The challenge here with this case is such a high pre file case, right. You just talk about it. When they brought in 100 people. Normally they will bring in 100, 150 people for a trial like this before they brought these people in they sent out questionnaire toss almost 3,000 people to try to cull down. Everybody knows about this case. So to try to find people that could sit one, right, because they are picking people that will to have move more than 300 miles and you have to be sequestered for three weeks, it is a significant hardship for anybody. You have to find 12 people, so , it is not going to be perfect. Two out of the five had Sexual Assault, some kind of history with a Family Member in their life is that better for cosbys side or other side you would think they would be more sympathetic potentially toward the prosecution or toward the victim, of course. So, one of the things is a judge will ask, for a hardship challenge, two types of challenges preemptive within side get to choose they get seven of those and hardships where they can petition the court to say we think this person is bias or unsuitable for this jury and they will be moved to the cause. So, these jurors, pass that for cause challenge with the judge, and they said look even though we have had this in our past we can be unbiased fair and judge this case without that coloring our opinion and they agreed to it. Also we have three men and two women, they are all white. Your thoughts on. That when we talk about this yesterday experts were saying you might want some African Americans on there so to hear they are all white, what do you think of that. They are not done. They moved to Allegheny County because of the diversity, it is a much more Diverse Community then Montgomery County to start with. But not by much. Yeah. Yesterday we were told it was 80 percent white. But the background their background as far as it is less conservative of a venue and their background in the people and in the population, is there more diversity. What do i think of that . I think that sort of where they are right now. I know they had potential candidates that were africanamerican and think were removed for cause and because of the prosecutor removed one with the preemptory challenge. After they get all seven, six alternates and all that, 12 of them, they have seven more to go, will they find people exactly like that and practice the trial . What is this shadow jury. Shadow juries are interesting. I dont go into monitor a trial without one for my clients. What i would do is i would literally mirror the actual jury. So these five people that were picked would i find surrogates that will find them. Three white guys and two white women. More importantly then that with the same characteristic. And practice. And they will come to court every single day, and i will sit in the courtroom. They dont necessity who they are working for and i will interview them on breaks, at night and then go back with the team and we will structure and retool our case every single day based on than that feedback so we are targeted and that we are having the maximum impact at that trial, so we know what the outcome is going to be and that is what is used for. Beforehand these guys, there is in way they were not tested in this case ahead of time, he has got, affluent, he has machine toy do it and they want to know, a change of venue why did they go to Allegheny County . What would you say to someone saying arent we supposed to be trying to stop this and get people off their addiction . Isnt this continuing it. No, not at all. These people are out using drugs. Why is it cities responsibility to do that.
