attack on that woman but they aren't saying much else. >> reporter: with a heavy police presence it's a safer walk for some heading to the grocery store after three separate assaults last week along medical practice that will perform late term abortions. >> it's opening up in our area, plus we'll hear from both sides in this debate. >> you're watching the 10 right here on fox 5. , hyoyeceic a developing story tonight, a protest planned tomorrow as a late term abortion doctor brings his practice to our area. dr. leroy carhartt will start work at germantown reproductive health services. he left nebraska after a new state law there banned abortions after 20 weeks of pregnancy. let's get a start to the conversation about this controversial story. jeannie monaghan from family research council who is pro life and aaron matteson, the vice president of now pro choice, of course. aaron, you actually know doctor carhartt. you refer to him as a hero. >> i do. i met doctor carhartt at our national now conference this past summer in boston and i actually introduced him with this idea that a woman who's having an abortion is not a criminal, but a patient in need of compassion and care and i have to say having met dr. carhartt personally and watched him speak of the stories of the women that he's helped serve, i've seen how he provides that compassion and care, literally just moved by the individual stories of his patients. >> jeannie, why don't you jump in here. family research council certainly against abortion in any case. in this particular case these are fetuses that some would argue would be survivable outside the womb. >> right. while we don't begin to judge dr. carhartt's motives, we do know that he is a proponent of doing abortions 21 weeks and beyond of development. let's be clear. babies can survive outside of their mother's womb from 20 weeks or even earlier, as early as 18 weeks. so this is not, you know, mainstream abortion. this is radical. this is late term and most americans are not in favor of this procedure. >> jeannie, what about those who say this could be a mother who is about to start chemotherapy or a mother who found out that the fetus is brain dead? >> right. according to the national abortion federation, dr. carhartt's abortions, almost none of them were done for instances of the life of the mother and we also know from dr. tiller, of course, who was shot not by a man associated with the pro life movement and we're very sorry that that happened, but literally none of the late term abortions that dr. keller did had to do with the life of the mother according to the kansas department of health. so it's not a fair claim. >> erin, would you respond differently? you've said you worked with the doctor. what type of women are coming in to have late term abortions? >> it's precisely that. it's women with serious medical conditions, women who need to be able to start chemotherapy, women whose lives are literally on the line. i'd just like to collect correct a few things i -- correct a few things i just heard. the man who savagely murdered dr. keller while he was attending church was deep into the anti-abortion rights movement and it's all sides of the spectrum we see leading to those horrible tragedies. >> jeannie, i man you would call protesting these type of practices less -- imagine you would call protesting these type of practices less about harassment and more about a message. >> i am planning on not going tomorrow. i will be peacefully praying for this, but i'm not in favor of actively protesting this tomorrow. >> erin, one of your biggest concerns obviously security based on what we've seen before. certainly the face and few would argue that dr. carhartt is the face of late term abortion. what is your biggest concern outside this practice tomorrow and as we move on into the future? >> well, abortion is a safe and legal medical procedure that is backed up by a constitutional right and we have laws to protect doctors and clinics and patients and their staffs. so we will use those laws and make sure that the police enforce it, but in terms of the protesting and harassment, we're going to stand strong behind dr. carhartt and, you know, even tonight i'm having a meeting with some other young activists in terms of what we can do to best support him now that he'll be in the area. >> as i understand it the practice is opening in maryland because maryland state law is more permanency sieve than other areas. jeannie, why -- is more permissive than other areas. jeannie, why don't you speak to this. dr. carhartt left nebraska after the new state law there, right? >> right. nebraska is the first state to do a fetal pain law and have outlawed abortions after 20 weeks because the baby can feel pain. the abortion industry really has a strategy trying to make developing babies seem like a lifeless blob of tissue, but the reality is it is a little person who has a beating heart, has brain waves and yes, can feel pain. so i think this is a good point, too, that we don't need to go all the way and overturn roev. wade. we hope that that happens, but these laws in little states make a big difference. >> erin, do you see anything on the horizon that could change the law say in maryland? >> i think i see something that could change the law in nebraska potentially. there is no medical or legal consensus on this idea of fetal pain that has been created in large part by the anti-abortion rights movement and so this is something that i predict will go to court. >> just to make a slight correction there, we know that babies have more pain receptors per square inch between 20 and 30 weeks of development and that it's possible, in fact, they feel more pain. they also respond to noxious stimuli early in the second trimester. so i would assume we would want to error on the side of caution in terms of a baby, not a lifeless blob of tissue, that could be potentially feeling pain. >> erin, i've got 10 seconds left. you have the last word. >> i would never call terrorring, but we should always trust women to -- call it errorring, but we should always trust women to do what's best for themselves and their families. >> thank you both for coming in and starting the debate here. we will continue to stay on top of this. maureen, back to you. a
