Death of fairfax native and uva sophomore hannah graham. Peggy fox was there and has this live report. Reporter the Biggest Surprise is we dont have a capital murder charge. Capital would mean that they could pursue the death penalty. We do have a firstdegree murder charge against Jesse Matthew. We also have abduction with intent to defile. He had been charged with that in charlottesville. Its moved over here to Albemarle County. He also faces reckless driving charges from the time he is said to have fled authorities when trying to question him about Hannah Grahams disappearance. Let me take you back to that time. The second uva student secondyear uva student, hannah was seen leaving a bar with Jesse Matthew. After intensive searching, her remains were found on an abandoned property in Albemarle County on october 18. Matthew is currently incarcerated in fairfax where hes facing attempted capital murder, rape of a fairfax woman in 2005. The commonwealths attorney would not touch on why they are not burr suing capital charges, whether or not theres not enough evidence at this point or something else. Heres what she did say about the firstdegree murder charge. The charges that the jury will hear are the charges that the prosecutor feels comfortable and feels the prosecutor has probable cause to bring. In this case firstdegree murder and intent to defile. The abduction with the intent and the firstdegree murder are 20 years to live. Substantial penalty that the jury will be able to consider. Reporter prosecutors do say that they have d. N. A. Evidence linking Jesse Matthew to hannah graham. They also say they have d. N. A. Evidence linking him to that rain in fairfax and prosecutors say they have d. N. A. Evidence linking him to the disappearance of morgan harrington. She was the Virginia Tech student who disappeared from charlottesville back in 2009. Her remains were found about five miles from where Hannah Grahams remains were found. Jesse matthew is not charged at all at this point in morgan harringtons case. He is expected to appear for his First Court Hearing in Hannah Grahams case coming up february 18. He will make that appearance by a video link from the fairfax jail. The critics say early start times are leaving children sleep deprived and has a negative effect on their ability to learn in the classroom. Bruce leshan is live outside School Board Headquarters in rockville with more on the impending vote. Have they voted yet, bruce . Reporter they have not voted yet as of five minutes ago when i walked out of the hearing room. They were still debating this. Theres been a clearly massive issue. A lot of High School Students saying please, please, we need to sleep in just a little bit. They actually had a sleepin here overnight pushing the board of education to let them start school just a little bit later. It looks like were going to have a slit vote. What weve heard in the debate so far is some members of the board of education want to make schools start later and other members say the impact is just too great. Financially on the School District which is currently struggling with the budget deficit and as well on some low income families, questions about them and their child care. The idea that is being debated right now is actually flipping school start times. And so elementary School Students would actually get out earlier, have to start school earlier and high school and middle School Students would get to start school later. It would be a significant impact, almost an hour for High School Students that they would get extra to sleep. But elementary School Students in tier one, im not sure exactly what that is but would start at 7 45, high school 8 50. Middle school 9 30. Im going to go back in. Were expecting a decision any minute now. A lot of students, a lot of parents want to know if Montgomery County schools will start later. This can be accomplished by integrating Character Education and citizen education into our schools n. Is something were passionate about and a lot of residents and voters are passionate about. Its one of the reasons i came up with this measure, but its one of the reasons why i threw my hat into the ward 4 council race as well. How do you go about setting a character curriculum or how is it woven into the school day . I would imagine youre going to have to ask for a lot of input on n. You cant just on this. You cant just do it by yourself . This measure actually has a panel of 15 individuals i five of which are secular and religious community, Law Enforcement community, teachers, administrators. So its a wide Broad Spectrum is involved in sitting down and making recommendations to the mayor, the council, the d. C. Council and other educational standpoints on how to integrate social development back into our schools so we can take our kids to the zoo and enjoy the zoo. We can go into gallery place and going to the movies and so forth and some kids can go to school and engage in instruction and not in fear of just violence. How do you get this done . What is the next step to bring this before voters . What do you have to do . This initiative has actually been posted in the d. C. Register. Its actually going to be there for another five to ten days. It will be pulled off and after that the petitions will go out and will actually be particular lating petitions to be circulating petitions throughout the community to make sure we get enough signatures to make sure we get this Important Initiative on the ballot for the 2016 ballot. Roxy heart is a woman whos who always wanted to be famous and a vaudeville dancer. She has not had much luck until she finds herself in a situation she kills somebody. That will do it.
