Two counselors, at addiction facility, they are the once counselling, helping to treat people that are there. Theyre dead from apparent overdose. The counselors . The counselors. They were working to help others, overcome addiction, like alex says, but tragically they lost their own battle. Sometimes, in fact, i think many times, facilities around america, the counselors were former addict themselves. Jenny joyce in west chester, jenny . Good morning, mike and alex, yes, clearly, it helps you understand that addiction is a lasting battle for many people here. We are live at the Chester County District Attorneys offers which is now investigating the death of these two counselors. Police tell us that they were called to the freedom bridge recovery house in west brandywine township sunday afternoon around 1 30 to find two counselors who were working here to help others recover from drug addiction, dead in their bedrooms from overdosing on heroin and phentinol. Used needles and drugs were found inside the bedrooms, six client are set to live in the home with the counselors, according to a source, all were drug tested, after the bodies were discovered and the client are clean. They are the ones who tried to use narcan on the counselors to save their lives. But it did not work. These types of recovery homes are not regulated in the state of pennsylvania, after this case, it is likely there will be a call for greater oversight. District attorney hogan is pushing for regulations on these facilities. It is so bad that even the people who are the counselors, who are trying to treat people, and keep them from relapse g into addiction, are subject themselves to relapse into addiction and dying. Law enforcement Officials Say the heroin baggies have superman and danger logos with the skull print on them. The Chester County District Attorneys offers is warning anyone who may come across these bags to stay away. This is heroin believed to be laced with phentinol. Because are they real questions or questions hes asking in a phony fashion because he already knows the answer to . And yes, thats a strange question. Why would you leap to that . Im not on the jury. But, see, it is good you bring that up, when i heard that im like geez why would he even ask that . Why wouldnt he ask who took him . Who took him . How did he get there . Were his socks all dirty . But to ask whether he drowned . Obviously they dont have autopsy. But again his lawyer told the jury in closings, hey, look, we all react differently to hearing a loved one die. So dont hold that against him. No one can predict how you would react in that kind of situation. Again, what mud thinks case here is that they never determined the cause of death. You know, unusual. Four white women, six white men, one black woman, and one black man. They will travel to Montgomery County for the trial it will will begin on june 5th. Cosby, who hasnt really spoken much in public, only one time, that was a radio interview, had a message for supporters, as he left the courthouse yesterday. Let me tell you why he want add africanamerican jury. This racial overtones to this case. Mr. Cosby has even spoken about the potential for, you know, this to be racially motivated. The charges against him. Let me make contrast here, i would love to hear your jury consultant what he thinks about this. Back in the o. J. Trial, nine africanamerican jurors, one hispanic two, cause case. I can tell that you Brian Mcgonigle on behalf plaintiff cosby would love the make up this jury the same as the oj jury. And the reason for that, if i were representing mr. Cosby, my target jurors would be africanamericans, between the age of 55 and 65. Why . Because the cosby show is on nbc from 1984 to 1992. He was known as americas dad, mr. Cosby, everybody loved him. Anybody that was in that 55 to 65 year age range would have probably been a parent during the time that the cosby show was on. Okay. That would have been my target audience. Do you agree with him, mark . Sure. I mean, if you were able to absolutely hand pick the people that you might want, i would agree. You know, the make up, so the o. J. Simpson trial in longs less, different venue, different make up of the venue. Allegheny count bye 13 africanamerican by census. The latest census information. They have 16 percent with two injury out, so it is actually more than what would you expect in allegany county. I would absolutely agree that they probably would want to have more africanamericans. But in a venue, it would be tough based on the distribution that you would pull, you know, for the entire pole. But even though there were potential for africanamericans, because yesterday reporting thats when the Defense Attorneys for cosby are saying hey we wanted more black people you people seem to be blocking them. They could have had more black jurors seat in the. They could have. They could have certainly had them, you know, there were more people that were yesterday. They also strategically decide that these people were not appropriate for their, for one side or the other. Attorneys yell at him back and forth, i want them, dont want them. The judge is the one that rules. I can tell you though that youre stuck with your panel. When your panel comes in, if you have a panel of 100, and i think i read that the first panel had only ten of 100 africanamerican jurors, youre stuck with that jury. Now, what happens is you have both per em tori challenges, challenges for cause. Challenges for cause, burden, hardship, cant be on the case, tell that to the judge, the judge would excuse you. The defense objected, called the batson challenge. Can you not eliminate jurors based on race or gender, in criminal cases, but the judge questioned the prosecutor as to why he eliminated that particular jury. And he had a