more on the gay marriage battle. bob? >> reporter: gay marriage is performed elsewhere are now recognized in the district of column bachlt the legislation being debated upstairs would allow same sex couples to legally mary here. >> bigotry is bigotry. discrimination is discrimination. >> reporter: most of the nearly 300 people who signed up to tell the d.c. council how they feel support along gay couples to legally mary in the district of columbia. >> marriage does matter. it does make a difference. >> same sex relationships are part of a rich tapestry of life in our beloved district of columbia. >> we're really talking about civil marriage. we're not talking abou religious marriage. >> reporter: there is strong opposition. >> i only have one dictionary in my home. which is a web dictionary. it states that a marriage is a civil union between one man and one woman. >> reporter: many of the city's black churches are leading the charge against change the law in this city of 6,000 residents. >> there is a powerful lobbying group with money influence and power that is pushing away others from weighing in on the issue. >> reporter: they want the matter of legalizing gay marriage in the nation's capital t to a vote of the people >> the reason the owe poe opponents of marriage equality want a referendum they know more often than not you can stir enough hate and fear to turn neighbors against neighbors. >> there is no justice when ten co sponsors have already indicated their position on the bill. >> reporter: 10 d.c. council members said they will vote for legalizing gay marriage in the capital. >> it is herb especially important for me now as an openly gay member of the council to say i want your respect for my point of view when comes to marriage equality as a human rights issue in the city and in this n. >> reporter: tonight's public hearing is expected to go for about another half hour. it will continue on next monday night. the full d.c. council is expected to vote on this legislation by the end of the year. with the mayor's signature and approval from congress, gay marriages, gay couples having weddings could start in the district january of 2011. >> bob sellers live for us tonight. the d.c. board of elections held a hearing on same sex marriage today. opponents of gay marriage are asking the board to put a measure on the city ballot that would give voters the option of banning same sex unions >> we're asking the board to let the people vote. whether the board is for or against the initiative we feel the people should make this critical decision on a definition of marriage in the district, not 13 members of the city council. >> reporter: the initiative would go on next year's ballot. board members did not make a decision today and there is no set timeline for them to do so. in virginia a walk in the park turned violent. a woman beaten in broad daylight. investigators say the man viciously attacked the woman this morning in jielz park. roby chavez is live. >> reporter: very alarming for this area. the woman fought back hard and in this case it was enough to stop the crime. fairfax county police were quick to the scene and questioned several people in that area. tonight joggers and nearby residents are on alert. the crime happened here in an isolated area off lornton road. a 53-year-old woman was walking along a trail and beaten. the crime took many by surprise. >> actually i was standing with my family. i just don't know that area over there. >> reporter: it's an area that has kept its country feel. nearby residents say it make for a relaxing run. it's popular with joggers and walkers even though many areas have no trespassing signs posted throughout. >> there are trails behind the house and they all connect but they're not lit. i do see others but i don't go. >> reporter: police searched the area for much the day. the victim says the suspect came up from behind her and tried to drag her to the ground while taking her purse. she struggled with her attacker while her. fairfax county police say she continued to fight and he gave up. >> i'm glad she did fight back, you know, at least to try to keep the guy from just running into her and robbing her. i also wanted to say that that's very unfortunate that something like that would happen to her in this particular area. >> reporter: residents who live in a a nearby developed area say the wooded area doesn't just attract joggers. >> it's isolated, not well developed. it's still country. it's still a little barren in certain areas. so it's probably a key place for people to hide and lushing in e bushes. >> reporter: still it's a most unusual crime even joggers using a different path are rethinking their steps. >> i do not jog in that area. i jog up at silver brook. i've never gone that way because it is not lit. it's kind of scary. >> reporter: we just got off the phone with fairfax county police and there are new developments tonight. police won't elabote but they do have a person of interest and could make an arrest in this case by the morning. >> thank you, roby chavez in the news room. taxi drivers targeted. police are looking for this man suspected in a rash of robberies. at least nine incidents in d.c. within the last two months. investigators say the man hails a cab, asks to be taken somewhere. once they arrive he