Eightyearold martin richard, 29yearold krystle campbell, 23yearold lu lingzhi, and 26yearold sean collier, the Police Officer shot as the tsarnaev brothers attempted their escape. 260 others were wounded. From the start, the tsarnaevs lawyers admitted he did it, but now in the sentencing phase they will try to convince the jury that he was under the spell of his older brother who sought revenge for the deaths of muslims in iraq and afghanistan. Don dahler is in boston for us tonight. Don. Reporter scott, when that last verdict was read out loud in Court Tsarnaev showed no emotion but someone sitting among the families of the victims let out a loud sigh, and another person was seen nodding emphatically yes. Outside Karen Brassard who had been badly injured in the bombings tried to put these verdicts in perspective. I dont know what justice is. Im grateful to have him off the street. Im grateful to show everyone, the world that its not tolerated. This is not how we behave. Reporter this was perhaps the most digitally documented terror attack in history. Nothing during the trial had the impact and shock value of the surveillance images. Jurors were shown neverbeforereleased videos of 19yearold dzhokar and tamerlan boylston street that fateful day the defendant setting his backpack down and running away after it explodes. Ed davis was Bostons Police commissioner at the time. I think the videotape that youve seen a piece of from the Forum Restaurant is the most damning piece of evidence. Reporter it was a willful act, setting a backpack down just feet away from his youngest victim. Reporter right. That happened because of the acts of this particular individual. Reporter that youngest victim eightyearold martin richard. His father bill described make the sophies choice between seeing to his grievously injured daughter and comforting his boy as he took his final breath. Investigators called from 13,000 videos and 120,000 stills to track the tsarnaev brothers including the younger tsarnaev less than 30 minutes after the bombings, casually buying a gallon of milk. And then three days later, the brothers stalking and killing officer sean collier. A carjacking victim, dun meng told a transfixed court how a calculated dash saved his life. Its the most terrifying moment he said, the most difficult decision in my life. But that decision directly led to the police being able to track the brothers to watertown. gunshots the older tsarnaev was killed in the ensuing shootout. The younger brother. Managed to escape. Badly injured he hid in a boat where he wrote a confession blaming their action ogz the wars in iraq and afghanistan saying, the u. S. Government is killing our innocent civilians. In all prosecutors put 92 peninsulas on the stand and submitted hundreds of pieces of evidence from bomb parts to jihadist bomb making literature found on tsarnaevs computer. By contrast, the defense, which on day one admitted their client did it, presented only four witnesses and scant evidence, saving their efforts in order to save Dzhokhar Tsarnaevs life during the penalty phase. Scott, judge otoole is giving the jurors a few welldeserved days off before the penalty phase begins next week. Pelley don thanks very much. Vinita nair has been listening to what victims and their families have had to say. Reporter he was one of two Police Officers involved in the gun fight with Dzhokhar Tsarnaev a bullet hitting him in the leg severing a major artery. He almost died. His colleague and friend, sean collier, lost his life. Donahue was driving when he heard todays verdict. Had number one came down as yes, orgguilty, it was like, okay, were one step closer. And then we got through 30 of those blocks to get the full picture and to get the right results. You know, of course when under 19 it pops up and its your name on the screen, and you see that its guilty, its definitely a big relief. Reporter he was in the courtroom for much of the trial. You had a chance to look at him in the face. I did. Reporter what did you think when you saw him . Thats the guy. Thats the guy that that was involved in killing my friend. Thats the guy that that changed so many lives. Thats the guy that it took lives and and injured people and carried out a heinous destructive act in the city of boston. Reporter officer donahue told us he has practically no memory of the shootout after the bombings but after the bombings. But he sphrfers severe pain as well as nerve damage. As for had if he wants the Death Penalty, scott he told us at this point hed rather not comment. Pelley vinita nair thanks. Rikki klieman has been both a prosecutor. A criminal defense attorney, and shes now our cbs news legal analyst. Rikki, what happens next in this penalty phase. After the guilty verdict that we have heard we will move to a penalty phase next week. The government