Youre a defense attorney. At this point in the trial what grade would you give them . I would give both as. Everybody is doing a great job. Theyre doing the best with the evidence they have. Little setbacks here and there, things hurdles, proving points. Its part of the game. Its what they do for a living. Earlier you said one piece of this case that hasnt got an lot of play can whether Bob Mcdonnell, if anything he did was actually an official act. Why is that so crucial . To prove a bribery defense, you need three things, you need to prove there was an offer. You need to prove whether its circumstantial theres acceptance and an official act for that offer. You can see the government trying to prove you have Jonnie Williams. But youre saying that right now proving there is an official act, there had to be an official acceptance or you have to see the actual act . Circumstantial evidence of an acceptance is fine but you have to see some kind of act. It would be the bribery offense they need to get Bob Mcdonnell convicted. Its just not there yet. At this point do you think we would have already seen that at this point in the trial . They have more witnesses coming up. At the end of the day the judge will give his instructions to the jury.
