park. we are told this was an accident between that jeep that you see there and a tractor- trailer. not sure of injuries right now. but those two collided a short time ago and the end result is that jeep bursting into flames. there is the tractor-trailer. so we are still getting developing news on this and we will bring it to you. i guarantee you, we'll bring it to you through the hour. but a live shot of the beltway west of the route 1. and now to today's top story. d.c. police arrest one of their own. an officer facing felony murder charges will be arraigned today. >> it all stems from a deadly shooting and a car jacking that happend two weeks ago and sherry ly is live outside of d.c. superior court with more details. >> reporter: good morning allison and tony. police arrested this officer last night after discovering that he was a known associate of one of the other murder suspects. police say officer reggie jones wasn't theshooter, but the lookout during a deadly carjacking and robbery gone bad. 40-year-old arvell alston was killed on 4th street southeast. when police arrived he was lying in the street dead. a second person was woundein the shootout. police say officer jones knew the shooter and took part in the murder. jones is a six-year veteran of the force was charged with felony murder on tuesday and arrested. he is assigned to the narcotics investigation division. cathy lanier says a police officer involved in a murder is a cowardly and violent act. >> the worst thing a police officer can do is to betray public trust and in this case, the officer went far beyond that. he did so carrying our badge, wearing our uniform. >> if you commit a crime in the district of columbia, the police will find you and hold you accountable. that also aemployed to d.c. government employees, as you've seen today. >> two others were arrested in the murder. investigators are still trying to determine how long jones had been working with those suspects. jones is scheduled to be arraigned here at d.c. superior court on those felony murder charges later today. live at the courthouse, sherry ly, fox 5 news. in the meantime, new details on an escaped suspect back in custody in montgomery county. 23-year-old jose melton was on the run for 3 hour this is morning. eventually police found him at the falls grove village shopping center. police say he robbed a grass station in gaithersburg but crashed into a tree during the police pursuit. he fought off an officer we'll be treated at the shady -- while be treated at the shady grove hospital after he was taken there after he hit his head on a table at a police station. and we are following a developing story from the middle east. iran confirmed it successfully test fired a long range mssile today with israel well within range. iran's defense minister said the high-speed missile would sve as a strong deterrent against an attack. this comes one day after the military intelligence chief says iran has enough nuclear material for a war head. we're following two developing stories regarding kim jong sill, saying he has taken every other day off because of a bout with chronic largitis. the president sent him a personal letter in order to draw him back to nuclear disarmament talks. the letter was delivered last week. no word on whether kim has responded to that letter. now to a story we first brought you on fox 5. this is donald gates walked out of prison yesterday. he was freed by the same judge who put him behind bars for a murder the judge believes gates now never committed. gurvir dhindsa is back with more on this case. >> such a remarkable story. right before the holidays. gates was convicted in the 1981 murder of a georgetown student in rock creek park. he was sent to serve his sentence in arizona. this morning he's waking up in ohio and getting his first taste of freedom in nearly three decades. >> reporter: this is donald gates on his way to akron ohio for a -- a reunion with his sister. gates asked for dna testing as far back as 1988. but it wasn't until new evidence was discovered 20 years later that gates finally got his wish. we spoke with him if the tucson, arizona, bus station a few minutes after his release. >> i'm happy that i'm a freeman and i'm going home. and i'll talk to you later. that's all i want to say. >> reporter: in the summer of 2008 inside of the office of the chief medical examiner, d.c. police detective jim trainham found evidence nobody new existed. six slides used in the autopsy of katherine schilling. >> it was all a team effort, its u.s. attorney's office and realizing this is an issue to be addressed and i was just a facilitator. >> reporter: two labs both returned the same results. donald gates could be excluded. >> mr. gates is fighting to prove that he's innocent of this crime since the moment that he was arrested. as the judge said in court in 1988, he order additional dna testing but its technology was to primitive at the time to get results. >> reporter: at sentencing gates said i didn't kill her. i never saw her. i'm sorry she died because her death has rueib -- ruined my life. the informer, i never saw him before. i would hope to return to society, raising a family, having a place of my own. judge said he was appalled to learn the fbi agent who testified was later discredited, singled out by the inspector general in 1987. the agent testified two of donald gate's pubic hairs were found on the victim's body, evidence the prosecutor said was crucial to the case. michael p. malone has been exposed as a liar who testified falsely and fabricated results, who testified outside of his expertise and whose laboratory notes did not support the conclusion he offered in court. >> there are two victims in this case. there is katherine schilling, 21 years old, brutally raped and murdered, and there is also mr. gates. he's a victim also through the results. whoever this unknown man is, two lives destroyed. absolutely. >> reporter: the two sides will be back in court next week where a second series of dab tests are -- dna tests are expected to clear donald gates for good. until then he's a freeman with a murder conviction. >> in addition to freeing donald gates, the judge ordered an investigation of the u.s. attorney's office. the judge said he was appalled to learn the in spector general knew about the shoty work of the fbi special agent and never passed on to the defense until last week. court records show the u.s. attorney's office knew about the findings as recently as 2004. the question is whether other cases may have been tainted as well. >> just remarkable that the man spent 28 years in prison. so we'll see what happens. there could be other cases too. >> sad story, guhe is free toda the maryland department of education has named six public