goes first, and the government will introduce evidence of aggravation. They have saved withins. Theyve saved little Martin Richards mother Martin Richards died at the age of eight. Theyve saved the double amputees. Were going to hear horrific evidence about why he deserves death. Pelley theyll all be called as witnesses. Correct. Then it is the defenses turn. This is their time to woo the jury, if they can and they only need one scott. It is unanimous verdict for death. One vote against it is life imprisonment. So what well hear from judy clarke and her colleagues probably is evidence of psychological nature experts who will talk about who this young man is, why his will could be overwhelmed why he could have been intimidated, why he could have gotten into jihad at the behest of his older brother. We may also hear from relatives from friends who can talk about his change. He was a normal teenager. How did he become the person who allowed himself to do this terrible act . Pelley Rikki Klieman our cbs news analyst, thank you rikki. Thank you. Pelley in another important story, Michael Slager could get the Death Penalty if he is convicted of murdering walter scott. Slager was fired today as a North Charleston South Carolina Police Officer after the shooting he was involved in was caught on video. Heres vicente arenas. I i have watched the video and i was sickened by what i saw. Reporter North Charlestons chief of police was quick to distance himself from this explosive video. We havent seen any video that shows what led to this but according to the Police Report it started with a traffic stop for a broken tail light outside this store. The driver, walter scott, took off running after being pulled over. When the video starts, you can see the two men struggling. Officer slager had apparently fired his taser. As scott broke west africa the taser wires were still attached to him. The object then either falls or is tossed to the ground as officer Michael Slager draws his gun. Slager said he feared for his life. Slager fires eight shots. And scott went down. Moments later, officer slager radioed for help. Later on in the video slager ran back to pick up an object and then dropped it near scotts body. Anthony scott is the victims brother. If the video had never surfaced, i dont think we would have had the results as soon as as we did with what we have. Reporter the video was shot by a local barber. A woman at this local restaurant, who says she used to be his boss, says she watched the video soon after he shot it. She says he told her he was afraid of the police. I said, you know, you dont have to be scared. You know, this is america, you know. They can protect you, you know, by that kind of stuff. Reporter slager has been an officer for six years and was with the coast guard before that. He had one prior complaint of unnecessary force with a taser. He was exonerated. More video from a Police Dashcam is expected to be released tomorrow. There was also a passenger in scotts car, who may have witnessed what happened. The citys mayor told protesters he doesnt know if other officers at the scene will be disciplined. The Police Report says they tried to administer cpr but there isinose evidence of that on four minutes of video. Scott, there were seven officers on the scene that day and theyre still being questioned by investigators. At this time, we dont know why walter scott ran or why that bystander started shooting that video. The former officer is still in jail and could face the Death Penalty if hes convicted. Pelley vicente, thanks very much. This case comes eight months after the Fatal Shooting of an unarmed black man by a white Police Officer in ferg son missouri, set off protests and a national debate. That officer was exonerated, but changes are now coming to the city. Voters have just added two more African Americans to the city council, and Michelle Miller is in ferguson. Reporter bell, a 40yearold lawyer and criminology professor, says hes proud to be a part of a historymaking council with three white members and three black members. In ferguson since the shootings, volunteers got sixth 8 new voters registered. Eric fey is director of elections. Its fairly uncommon for local municipal elections to have a lot of people going door to door and handing out leaflets, definitely not to the extent it happened in ferguson this time. Reporter councilmanelect bell says in light of the scathing justice deps report, hes looking forward to make a difference. We have a chance with the world watching to show what change can look like so that can have a positive Ripple Effect throughout the world. Reporter ballot results wont be official until a mandated audit is finished by the board of elections but scott, if all goes as expected, those three new City Council Members will be confirmed on april 21.
