using an ak-47 style rifle and firing shots at the white house last friday night. the secret service discovered two bullets. one of them breaking the historic glass on the residential level that stopped by bullet proof glaze behind it. inspecting the entry point. the secret service hasn't identified the location of a second bullet found on the exterior of the white house. >> within the past days or weeks, he was a visitor in the hotel. >> pennsylvania state police found him here in indiana. a hampton inn about 100 miles outside of pittsburgh. how did they know to look here? police believe the shots were fired from constitution avenue. about 800 yards away from the white house. ortega-hernandez's car found abandoned near the roosevelt bridge. officers found the rifle inside it. along with evidence that indicated he recently stayed at the pennsylvania hampton inn. >> secret service and, or the fbi contacted them within the last few days. maybe been in town, i'm not sure. and alerted them to fact that this subject may have been there in the past and may be back in the future. they will notify the secret service. >> it was an investigative hunch that paid off. all along, detectives thought ortega-hernandez was in the d.c. area. they looked at the occupy encampment, thinking he would try to blend in. >> they asked me if i seen him and i said no, sir. >> they showed a little picture of the gentleman and just ask if we had seen him. >> state police say ortega- hernandez was at the hotel looking for a friend he previously stayed with. that friend was not there and police in pennsylvania don't believe that friend had any connection to the shooting incident on friday. >> let me ask you, what did he look like when he was arrested? was he armed at all? >> police were asked that question at their press briefing today. he looked exactly like the photos we have been seeing. even the same clothes. he was not armed and did not resist. shaun. >> this is not the first time someone fired bullets and hit the white house. back in october of 1994, a colorado man armed with a semi- automatic rifle opened fire from pennsylvania avenue. sprang the mansion with 57 bullets. trying to assassinate bill clinton who was home at the time. two witnesses tackled the man. he is now in prison serving a 40 year sentence. fox 5 weather alert. big changes happening very soon. a live look outside right now. the warm temperatures we have had the last few days will be a thing of the past. much cooler weather is moving in. could we everyone see a flake or two tomorrow? sue has the answer from the weather center. >> that's a weather tease. the answer to that is yes. we actually could, because we are going to see a big difference in temperatures as the headline says, we are going to be falling through the 40s during the day tomorrow and by the way, add in a blustery wind and it's going to feel chilly tomorrow. it will feel like we have temperatures in the mid 30s. tonight, we deal with the rain that is still around. our first stop will be radar. the heaviest access shifted to the suburbs. the richmond area had to put out flood advisories because there has been heavy rain. over to the radar and you can see where this pattern is shifting to the east. but the thing is, while we had a lot of rain south and east as we expected, a little more to come. i also want to mention we had 13 tornado reports across north carolina, south carolina, and georgia. see the moisture toward memphis, that's one last piece of energy. it will probably rotate through here on the frontal system in the morning. that will be bogging the front down. it will bring another round of showers and begin the process of bringing in that colder air. we are 54 degrees now. it's not here yet, but here come the 30s and that is the kind of cold air we are going to be tapping into. as for the snow report, yes, it looks like it could be cold enough if there's moisture yet for some of the higher elevations to get a small accumulation of an inch or two. it would not be shocked if some of our northern and western suburbs see this. but it should still be warm enough for that not to accumulate in those northern and western suburbs. we'll keep track of that trend and how long this cold snap is going to last when i join you upstairs. >> thanks sue, we'll see you then. an arrest in an illegal jewelry operation in prince georges county. more than $100,000, mostly in gold jewelry seized and the operators were knowingly taking in stolen goods. >> police say that the tip for this investigation came from a citizen and it turns out the suspects were boldly operating in plain sight. tonight, investigators say this may just be the tip of the iceberg. >> after shutting down an illegal jewelry operation, officers from prince georges county police department special enforcement division sort through more than 100,000 dollars in jewelry, most of it gold and likely stolen. investigators say part of the operation was run out of this international market in riverdale. inside at a kiosk is where police first approached one of the operators. >> we sent an under cover officer and she portrayed it to be stolen. she bought it without asking for identification. they gave us more information, which led us to a home. >> at this home on hamilton street, there was a second part of the operation. a workshop in the basement. >> it was, you know, apparent that they are either melting it down, taking it apart, recon figuring it. without any identifying marks, without any identification, you would not know where the jewelry came from. it melted down quickly and it is almost instant cash. >> officers say when they raided that home on wednesday morning, they also found a fully stocked grocery store on the premise. also being run illegally. investigator say it looked like the jewelry business had been operating for a year and they suspect with the price of gold soaring these days, there's certainly may be others. >> they are getting a lot of cash for the gold now. in our theft reports, coming across our desk and talking to investigators that a lot of jewelry is being stolen. >> they are going to go through that. see if they can reunit any of it with its owners. >> hopefully they can. thank you. also in prince georges county, two murders in a little more than two hours last night. police were called to the 700 block of murray avenue around 11:00. they found a man lying here in the middle of street. he was pronounced dead at the hospital. investigators have not released his name nor how he died. they do believe he was killed. the