Council passes the measure today, washington would join 15 states and a handful of cities that have decriminalized marijuana use. As you said, there is agreement on the basics here. The mayor, a majority of Council Members, they agree there should be no criminal penalties for smoking small amounts of marijuana inside your home. After that, the chairman of the d. C. Council Phil Mendelson thinks smoking pot in public should still be a crime. The first concern has to do with whether were going to treat the open use of marijuana in public spaces differently and more leniently than we treat alcohol. Reporter Council Member tommy wells sponsored todays bill. He wants criminal penalties eliminated. Instead he wants the act of smoking pot in public to be treated kind of like a parking ticket. 25 for foe saying less than an for possessing less than an ounce. 100 for actually smoking pot. Right now its a misdemeanor carrying up to six months in jail or 1,000 fine. The other issue being debated is whether its legal for police to be able to use the smell of marijuana as probable cause to search a car or home. If Council Members cant reach an agreement today, the whole bill could be tabled, and that may not be what District Residents want right now. A Washington Post poll last week showed 63 of folks who live in the city are in favor of legalizing marijuana. Theres even a group of district activists who want an initiative on the November Ballot to legalize small amounts of pot for personal use. They say after his escape sunday night, elliot kidnapped a woman and commandeered her car to make his get away. She later got free and called police when they stopped for gas. Investigators are tying to determine if the drug was mixed or tainted with anything else. Police suspected 46yearold overdosed. Some the misdemeanor stop them from getting a job . Is the law unfairly targeting young africanamerican men . These are some of the big social questions behind the bill that goes before the council today but there is agreement for the most part on the basics. The mayor and a majority of the council agree there should be no criminal penalties for smoking small amounts of marijuana inside your home. Council member and mayoral candidate tommy wells wants to take that even a step further. He sponsored todays bill and thinks if you get caught with marijuana in public, you should only face a fine. Im not willing to make it a criminal charge where you could be arrested and locked up and put away for a while because youre caught smoking outside. This is the whole point. Reporter in a city where the Unemployment Rate stands about 2 Percentage Points higher than the national afternoon, some offenders say marijuana convictions have prevented them from securing even entry level positions. And theres the question of irthe bill was motivated by an aclu study last year showing that washington, d. C. Has the highest marijuana arrest rate in the nation. Blacks were eight times more likely to be arrested than whites. As it stands right now, a pot conviction in d. C. Could get you locked up for six months or you could face a 1,000 fine. Under todays bill, youd be ticketed. 25 for possessing less than an ounce or 100 for smoking pot. Thats about the same penalties as a parking ticket. Some on the council think that doesnt go quite far enough. Penalties are stricter for alcohol use in the district.
