Ber at the time of his apparent suicide but was struggling with depression and anxiety. Less than an hour ago the prosecution rested in the corruption trial of former Virginia Governor Bob Mcdonnell and his wife maureen. Peggy fox has been covering this case from day one. She joins us live from richmond. Reporter the prosecution rested about a half an hour ago. The jury is off tomorrow after hearing what could be the strongest day yet for the governments case. A lot of people are wondering how is it your family racked up so much in credit card bills . Well, thats why were going to put on a case. Are you really eager to. Its tough running for governor, you know. Reporter it may have been another tough day in court. The prosecution displayed all those luxurious gifts Jonnie Williams gave to the mcdonnells, all the designer clothes and accessories that he bought for maureen mcdonnell, the golf bags, clothing and clubs he bought for Bob Mcdonnell and his sons and that 6,000 role bought for the governors wife to give to him on christmas. Those items had been discussed. They needed to be introduced into evidence. They are clearly relevant, but the government made the best of it and with a little showmanship wield those things before the jury today. Reporter the prosecutions final witness fbi agent david hulser took the jury through a timeline of emails, texts and phone calls. He tried to show that for every gift the mcdonnells received there was communication between them and williams and also action by the governor. I think the prosecution has done an excellent job proving the corrupt intent here. Again what the jury will think about how Bob Mcdonnell responded and did he take an official action on the part of Jonnie Williams still to me is the open question. Reporter the defense says there was no official act helping Jonnie Williams. Williams wanted the governor to help approve Tobacco Commission money to test his product. Today the defense asked agent hulser if he found any calls from Bob Mcdonnell to the Tobacco Commission and he said no. So the defense begins monday. At 6 00 hear what governor Bob Mcdonnell thinks about the prosecution resting its case today. Im peggy fox reporting live in richmond. Back to you. Ted cain is a partner at austin and byrd where he specializes in white collar defense. Before that he was a federal prosecutor in the Public Integrity section which is prosecuting the mcdonnells integrity. Big question for this entire case here, the prosecution has rested. How would you rate their job so far . Thanks for having me back. Overall i think the prosecution has to be pretty happy with the way the case went in. They started off with a few road bumps when Jonnie Williams took the stand, didnt put a lot of direct evidence on the governor, but theyve recovered nicely and put forth brick by brick a fairly strong circumstantial case against the governor. Theyve put forth evidence of the financial distress the first family was in suggesting motive. Theyve shown over and over again the close timing of events between acts and gifts and theyve put in evidence that the governor himself might ve taken steps to conceal the money he was getting from Jonnie Williams and i think overall the government now has a lot of ammunition to argue in closing arguments to the jury that hey, look, theres no other reasonable explanation for all these events other than to come to the conclusion that the governor knew and intended to trade official acts for gifts and loans from Jonnie Williams. But before those prosecutors can get to their closing arguments they put sort of their closing person on the stand over the past couple days, an fbi agent testifying about the scope of the investigation, but the defense is using that same witness to say prosecutors, you were targeting the governor. You were going after him. Thats absolutely right, lesli. Agent hulser who testified today as an fbi summary witness and essentially he is an agent thats been working the investigation from the very beginning and it can be a double edged wonder, obviously hes kind of sword, obviously hes kind of a prosecution main witness to sum up the theme of the case, but the defense is bring out those questions for their main theme of the case on cross. Ive got to ask you quickly about this sweetheart immunity deal Jonnie Williams got. Youve been on the other side of this. I mean what would make you give someone blanket immunity so that a, none of that could be used against them and b, you cant go back and charge them with anything . Well, you make a very this is a different type of immunity deal they gave to Jonnie Williams than typically the prosecutors give. They usually give whats called use immunity which only shields the witness from having his testimony used against him. In this case the prosecution says we cant charge you with anything at all related to the mcdonnells. I think the prosecutors made the decision they had to do that because there was some information that only Jonnie Williams could provide that could eventually lead to a case against the governor and the first lady. We have should hear from the governor in the next couple weeks. Ted cain, thanks so much for joining us. Thank you.
