attorney robert wanona is now considering a motion for aquittal. the three house mates on trial are charged with obstruction of justice and tampering with evidence. robert wone was found dead inside the home where the three lived some 2006. maryland governor mart uno'malley has made his re- election bid official. he filed ther work in annapolis yesterday. he is seen here touring. icc construction project. republican bob earlyic also plans to run but hasn't formally filed yesterday. money for metro could be on the line as the "washington post" reports virginia governor bob mcdonnell's administering is threatening to unravel a one and a half billion dollar plan for metro. until the state gets two members of the agent a spes board. the federal government is providing some money but requires the district, mayor daley and virginia to match those funds inform virginia pulls out of providing funding, metro says a plan to buy hundreds of new railcars will be in jeopardy. it is the case prompted prosecutors to reopen the 1986 murder case of her brother in massachusetts. at the time think officials thought that bishop pulled the trigger by accident while trying to unload a shotgun but now they say police failed to share crucial evidence. bishop has been indicted in her brother's murder now. a 79-year-old woman has her age to thank for getting her out of what could have been a tough intelligence. ann fisher, a grandmother from maryland, was recently convicted of obstruction of justice. she and her husband were in court facing off against their young he have son and his wife over a family business. surveillance have i i don't shows fisher waiting until everyone left the courtroom and taking document from the opposing side when she thought no one was looking. be building in and it will be slow to move aross the area. not only today, tomorrow, right through the weekend should feature bright sunshine. as that high pressure gets off the coast here by saturday half percent the other day and than you follow it up with another gain. it look like the stock may be -- mute have stabilized a little bit. you have bank of america coming out and downgrading the stock two days after fitch downgrade the debt a couple of notches on bp. it is not out of the water yet. we saw a reversal in the stock to the up when it was announced that they were going to put the $20 bill wrong into escrow because it removed unsirnty. we know that is the absolute worst thing for a stock, people not knowing. least now you know. you are putting the $20 billion in. rebounding from losing 47% of its value. gentleman let's talk about what is going on at the gas ump. i was so pleased just a couple of days to play $2.55 for regular unleaded my way which is pretty nice. >> that is nice. that is below the national average according to aaa. that is at $2.70. it stabilized a little bit. what we've seen is we've seen oil just slowly really under the radar creeping higher and higher over the last couple of weeks. we got down to -- i'm sorry. $78 a barrel. when we were down below $70 just a couple of weeks ago. we are seeing it sort of creep up a bit. there is the lag time between crude oil and the price at the pump and i think we'll be beyond the peak driving season before the prices start to go up so they may not go up that much. there is still a ton of fly in this yesterday but didn't show up. police believe pauls may be in a 2009 black lincoln mks with maryland tag 1 fft 59. investigators be able to call him and it was clear in the conversation that he was having a medical condition and was disoriented but he was unfamiliar with the area and he could not tell police where he was. they think he is somewhere in the lewistown area of frederick county. >> obstruction of justice trial involving the killing of d.c. lawyer robert wone. the question is could it all enwithout anyone being convicted? >> stacy cohan join us with more on this story. good morning. >> reporter: good morning to you. the prosecution has completed their case and as is customary in most trials, at the end of that, since the burden of truffe lies with the prosecution, the defense usually take that opportunity to say that the prosecution has not proved their case and therefore an aquittal is warned. in testimony yesterday, there were a number of witnesses for the prosecution including a maryland medical examiner. dr.david fowler said he learn learned how it be a forensic pathology in south africa where the number of murders involving knives and other sharp objects far he can seeds the number of similar killings here in the u.s. on the witness stand today, dr. fowler was asked about the stab wound found on the chest of robert wone. quote, they meetly catch your eye, dr. fowler said. i have never seen wound like these, not with this uniformity. dr.fowler said he reviewed the items associated with the body. he said the lack of blood on his hands is remarkable. it is a normal reflection to place your hands over any wounds. the pathologist testified he found no evidence robert wone ever moved while being stabbed three time in the heart telling the