second murder happened in the 2100 block. police found a man dead in a parking lot from at least one gun shot wound. remember this? d.c. mayor vincent gray and a half dozen council members and many others as well arrested during atonmy protests last spring. this week, eight of these activists who pleaded not guilty to the charges went on trial. the verdicts handed down today. fox 5 is here with the details. bob. >> brian, charged with blocking a city street and not leaving when ordered to do so. seven of the eight protesters were found guilty and ordered to pay a fine. they say they will do and continue fighting for the district's full voting rights in congress. >> voting rights for the district of columbia. >> they had just been found guilty by a d.c. superior court judge and here they were again. >> free d.c. >> continuing their protest for d.c. state hood. one of the guilty parties shadow senator michael d. brown. >> i would be given this responsibility to represent 610,000 loyal americans and the only thing that i can do is make trouble. >> let's take you back now to april of this year. d.c. mayor, vincent gray among the demonstrators arrested for blocking streets on capitol hill. >> we were moving fast toward democracy by getting out in the street. by protesting congress and letting people know that we are fighting in wars, we pay taxes, but we have no representation on national legislature. >> at the time, angry at congress for trying to pay for abortions for low income women. the very same issue that came up in the house today. >> we would have had to give over our most vulnerable women. low income women. they mean a lot to us. we already are singled out as the only jurisdiction that can't spend its own local funds the way it wants to. >> took their cause to trial, only one was acquitted. found not to meant to get arrested that day in april. >> i think everybody should have been acquitted. i respect the judge. i respect the court. but we definitely should not have been here at all. everybody was there to stand up for our rights in d.c. we were innocent. >> after his arrest, april 11, mayor gray paid his fine and went on his way. >> we can't forget that the mayor started all this. if he hadn't stepped off that curb on april 11, none of this would have happened. >> and we will be back. we will continue our protest. >> what do we want? statehood. >> eleanor hole ms norton says the bill in congress is not dead with more discussion slated for tomorrow. brian. >> tonight's mayor gray's office is using youtube to show the public how the mayor is using to implement its agenda. highlights mayor gray's dedication to his four top priorities. safe communities and fiscal stability. thousands of drivers stranded for hours on area roads in ha major snowstorm. tonight, we have the new plan to get you home ahead of more bad weather. also ahead tonight, metro workers making a surprising admission. they are seeing problems on the job, but not telling anyone about it. >> and tonight at 11:00, a straight a college student banned from campus and possibly facing expulsion. she says it's all because she fought back when she was attacked. her story only on the news edge.  more safety concerns for metro tonight. a new survey finds a majority of them are observing safety concerns while on the job and sometimes not reporting them. fox 5's john hanrahan has details of the new report. >> although there had been fatal metro accidents before. the 2009 crash of two red line trains which resulted in nine deaths put metro under the safety microscope. the subway systems trains are still being manually operated while the train control system is being rebuilt. a new safety report takes a hard internal look at current practices in the rail and bus systems. an outside group, the corporate executive board surveyed 98% of metro employees about safety. 60% of metro employees reported observing a safety concern on the job. of those who saw something wrong, 70% reported the situation. which was usually an unsafe working condition. why didn't everyone report a problem? the survey sites fear of retaliation from coworkers as a reason for not reporting. metro has already established unanimous employee reporting of safety concerns via telephone and e-mail. the report suggests continued emphasis on safety inspections, training, and communication. according to the ntsb, the train rollback wreck of 2004 at the woodly park station was due in part to the operators in attention. the new safety report points out there are still no federal guidelines limiting hours on the job for either subway operators or maintenance personnel. the report concludes interviews with employees, managers, and supervisors indicated widespread belief that these rules and practices did not adequately control fatigue. our metro passengers concerned about overworked metro employees? >> you know that there's no federal rule for subway drivers? >> no, i didn't. interesting. >> should there be? >> yes. definitely. >> john hanrahan, fox 5 news. the safety committee of metro's board will discuss the report tomorrow morning. a new vote is saving huge money on project to extend metro to dulles. loudoun county board of supervisors voted to approve parts of phase 2. it will lower the cost of the project by nearly a billion dollars. removes the requirement for labor agreements. the vote details the funding to build parking garages. flying out of reagan national this weekend, don't plan on taking metro. the stations will be closed from 10:00 friday night until monday morning. it is being shut down for major upgrades and repairs. there will be a nonstop shuttle bus. shuttle buses will be running between all the closed stations. fox 5 is always monitoring metro. if you have a story idea, shoot us an e-mail. who can forget this, the snow came down fast and furious late afternoon january 26. the roads were so bad drivers abandoned their cars leaving hundreds of vehicles all over the region. especially in montgomery county, maryland. now the council there is considering a new action plan to make sure this never happens again. councilman, phil andrews joins us tonight. thanks for being here. >> good to be here. >> what is your county's plan of action to prevent this? >> this is actually a regional plan that would address the region's ability to respond to events like the january 26, snowstorm which caused havoc for commuters. it hit montgomery county very hard, but it affected the whole region. develop recommendations to ensure we don't have a repeat of what happened that day. >> indeed. so