rational basis for eliminate that jury. Therefore, the judge went along with it, that jury was eliminated. So, ken, my question for you then is you said that identify deally you would want more africanamericans on the injury if i youre the Defense Attorneys for cosby. Now that we know what we have, what would be your argument . How would you hands this will case . Would you change up then your approach based on what the jersey thats been seat in the. I think i would change my approach. I have to tell you, theyve said that they wont call mr. Cosby to the witness stand. No. I would call him to the witness stand. I would break the rules here. Ill tell you y he is one of the most charismatic people could you ever put on a witness stand. He was americas dad people love him. There is a reason why he stood before the cameras yesterday, when he came out of the courthouse, because essay tell to go charm the potential jurors in terms of his personality, and, you know the the lies. Of himself. I would put him on the stand, i have to tell when you mr. Cosby turns to the jury and gives his side of the story think it will be very compelling. Mark, would you agree with that . I know youre a jury expert. I do get into the strategy, witnesses, you know hes a public figure, hes been in front of the camera, been in front of the public. Certainly just or would want to hear from him. Yes, strategically you would want to put him on. But going back to the jury question, that you asked, also, you know, i think people are if you wanted to have predominantly africanamerican jury, the chances of you have getting it in allegany county, the deck stacked against you before you even start. Who would ask for that . They ask . I know they asked. Because it was better than montgomery, but still not los angeles, like we were comparing, talking about the o. J. Simpson. The oj thing. So automatically, your likelihood have, better chance, if thats your target audience or target jurors. But i think people are making a little bit too much about the race issue. Because in my experience, it is an experience issue, background, whether theyre white or black, if you had two jurors, one that had sexual abuse in their past, for their Family Members, or themselves, opposed to somebody who didnt. It doesnt matter what the color of their skin is, frankly, what matters is that issue, because thats going to color their judgement, traumatic, change the way they feel, i would rather have somebody who doesnt have that no matter what the color. I have to tell when you bill cosby made his comment after the jury was selected he seemed much more spry, ken, than he had every time we see him walk in. I agree. His lawyer said to him get in front every those cameras, be yourself being be the charming bill cosby, and it will help up. Remember this says case is a he said she said case. Only two witnesses will testify against mr. Cosby, andrea constand, and another witness. Andrea constand is white, the other witness is africanamerican. And so it is going to be those two against him. Thats why if i were mr. Cosbys attorney, i would put him on the witness stand because i think hes going to be more compelling potentially than the other two witness. Ken, thanks a lot. I would say, to kens point about the age of the jurors, most of these jurors are from 20 to 40, majority of them, there are younger jurors, theyve never seen the cosby show most likely. Sean thomas was 19 when he was sent to life in prison for whether he walked into the arms of his fiancee, sean thomas convicted of aking part in the murder every businessman in north philadelphia, in 1990, based on the testimony of two questionable witnesses. Whats more, he had long claimed that he was at a juvenile Detention Center at the time of the crime. In the years that followed, his lawyer began working with the pennsylvania innocence project, and this year the conviction review unit of the District Attorneys office found new evidence leading to his release. Police say that they were called to the Freedom Ridge recovery house in west brandywine township sunday afternoon, around 1 30, to find two counselors, working here, to help others recover from drug addiction, dead in their bedrooms, from overdosing on heroin and phentinol used needles and drugs were found inside the bedrooms. Six client are said to live in the home with the counselors. According to a source, all were drug tested after the bodies were discovered. The clients are clean. They are the ones who tried to use narcan, but it didnt work. Our jeff cole spoke with a man believed to be the coowner of the home, who spoke briefly, after closing the door and ordering our cameras off the property. Well, it is a tragedy of addiction. On medical level, and also, legal level. Ya. A 21 year old man is charged with murder after a bullet, he put a gun to his head, to kill himself. Well, his girlfriends was standing next to him. The bullet went through his head, behind his left eye, went out the other side, went through his girlfriend and killed her. So now hes being charged with attempted murder. Ken, i would they have a case . There is no intent. He didnt mean to kill her. Bingo, you just said the right word, intent. Murder is defined as intentional act to kill. He absolutely didnt intend to kill his girlfriends. He intends today kill himself. I think this this over charge. I dont think he will be convicted of murder. The think the proper charge is manslaughter. Involuntary manslaughter, wreckless killing. And i think thats what this was. So i think that theyve over charged this, this took place in alaska, alaska law, i think, will, when they read the alaskan law to the jurors, and it is red, and they know that it needs to be intention act act to kill, i dont think anyway this man would be convicted of murder.
