>> thank you, monika. making news at 5:11, a large cross displayed on public property in california for decades is now deemed to be unconstitutional. >> the 43 foot tall mt. soledad cross serves as a war memorial in san diego. tuesday, a federal appeals court ruled that the cross violated california's constitution. in the decision, the court said using such a distinctly christian symbol to honor veterans sends a message of endorsement and exclusion. the ruling is expected to be appealed though. federal prosecutors in new york are looking into claims that sanitation workers sabotaged the city's snow cleanup. after last month's blizzard. it took several days to pile all of the city streets after the storms dumped 20 inches of snow. une officials say the sabotage rumors are false. >> and some of the nation's top experts are now investigating the mass death of birds in two southeastern states. as many as 5,000 birds fell from the sky in arkansas on new year's eve. another 500 found dead in labarre, louisiana. preliminary reports say the birds likely died from some sort of massive trauma. still to come on 9news now, could the caps regain the first place in their division? >> making news now at 5:51, prince george's county police are investigating another shooting near the iverson mall and temple hills. >> before midnight, four people were shot. this happened in the 4000 block of norcross street. one person died on the scene. right now, we have no word on their condition. more than 8,000 homes are damaged in china's province after dozens of tremors there. state media in china says 92 minor earthquakes hit the area since the start of the new year. over 80,000 people are living in temporary tents there. luckily, no injuries reported. the province is located along a very active seismic belt. a ninth grader in bethesda, maryland is in trouble this morning for bringing an air soft gun to walt whitman high school. another student passed a note to the teacher telling her to check the 14-year-old's bag on tuesday. that's when they found the air gun and 200 pellets inside. 9news now was there as the boy left the montgomery county police station. just hours after he was arrested. i think it is shocking that they -- that it is so easy for students to bring this stuff to school. >> school officials are taking the incident very seriously. and say the freshman could be suspended or even expelled. the boy is a straight a student with no previous criminal record. so, do you think you know everything about your spouse?