how are you guys working together with other cities and other federal governments to coordinate? we know that the feds change their policy for the first time in 14 years, telling federal workers to leave the office by the time the federal government says so or stay put until the roads are safe. what is the plan? >> three major recommendations. one is that one, to better coordinate release employees. the release decisions for over 300,000 federal employees in our area and influences many others. it is crucial what the management does and they are revising their policies so they'll have a leave no later than option in order to get people to leave and get them home before things get bad, as well as to use alternative work strategies, schedules, and tell working. the other two major recommendations are to establish a regional staff that is specifically focused on making sure there is a regional response and that it is well coordinated. the third and final is that there be a way for the public to get real time information about the traffic conditions and emergency conditions in the region so the public can make the best decision possible. >> and you know, we have been through a will the of different situations where we had to evacuate quickly. we've had problems in the past. we come back and we evaluated again. i don't mean to sound like a pessimist. but what do you think will make the difference this time. it will actually work? will small parts detach? will sharp edges be presented? >> but some perennial problems remain. small parts that break off of cheap toys and become choking hazards. riding toys with protruding parts that can cut a child. and toys with long strings or loops that pose a strangulation risk. magnets not intended as toys are a growing threat. kids are using em as fake piercings. if swallowed, they can be deadly. >> we want you to put safety at the top of the shopping list. >> follow the age guidelines on the toy labels. watch for small parts and make sure you include safety gear with any riding toy to keep your little ones safe this holiday season. melanie, fox 5 news. >> the cpsc says 180,000 kids were hurt badly enough to be treated in an er last year. nonmotorized scooters were associated with most of the injuries. downstairs in the newsroom now, the web center to be exact where a lot of holiday shoppers will be looking for toys the day after thanksgiving. black friday. however, a lot of stores are actually opening at midnight. so shoppers will be shopping in the predawn hours. that plan has store employees asking companies to stop stealing their thanksgivings. in fact, one employee in nebraska in particular has corralled 120,000 signatures for an online petition asking the companies to back off their plan to let shoppers start shopping so early. and a lot of people are getting on there who aren't employees. let's give you a smattering of some of the comments. one guy writes, encouraging people to shop in the middle of the night is bizarre and forcing employees to be there to help them when they could be home with their families is insensitive and cruel. caroline says is this absurd. a toxic consumer culture, pure greed. to which i ask jeff, have you ever worked thanksgiving? yeah, it's going to be a big change. the temperatures that we bottom out tonight aren't going to go anywhere and the cold air is poised to get in here. probably take longer. it's really not that cold yet and as for rain, we'll start you out with the radar so you can see what's going on. most of the heavier stuff has shifted to the south and east and it's going to wind down. there will be one last surge that comes in tomorrow morning, maybe later than that. and wraps up in the early afternoon. and that piece of moisture could be interesting. more on that in a moment. meanwhile, here are the showers. we had tornado warnings in southern virginia into north carolina, down to south carolina, and georgia. 12 reports of tornadoes so far today. but nay is because the really warm air is down there and the frontal system punched down to the south. this produced significant rain just south of d.c. where we thought it would be. this is the heavier stuff and this is estimated an inch and a half. lighter amounts around the metro area on the order of a half inch to slightly under that. but still more rain to go. and as we put it in motion, especially the later hours, down to the south. and here's why. that's where the frontal system is and one more piece of energy wants to ride along that front later tonight. that will kind of bog down the works. it will hold the cold air up just a bit. after that, it is done riding the front. that's when the cold air is going to come in and the chance of a midday snow shower in the colder spots north and west. if the precipitation is still hanging around as the colder air comes in. now that looks doable in the mountains and there might be a small accumulation there. for the rest of us, primarily north and west. let's say around 2:00, 3:00 tomorrow afternoon. that's only if the moisture is still around as the colder air comes in. it's only going to be 49 degrees tomorrow. that's 10 degrees below average. prepare for the chill. because it's the story of the day tomorrow. did i mention it's going to be windy tomorrow afternoon? dress for windchills in the 30s. it's not going to be as windy. in fact, i bet we see the sun tomorrow before everything is said and done. early morning rush hour might be wet. midday is wet, but not so wet for the evening rush hour. saturday 54. sunday 63. we begin to recover a little bit on sunday. meanwhile, it is in the 50s now. so not that cold here. but we know the cold stuff is coming. we can see cincinnati at 41. chicago at 32 degrees and up to north and west, we have international falls at 21. fargo, north carolina, 15 degrees. some colder air coming in. as the frontal system departs, definitely colder. definitely breezy. maybe a left over snow shower. last thing i wanted to show you is maybe, just maybe a small accumulation. possibly as close by as the panhandles on the order of an inch or two of wet, slushy snow. and maybe you see some of this in the higher elevations north and west. maybe it ends as a wet snow shower. a little bit later in the day. you on the news edge at 11:00. i would say any time after noon or so. could see a couple wet snow flakes and out of here before the evening rush hour. >> so 49, blustery, colder. we drop to 33 degrees tomorrow night and we slowly recover each day as we head on into thanksgiving week. >> wow, can you believe it?
