I will show you, we can move into it and we are right up next to the crime scene. See that house with the green roof . Down in the basement apartment, that is where this suspect was holed up for nearly six hours in this standoff. That large vehicle in front of it, that is known as the bear. That is a heavily Armored Vehicle used by the esu unit. That is what the men worked out of while they worked on this stand off and what they used to protect them when the gunfire began. This standoff began with gunfire. It ended in a halo of bullets leaving this troubled man dead. [ sound of gunfire ] reporter a series of gunshots shattered the quiet that surrounded the standoff. Then suddenly. The sound of a hail of bullets and concussion grenades followed. Police finding 38yearold garland tyree seen here on his facebook page, dead. He fell back toward the house. Reporter a small army of heavily armed officers as seen from news copter 7 rushed from their position in this small culdesac where they surrounded this house. The nypd showed extraordinary restraint and care. Reporter u. S. Marshals attempted to serve garland tyree a warrant for a probation violation. When they gained entry, they were confronted with what is believed to be a smoke bomb. We have confirmation one firefighter is down. No further information. Reporter two bullets striked 52yearold james hayes of engine 158 in the leg. Threatening injuries. As Emergency Service units began arriving, officers surrounded the house where garland tyree had barricaded himself in the basement apartment. Police say he was armed with this fully automatic assault rifle. Hostage negotiators began a dialogue. For the next four hours, we had periodic conversations with subject. Reporter larry johnson, a family friend, also tried to speak to garland tyree. I texted him. I dont know if i can get in there and talk to him. Reporter police had brought his mother from delaware to the scene. There was a very brief encounter, maybe three minutes i would say and they exchanged that they loved each other. And at that point, mr. Garland tyree indicated he was going to surrender. Reporter he left his apartment and started firing. But that is exactly what happened here on Staten Island this morning. Well tonight, im told the lieutenant is upbeat and recovering well after what could have been truly tragic. Mayor de blasio and the citys fire commissioner visited the lieutenants bedside this afternoon. Officials say the bullet struck james hayes in his hip and just above his ankle. But missed his bones and vital arteries. Very, very impressive guy. Cool, calm, collected. Making light of his injuries. Thank god, thank god his injuries were as limited as they are. Reporter the lieutenant was shot while leading his Engine Company into a home in Mariners Harbor where federal marshals has arrived to arrest garland tyree for a parole operation when smoke billowed from the home, they called firefighters to pull it out. There was no evidence that he was armed. There was evidence that there was a heavy smoke condition and an unknown number of occupants in the apartment. Lieutenant hayes was speaking calmly with the occupant of the apartment. Speaking calmly. Then he stopped. Lieutenant hayes was concerned he had become unconscious in the smoke in the apartment. That the other occupants. He entered the apartment to make a search at which time he was shot twice. Reporter firefighters learned only after the siege that the smoke came from a smoke grenade. Lieutenant hayes commands Engine Company 158 on Staten Island. He has 31 years with the fdny and two citations for bravery. His neighbors. Time. Hes a great guy. Hes a good man. A good family man. Traffic is moving along just fine after a dump truck accident shut down all lanes in boxbury. It caused problems for transit. But Maurice Osborne has already given this would be rapist a taste of street justice. He would do that right there . Right there on the platform and not care. It was shocking. Reporter maurice was riding the 3 train wednesday morning when the subway doors opened screaming. Police say the suspect, 40year old alvaro danika had already fondled himself and approached the woman. He was on top of her trying to do something. Reporter maurice rain toward the victim and punched the suspect repeatedly. Even dragged him to a nearby Police Station two blocks away. The distraught 28yearold woman following behind. I just picked him up. Started taking him to the police precinct. She was following and crying. Once we got there, she said thank you. Reporter maurice is living at a local shelter but is training to become a medical assistant while trying to put his own life back together, he possibly saved someone elses. New at 5 00, the new Jersey Police officer accused of exposing himself to drivers during traffic stops will not serve time behind bars. Tore two years probation. He pleaded guilty to tampering with records to conceal onofre professional conduct. The newtown Police Officer turned off his dashboard camera and exposed himself to at least five male drivers after pulling them over. The massive man hunt for two escaped prisoners in up state new york cost more than 23 million. State police and corrections departments paid about a Million Dollars a day in overtime during the search for richard matt and david sweat that happened back in june. Now that number does not include the cost to other agencies. One of the convicts was fatally shot, the other captured. New york is the largest state to ban the sale of powdered alcohol. I cant believe it we are open for business. Reporter just four doors down is the reminder why. They had to close their door ins february after the east village gas explosion that killed two people and leveled three buildings. They also left the restaurant with no gas. The owner who waited and waited to have the gas turned back on, but in the meantime, bills had to be paid. With help from the communitys crowd funding website, they are back in business again with a line out the door. First time in any my life, i really miss my job. We always fight for one day off.
