the grand jury information . If you read through the documents, and i know you havent had a great deal of time to do it mr. Reese is one of a very few individuals that personally had access to that information. If he did not do it himself and if he had others, i do not have that information yet. Certainly well consider that and continue our investigation. Did you receive any alss that the attorney general has people following her . No i cannot. That did not happen i cannot say it did not happen but i cannot discuss it. Whats your understanding of that. No i cannot. [ inaudible ] we often in many of our cases have the opportunity to collaborate with our federal partners. I certainly cant discuss any of that this is a case where we did have discussions with them. You called it a sad day for pennsylvania. Youre also a longtime prosecutor yourself. From the view of a prosecutor whats your take on what youve alleged the attorney general has done your take . As you know, ive been a prosecutor for over two decades. I started here in january of 1993. One of the proudest days of my career is the day i put my hand on the bible and i swore an oath to support, obey and defend the constitution of the United States and the constitution of this commonwealth. And i have been very proud to be a prosecutor in pennsylvania ever since that day. To be surrounded by people who are simply committed to doing justice and doing the right thing. This investigation and the charges makes me profoundly sad. Give me a perspective on that because some people saying a politician not telling the truth is not earthshattering and grand jury information leaked is not earthshattering but once an attorney general is alleged to have done that to the average person, how big of a deal is that . People need to understand the oath we swear as prosecutors, the all of us standing here is to uphold the law. As prosecutors in pennsylvania we focus on doing what is right. We describe our mission as dot right thing for the right Mission Every day. We hold ourselves to the highest possible standards. Thats an expectation i have of myself and its an expectation i have of my fellow prosecutors. So to have a situation here like we do the attorney general, the chief Law Enforcement officer of the commonwealth of pennsylvania is alleged to have violated not just the law but that oath that we cherish is very distressing. Its not the way its supposed to be so it is a sad day for all of us. Go ahead. [ inaudible ] what it really comes down to when you have a team of Law Enforcement professionals who conduct investigations for a living, this is what they do every day, they have to be able to simply put ausd any personal concerns any challenges any difficulties and just do the job. Thats what the men and women standing here with me did. They put aside the fact that it was difficult, the fact that it was sad, that it was a violation of everything we stand for, that we were looking into and simply did the job. So i know its easy to look at it and say, it must have been difficult because, but ive been incredibly impressed by this team and their ability to simply get the job done to collect evidence, to analyze it and to do it in this pure way as possible. [ inaudible ] i dont believe i can address that. The membership card in the Good Ol Boys Network in harrisburg. I dont think they invited me. Allegations that its the Good Ol Boys Network in harrisburg that is against her doesnt come into this investigation . No. Certainly as you know and everyone in this room knows, every defendant under the laws of pennsylvania and the laws of this country is innocent until proven guilty. Every defendant has rights and they have the right to defend themselves and the right to a fair trial. And now that we have filed these charges, that process will move forward. And it has been conducted throughout the investigation as purely as it could be done with an eye towards what does the evidence show how does the law apply to these facts, and can we prove these charges beyond a reasonable doubt . And i think if you read the charging documents and if you review what has been filed, youll see the evidence expresses that. [ inaudible ] im not going to address that. How would you respond to anyone who says it appears the attorney general kane has gotten special treatment . Where an average citizen would have been brought in and cuffed. I think if you look around this room and you see the attention given to this case if there is any special treatment, i would say its negative treatment, not positive treatment. And we we organized our events today in a way that was most convenient for us so we took into account when our investigative needs were what our staff needed to be doing today and our ability to manage all of you here today. Attorney general Kathleen Kane is charged with leaking secret grand jury information and lying about her actions under oath. Montgomery County District attorney announced the charges less than an hour ago. She says kane leaked information to a political operative to pass to the news media in hopes of embarrassing and harming former state prosecutors whom kane believed made her look bad. She is expected to surrender in the next few days. Attorney general kane release aid statement saying she does not plan to resign. It also says quote, im very disappointed the District Attorney made the decision to pursue this case. I have maintained my innocence from the day these allegations surfaced and i continue to do so today. Well continue to follow this story.
