The defense is saying no, that interpretation is an overreach and for it to be an official act the governor needs to actually g a contract or job or other concrete benefit to Jonnie Williams and star scientific. So at the end of the day the question is whether or not the governor crossed the line into criminal conduct, but where is the line . Its the capriciousness of the judge at this point. Its what the judge decides to give to the jury for instructions . It needs to still be based on Legal Standard and law because if the judge issues jury instructions that are arbitrary and capricious, he could get overturned on appeal.
