celebration of his father's birth. but neighbors ring countries -- but neighboring countries believe that celebration could include a missile test. >> this is dangerous. it's provocative. >> reporter: secretary of state john kerry just wrapped up a trip to the region. he says even if kim jong un tests a missile, he's still prepared to sit down at the gerkting table. >> if he -- negotiating table. >> if he will meet the obligations that we have all set out that are necessary, stopping the provocation, ceasing the threats, moving away from the nuclearization, we're prepared to gerkt on a full range of issues. >> reporter: but north korea rejected an invitation from the south for peace talks. >> the problem is with the unpredictable north korean leadership, we do not know what they want. do they want to escalate further or sit down with talks. >> reporter: secretary kerry believes north korea is not happy with its european allies. u.s. leaders will meet with the chinese with the goal of persuading kim jong un to end his nuclear program. teresa garcia, cbs news. key measures of new york's new gun law will go into effect today. anyone with a gun which has been reclassified as an assault weapon is required to register it. the measure also places new limits on the number of bullets which will be allowed in gun magazines. the national rifle association says it plans to head to court to ask for an immediate halt to the magazine limit. the new measures take effect just days before the senate is expected to vote on a measure to expand federal background checks for gun buyers. with senators working on a bipartisan bill to overhaul the nation's immigration system, they believe that they could introduce the legislation tomorrow. republican senator marco rubio says the bill will provide a path to citizenship for the estimated 11 million undocumented immigrants in this country. however, he says, it will not be amnesty for those who entered the country illegally. the supreme court is hearing two sides of a case that could have big implications for medical research. the question is, can a human gene be patented? danielle nottingham has more. >> reporter: the biotech company myriad genetics argues its patent on the human gene is valid. the genes can show if a person has a greater chance of breast or ovarian cancer. but opponents argue that genes are part of nature and that no one the right to patent a part of the human body and they claim patents block other biocompanies from testing on the genes which could prevent potentially life saving cancer breakthroughs. the supreme court's ruling could have an impact on other patents for vaccines, antibiotics, stem cells and hormones. biotech companies argue what they're patenting is not a part of nature. >> instead what is being patented are d.n.a. sequences that are isolated away from nature, manipulated in the laboratory, and then used in an industry type of matter. >> reporter: opponents are also complaining that muriad is not allowing patients to get second opinions on its test results. kathleen says she was diagnosed with ovarian cancer after a test showed women in her family did not have the predisposition gene. >> they were the only game in town to go to. the product wasn't what they advertised it to be, it wasn't a comprehensive test. and i have cancer because of it. >> reporter: the supreme court's ruling is expected in gene r june. danielle nottingham, cbs news, the supreme court. synthetic marijuana is one step closer to becoming illegal. the d.n.a. has changed the classification of the substances known as spice and k2. they cited the popularity of the drug and public health concerns and the move means that a ban on these substances can begin within 30 days. five other forms of the fake marijuana were banned two years ago. police have tracked down a missing fairfax county boy and his mother in alabama. cameron serafin was due back at his father's home a week ago after spending two days with his mother 32-year-old rebecca serafin. she also goes by the name rebecca lover. detectives say they are concerned for the boy's safety. they are issued a felony arrest warrant for the mother. rehoboth beach police are promising an internal investigation after an arrest that was recorded by a cell phone camera. we would like to warn you that this video is disturbing. it shows officers repeatedly using a taser in order to subdue a man. at one point the man is kicked in his head. the suspect is a 34-year-old man from pennsylvania. he says he was on vacation when he got into a confrontation with a hotel worker. well, that's when police were called and the man's pregnant wife started recording the incident. >> officer, can i just take him home? he's my husband. i'm pregnant. i'm stressed. >> he's resisting arrest. >> but they've been tasing him like crazy, kicking him in the head. guys, listen, i want to take him home. >> police say he made a