court, i never fond an identifiable reason if why he didn't move while being stabbed. when ask the how long a person could survive after being stabbed like that. fowler replied he would have lot of conscious innocence 45 seconds it a minute. he could have survived for four to five minutes. there has been a lot of testimony about the knife found at the scene of the crick. the prosecutors think it was planted based on the length of the wounds found in the body. dr.fowler told the court it was less likely the knife found at the scene is actually the murder weapon. these are very similar to the con lieutenant governors reached by the d.c. medical examiner. prosecutors believe the three men now on trial are covering for the killer while the defense maintains an intruder killed robert wone and these three mean men -- three men had nothing on do with it. >> reporter: the judge could decide to acquit one, all or none. if the judge decides to move forward with the trial, can you expect should know they can't get away with things like this. >> investigators were automobile to identify the suspects by searching yearbook photos. they have been charged with second degree assault. the boy is said to be doing okay. with the summer jobs african-american set to start soon, one councilmember wants to make sure it will run smoothly an efficiently. councilman michael brown held a meeting to encourage parment and teenagers to voice their concerns about the program. the program will now start on june 28th. turning now it our other big story and that is the oil spill in the gulf. can you see it is still spewing in this live look deep below the water. later this morning, bp's ceo will get a grilling by lawmaker when he testifies on capitol hill. the company has agreed to set up a compensation fund for the vic tum but it will not be in charge of deciding who ge that money. fox 5's tom fitzgerald has more details for us. >> reporter: on their way into the west wing, bp executives headed for a face to face meeting with the president who hours before had spelled out his intentions. >> we will make bp pay for the damage their company has caused. >> reporter: following meeting, the president announced b perform will put $20 bill wrong into a compensation fund to pay the victims of its spill. >> this $20 billion will provide substantial assurance that the claim people and businesses have will be honored. >> still in damage control mode, an apoll jet you can chairman of british petroleum emerged from the west wing promising to pay the claim plus set up a $100 million fund for oil rig workers who have now lot of lost their jobs. >> we have always met our obligation and responsibilities. we have made here from the first moment of this tragedy that we will live up to all our legitimate responsibilities. >> reporter: north the government nor bp will have the final say on who receives money. instead, attorney kenneth feinberg will be in charge of awarding claims. >> it sets up a process. there will be mr. feinberg and a three-person review panel. all of that can be done in an expedited manner. >> reporter: as with other compensation funds, the victims may have to surrender some rights to sue in order to be paid. >> people aren't going to get compensated twice for the same damages. >> reporter: david hunter a professor at the washington college of law, who specializes in the environment, says for instruct timbes being the fund has pros and cons. >> people will be able to get some compensation hopefully north quickly than the judicial system certainly. but they're not going to be able it get exactly the same money for the exact same claim. >> reporter: but after their previous statement to the press, bp executives walked off with more month. the hottest temperatures around the washington area, typically, middle of july. july16 to july 27, our average daytime high is 89 degrees. i'm concentrating. what happens is imagine the atmosphere is a bank and sunlight is our money. so the more sunlight we put into the atmosphere, the warmer our temperatures are generally going to be. we keep adding to the bank here as we approach the summer solstice but we are not taking much out. we are not allowing a lot of the heat to leave this time of year. even though the summer solstice is passed, we are adding heat and there ever been the warmest temperatures occur about a month after. so the heat is kind of the interest on our deposit of sunlight. >> i love this analogy. >> the same holds true during the winter months, just the voted virginia's favorite winery in 2007. and the other reason we are at pair moon cellars is it is wine bottling time and virginia wine bottling l.l.c. is a company where they roll up a trailer and inside there is state-of-the-art bottling going on. they roll up the trailer, cook them up to the vats and off they go. so this morning we'll meet the couple behind the company and learn about the process, see how they get the wine into the bottle, get it all labeled perfect, boxed up, and then we'll see how many cases we can bring back to the station. oh, no, i made up that last part. but