pulls out a gun or implies he has one and demands cash. in one case he even stole a cab. police believe the suspect also held up a gas station using a knife. a former nassau scientist accused of spying pleaded guilty in january to over charging the government. court documents reveal that stuart nosette admitted to conspiring to get money from nasa to get a swimming pool, credit cards. he's a kusd of trying to sell classified u.s. defense secrets to an undercover fbi agent. to a developing story we are following in the news room. the u.s. military working right now to figure out what brought down a helicopter in afghanistan with ten people on board, including 3dea agents. in all, 14 americans are dead after two separate helicopter crashes. fox 5's tom fitzgerald has details on how the continued violence in afghanistan could influence the president's decision on a troop surge. >> reporter: two helicopter crashes, 14 dead and the deadliest day in the deadliest year for u.s. personnel in afghanistan. colonel wayne shank says enemy fired has been ruled out in both cases the first of which killed four u.s. soldiers after a midair collision. >> we do t believe a enemy action was responsible for that. >> reporter: meanwhile in western afghanistan, 3dea agents and 7 u.s. troops fresh from a firefight that killed 14 afghan drug traffickers lost their own lives when their helicopter crashed. the 3dea agents are the first killed in afghanistan. >> after where they were flying away that's when the crash actually happened but we do go into this and remove an insurgent who was working with the drug trade. >> reporter: the governor -- the poteial governor survived an assassination attempt. in kabul protests erupted after a false report that u.s. troops had burned a copy of the koran as payback for an i.e. d attack. u.s. authorities say taliban attacker spread the rumor to stirrup trouble. president obama monday met with the national security team as he considers whether or not to increase u.s. troops. the slow pace of that decision which some obama critics are focusing on. >> president obama now seems afraid to make a decision and unable to provide his xhanter on the ground with the troops he needs to complete the mission. >> reporter: senator john kerry just back from afghanistan said mont stakes are too great to rush the decision. >> i believe president obama has been right to deliberate and take theime necessary in order to find the best policy. >> reporter: prior to monday the deadliest day for u.s. forces was july 28, 2005. that was when 16 u.s. special forces soldiers get the vaccine because there could be a third wave early next year. hundreds of people lined up at the manassas mall in prince william county to get swine flu vaccines. families started showing up early this morning and the clinic didn't even open until 3:00 this afternoon. they expected to give out about 60 vaccines. they made a 150 mile miss takes flew right past their destination. tonight a distracted driving but how aboudistracting flying? that's what two northwest airline pilots say what's going on when they missed the minneapolis airport by 150 miles last week. today they admitted they were on their laptops when they missed the airport. steve brown is following the fa. >> reporter: laptops. chatting among coworker, comparing work schedules and bathroom breaks. sounds like the office water cooler. not the cockpit of an airplane. pilots on northwest flight 188 over shot a minneapolis runway by over 150 miles last week and new information from the national transportation safety board says it was because they were talking, looking at their computers and lost track of time. during interviews with the ntsb they admitted accessing personal computers during a flight, discussing their new work schedules and losing track of time. first officer richard coal would not discuss the incident with reporters. >> nobody fell asleep. nobody had an argument. nobody had a fight. other than that i can't tell you anything. >> reporter: interviews with three flight attendants are ongoing as the ntsb attempts to sort out the facts. one corporate pilot who does not work for northwest airlines says the pilots' conduct here is unacceptable. >> if i were these pilots i would rather have to defend having fallen asleep because i was fatigued and pilot fatigue is huge issue these days as opposed to we were not paying attention. >> reporter: the ntsb report says a flight attendant caed the cockpit by intercom so ask when they were going to land. that's when they realized their mistake and turned the plane around. they were out of touch with air traffic control for more than an hour. >> i cannot believe they missed all these calls. it doesn make sense. >> reporter: the ntsb is looking at the cockpit voice recorder to find out what it may tell about the final 30 minutes of the flight. del at that time parent company of northwest airlines is offering $500 vouchers to every person aboard that wednesday night flight which missed its exit in minneapolis. in chicago, steve brown, fox news. we are following another developing for i just in to fox 5. bruce springstein can selling a concert because of a family death. a member of his road crew was found dead in a kansas city hotel. on his website springstein says the person who died is an immediate