threatening gesture toward an officer. this afternoon the man has been charged with disorderly conduct, resisting arrest and offensive touching of a law enforcement officer. still to come when the claiming responsibility but al qaeda and other sunni groups have been implicated. the bombings come just days before the iraqis vote in elections. a new fee involving the national september 11 memorial and museum is causing controversy. the museum is charging a $2 fee for visitors who reserve passes online or over the phone. the memorial president joe daniel says that the fee is necessary to help support operations. family members of some 9/11 victims say the fee violates the memorial's mission. the memorial's website says that that reservation fee is temporary until some of the passengers jumped into action when a man fell on to tracks while a train was approaching. surae chinn talked with the father-daughter team who saved that man's life. >> reporter: jennifer buchanan from annandale, virginia, and her father kent wright who was visiting from massachusetts were on their way to a caps game thursday night. the excitement was supposed to be at the rink on ice, but all the adrenaline would happen during pre-game. and since they're on vacation this weekend, i interviewed them through skype. >> i could see the lights of the train in the tunnel. >> reporter: a man looking down on his cell phone stepped right off the platform into an oncoming metro train at pentagon city station. >> he slipped off the track right in front of us. >> reporter: you can barely make out in this metro surveillance video the man falls down on the tracks. >> he's laying right on the rail. on his face. >> reporter: the crowd gathers around on the platform to see what happens next would save the man's life. >> i got down on my hands and knees. my daughter got down on her hands and knees. i reached down. i said give me your hand. i don't know the train was coming. i just grabbed his hand and yanked him up. my daughter grabbed his leg. we rolled him on to the platform. >> reporter: the quick thinking and mere seconds prevented a tragedy and according to the pair, it was pure instinct. >> i think the guy's alive because we didn't think. we didn't hesitate. as soon as we fell, we were both on our knees by the edge of the tracks pulling him up. >> reporter: it started with a man distracted but ended with a focus of one main goal. >> when i reached down. >> and we pulled him up. >> reporter: the man they helped save is a mystery to them because the father- daughter team went on to the caps game but not before a little gratitude. >> he goes thank you. you see this on the news at different times and you say, i wonder what i have double. well, now we know. >> yes, now we know we would have done the right thing. >> reporter: metro is not releasing the identity of the manual they saved. the father-daughter pair do say that the take away from all this, don't be distracted. stop looking at your cell phone or what have you and pay attention to your surroundings at metro or anywhere else. you may not have good samaritans around to save you. i'm surae chinn for bad start to the week but not a great start to the week. clouds, a couple of sprinkles this morning. we're pretty much done with most of the real sprinkles. we may see one or two this afternoon but i-81 corridor. outside on our michael & son weather camera, cloudy skies. not this dark but it is a cloudy afternoon, 61. national reporting light sprinkles on the hour with a dew point of 46. here in northwest it is dry. wind out of the southeast at 6 miles an hour. it has not been dry out west. this has been a rather snowy period. more snow falling. bismarck 17.6 inches of snow yesterday alone. that was a record for them for a 24-hour period in april. looking at showers moving in toward michigan. more snow now coming in toward denver. they're going to get 4, 5, 6 inches of snow later on tonight and tomorrow. as this thing moved away, the upper level support was lost for much of these showers. we still have lots of clouds around with a few breaks in the cloud cover but generally we're looking cloudy for the afternoon with a stray sprinkle. southeast winds hit the ridgetops out west, it will squeeze out a little drizzle or a few sprinkles tonight into tomorrow morning. then tomorrow we'll burn it all off and in the afternoon looks like we'll be sunny here with a chance of a shower out toward i- 81 and points west. a better chance for us on wednesday. so mid-60s today with the isolated shower. back in the low to mid-50s tonight, some spotty drizzle. we'll burn that off and turn partly sunny in the afternoon. 77, a warmer day on tuesday. 80'ish on wednesday. i'm counting on a front to stay generally north of us. if it sags south, we'll be lowering that number with a chance of afternoon thunder. friday, friday night, better chance of some rain before cooling off for the