schools 2010 blue ribbon schools of excellence. winners are picked on state and national requirements for achievement and improvement. each school will get more than $6,000 in tech equipment and $1,000 from corporate sponsors. ellicott middle and new market in elementary are among the schools named. an effort to go green has some drivers seeing red. several cities nationwide installed energy efficient traffic lights, but the problem is this winter they're discovering the new l.e.d. bulbs don't burn hot enough to melt the snow. they become crusted over during storms and that has led to dozens of crashes and deaths. authorities are testing possible solutions, including weather shields and heating the hill for a 30 day review. the city could start issuing marriage -- marriage licenses around st. patrick's day come march. the archdiocese of washington said it will no longer accept millions of dollars in funding for crucial social services the church provides if the legislation were to pass as it if. the archdiocese says since this legislation has been first introduce the in october the archdiocese of wash opposed the redefinition of marriage based encore teaching of the catholic church that man and women is in trinessic to the term of marriage -- intrinsic of marriage. this very personal. you are ebb gauged -- engaged. talkto me about what this meant to you. >> we are overwhelmed and thrilled that we are consider whole citizens here in the district of columbia and have the same opportunities and obligations as every other family and couple that lives here in the district so we're very excited. we are engaged to be married next year and so this is just a very sweet for us to do it at home. >> and danielle. >> this is just overwhelming. we're excited about this opportunity. although it was quite nerve- racking to have a panel of although favorable council members judge our lives and whether or not we can move forward like our neighbors do, without having to sit and wait for our judgment to come before them. but we are overwhelmed and excited. >> the two council members who did not support the bill, barry and alex ander and they both say the constituents don't support this bill. what do you say to the council members, but more importantly to their constituents? >> the first thing i would say is let's be reminded that those two council members have been very supported of the community here in the district and we appreciate their support throughout the history of their careers. so on this one it was a tough one and they had to listen to constituents that were decenting. but we have broad support in the city for marriage equality in general. we have over 200 members of the clergy who have stood with us and supporting us in our request for equality and we have folks from every race, ethnicity, religion and creed around the country who -- around the city who are supportive. >> there are people who say, well you can -- gay couples can live together, they have certain rights. why is it important to be able to the mariage, to have the sanctity of marriage and to have the ceremony. >> to be honest, we're planning our wedding and we're very excited about that. but there is also a feeling of angst that we carry around with us like a dark cloud. what if we -- whatf something happens to the other person during the time that we're planning our wedding. what if i can't be by her bedside or care for the way in the way that i know she'll be cared for because i don't have a marriage license because i'm not recognized as an equal partner the way any other couple would be and that's a risk that i don't think that any family should have to make. >> some of the opponents, the religious leaders have said that -- that this is a matter that they just can't -- you're right, there are about 200 people -- religious leaders who are very supportive. others who will continue to fight this and be up on capitol hill. it's very -- it's an issue that has been dividing for the religious community. how do you address those leader who's have been opposed to seeing the bill passed and who will fight it up on to the hill? >> onef the things that i think we both agree on is that we believe in democracy and it is their opportunity as citizens of the united states it be able to exercise the things they believe in and that's great. but we are thankful and appreciative that justice prevailed yesterday. and we're talking about a basic issue of equality under the law. and respect the religious leaders' opinion to perform or not perform maiages and what they're views are. but this is really about civil justice here. and it's equality under the law. and we think that the council ruled the best way that they could by moving forward with the equality. >> so the plans from here out, you get married next year? >> yes. we do. >> and you're of days although temperatures will be well below average here right through the end of the week and then we'll see what happens as we begin the weekend. i'll show you the weekend forecast in a second. plenty of sunshine, much cooler than yesterday. breezy as well. high temperature of about 41. winds out of the north and west at 10-15 miles per hour. five-day forecast, more of the same tomorrow. for the afternoon high, more of the same on friday. 42 for the afternoon high. it looks like by saturday evening and early sunday, we'll have another coastal storm develop. we have to watch this one carefully because the computer models are suggesting it could brush the washington area and that could mean some wintry weather overnight saturday and into the first part of sunday. but it could also >> the makeup tes about an hour and 15 minutes. so we get here before most of the cast and it's -- it's a layering process, because the forehead is a prosthetic so you have to glue that down and let it dry and then the cap goes on first and then it's a series of bluing and makeup. you know the process. just layer after layer. and then finally you have the lovely teeth. >> reporter: so you and brendan are very comfortable with each other. you solved every problem. >> i know every song on his ipod. but it is part of my role, is to sort of watch yourself. >> reporter: and to give people an idea how long it takes, you are one of the first people here taking on -- putting on makeup but you don't come into the show 20 minutes until after the show starts. >> it's not a bad start, but the process is long. >> reporter: so to make the process more comfortable, i understand you travel with your own chair? >> ure sitting in my chair. and there is a massaging part of that chair. >> reporter: wait a second. they didn't turn that on for me. where is that? >> i know. they've unflog -- unplugged it and it's heated. >> and you have your own microwave?