family member but does not name the person. police don't believe there is anything suspicious about the death. a big name is getting involved in the hunt for a missing virginia tech student. metallica is offering $50,000 for information about morgan harrington. the 20-year-old disappeared from a mellica concert october 17. police don't know what happened to her but they found her purse and cell phone the next day. alarming new details about a man accused of selling underage girls for sex in d.c. court testimony revealed shelby lewis is the foster father of one of his alleged victims. lewis is accused of having the girl work for him starting at age 12. he is also accused of raping her. he was arrested in may on five counts of child sex trafficking the problem of gangs in northern vij virginia received a lot of attention last march from a loud en county man was killed by a man claiming to have gang ties. a new study reveals gang activity is decreasing in some areas. fox 5's claudia coffey has the story. >> we're finding that gangs are becoming more organized and for sophisticated. >> reporter: over the past five years the gang task force zeroed in on what can be done to slow down the amount of gangs moving from urban areas to the suburbs. the result was a case study including lowden, prince william, fairfax and arlington counties. the findings revealed good news. gangs and gang activities are on the decline but it's not time to let up. >> this is the time quite frankly to push as hard or even harder. >> reporter: specifically from 2003 to 2008, violent crime in the case study areas of northern virginia found that violent crimes fell 13%. gang related offenses dropped 17%. still, the gangs are out there. >> they're waiting for us to slack off, waiting for us to let our guard down basically and give that them that inch they're locking for to move in and take over >> reporter: the gangs involved include bigger name to what is being described as neighborhood groups. a loosely organized gang was behind the heinous crime that rocked lowden county this spring. william and cynthia bennett were brutally attacked. ben it died and his wife wased. law enforcement officials believe the tide is turning because of stepped up enforcement, a crackdown in local schools, eastbound things as simple as targeting graffiti. one of the most obvious signs of gang activity in recent years is all the graffiti. that even is tough to find these days. that's because officials say they have launched an aggressive campaign to remove it as quickly as possible. officials hope to use this assessment and plan as a model in other communities. >> people are looking to this area for answers to what is a growing problem nationwide. >> reporter: the trend that officials did notice from the members say was funneled from parks and rec to the deputy mayor for economic investment, then transferred to the housing authority. that agency then awarded contracts some no bid at least one to mayor fenty's fraternity brother. this despite city law that says contracts over a million dollars have to go through the city council. were the contracts awarded illegally? we put that question to the attorney general. >> it was only when i issued an opinion last friday which is basically a definitive statement of the law that going forward, any contracts that involve more than a million dollars of local funds must go to the council for approval. >> reporter: but council member harry thomas who chairs the park and recreation committee says nonsense. >> pete orr nickel does not arbitrarily make correctly. you know, these projects may go forward and maybe they have to be relet. >> reporter: the contracts were awarded under an appointment that the cow council turned down and the mayor reinstated friday. saying she has a right to stay for an additional 180 days while he looks for another nominee. >> we asked the cfo to stop any further payments to her. he wants her to act in a volunteer basis that's on him. >> reporter: thomas says he will introduce an emergency bill trying to unseat heartsock. mary chee has a hearing set to get to the bottom of the contracts on friday. i'm virus. they're taking a look at how much tamiflu and other antivirals are being prescribed to patients. the information is broken down by sip codes and age groups so they can see which areas are express announced it will no longer charge monthly fees. new federal credit card rules will ban gift card fees before one purchase and expiration dates for at least five years. but that won't take effect until august 2010. long after the gift-giving season has passed. >> far and away the mos important thing that the recipients, the users can do, is to try to spend the value as quickly as possible. >> reporter: consumer advocates say stick to store cards if you want to avoid extra charges or you can go green this holiday and just give cash. >> another big irritation is the problems movies. next month the dvd rental company will launch a service allowing them to stream films and tv shows using the gaming console. xbox 360 has been able to do that for about a year. a netflix subscription starts at 9 bucks a month for the service. you brought up halloween. >> the good news is i think the showers will be over before the kids go trick or treating and i think it will be warm.
