minutes today at a hearing with a hearing officer from fairfax county public schools and that is their last appeal because of the level of the suspension. it doesn't go to the school board and there is no time, anyway. the graduation ceremony is tomorrow afternoon at patriot center. they just got word, the school system is standing pat. the young man, chris shoemaker and presumably the two others, we believe they did not appeal, won't be able to graduate with their class, at least not at the ceremony. they will get their diplomas privately instead. >> hmm. >> just happened, laura. >> i'm surprised. i am actually, i have to hand it to him for coming forward and talking to us about that and admitting it on camera saying, hey, i did it. >> he does admit it and he did do it. >> yeah. alert. firefighters are on the scene of the fire in the apartment complex and that is on winter third lane inegateton and did not spread to buildings and this is the same apartment complex where it was murdered over the weekend. and there is no word on if there is any connection to the case. and the fairfax county courthouse had a close call because of a bomb threat. the call came in at 9:30 this morning. the complex was evacuated and entrances to the surrounding roads were blocked. police told everyone to go home for the day and nothing was found and the court will reopen tomorrow. a fairfax county elementary school teacher is facing child pornography charges. the 26-year-old is charged with 10 counts of possession of child pornography. he's a special education teacher at popular tree elementary school in chantilly. a school spokesperson said this was the first year teaching and he was arrested yesterday afternoon. >> we have no evidence to indicate that any school computer was involved and all the evident collected was at his home in the herndon area and we have no evidence to believe that any of the children at that school were involved in any of this as well. >> finn has been released on bond and is suspended without pay from his teaching job. another day of dramatic testimony in the sex abuse trial against jerry sandusky. testifying, john mccreary, the father of former penn state football coach mike mccreary. he received a phone call from his son in 2001 indicating he saw sand of you thinky in the shower with the young boy. mccreary told jurors when he reported the incident to the former university vice president schultz, he was aware of sandusky's reputation for allegedly abusing young boys. and our coverage continues at the bottom of the hour. at 5:30, we're going go live to pennsylvania for more insight on what happened today inside the courtroom. another big story we're following tonight, the d.c. council voting for a new chairman and chairman pro-tem. phil mendelson is leading the council and michael brown is next in line. during the meeting, there was shouting, rude interruptions and tears from one member. fox 5s matt ackland there was and has more on the story. it's never a dull moment at city council. >> reporter: it sure isn't. it's been less than a week since kwame brown resigned his seat and pleaded guilty to bank fraud into a campaign violation. still, mendelson had full support from the council and things got ugly when vincent orange, who originally wanted the chairmanship, decided to make a run for the second throughout slot and took aim at michael brown. he boldly told his fellow council members there is no way i should lose instead of himself, i am the best. he attempted to criticize michael brown for media reports pointing out ethics issues and that didn't go well. the majority of the council didn't agree and voted orange down and put michael brown into the second spot. meanwhile, one of the most memorable moments was when yvette willexander spoke about the bickering she was listening to. take a listen. >> it affected us all and almost brings me to tears here again and -- i'm story. presidential candidate john edwards is officially off of the hook. today, federal prosecutors dismissed the remaining criminal charges against him. he was found not guilty of one charge in his criminal trial. the judge declared a mistrial on the rest of the charges and this means edwards won't be retried for hiding his then- mistress during the 2008 campaign. what went wrong to j.p. morgan chase. today, the ceo makes the first appearance before congress to answer that question and that they put a strategy in place to reduce risk and that back fired into the exact opposite. jennifer davis has more. >> reporter: an apologetic jamie diamond tells congress that mistakes at his bank, j.p. morgan chase, contributed to the recent trading losses of more than $2 billion. >> we have let a lot of people down, and we're sorry for it. >> reporter: appearing before the senate banking committee, the ceo testified that shareholder money was lost. the clients and taxpayers don't have to foot the bill and the bank remains profitable. still, he said it's clear that mistakes were pervasive from the top down. >> and to see the trader didn't have the understanding of the risks they took. they should have gotten more scrutiny from senior management and i include myself in. that. >> reporter: and clearly frustrated lawmakers made it clear they don't know how the u.s.'s largest bank could put the entire u.s. financial system at risk this way. >> j.p. morgan enjoyed the strong reputation for effective risk management, something, obviously, went very wrong. >> and out-of-control strategy was -- to no risk controls. >> reporter: simon said the bank made a number of changes to ensure losses of this magnitude don't happen again, including leadership changes and the strategy to oversee risky trade. >> and my conviction is that we will emerge as stronger, smarter, and better company. >> and diamond said the bank is conducting its own internal investigation. two of the top financial regulators are looking into this incident. leon panetta is criticizing the first round of changes made in the military proposed budget. they agreed last sum or a nearly $500 billion reduction in defense spending over a decade. he testified that current versions of the defense budget would force him to find money to maintain old weapons, aircraft, and ships and to hollow out the force. >> there is no free lunch here. every overhead cost retained will have to be offset to comply with the budget control acts. >> and republicans and democrats are struggling to come up with a budget to >> absolutely. this is going to be a razor- thin margin one way or another for either candidate and that is as it will be for the presidential campaign as well. >> and you look at the numbers, though. the rough math tells you it's about 88%. who are the 12% that are out there that both of these candidates are going to battle over the next few months? who is thatva virginia voter? >> it's going to be the moderate voter. a lot of them in northern virginia in this area and each candidate is going to try to portray the other as either too liberal or too conservative and to try to claim the moderate ground and that is where this will be played. >> and both of the candidates come into the race with histories and tim kaine, having been the former democrat of virginia. clearly, the president has had a rough time of it lately. does tim kaine run away from the president or does tim kaine embrace what he did as the dnc chairman and try to build on that? >> and george allen is going to pin the job on him anyway, and he might as well work with it and run why with it. the obama campaign has been organizing virginia for a very, very long time and if he can work with the organization, that is what they're pinning the hopes on. >> and we want to get to george age, you know. jamie radke, didn't come out and endorse him as ken kuchinelli, the republican attorney general who will run for governor did and is that going to be trouble for george allen? >> i think that is going to be the same process as what happened with mitt romney. the conservatives will get behind him hymn and there is another factor. he's going to have a lot of outside money coming into the state and that is going help some of the base get out and believe in him. >> and that is an interesting couple of months. professor, always good to see you. we have a long road ahead of us, wisdom. >> we know you will stay on top of it. thank you very much. house majority leader erin cantor easily won his primary and is endorsing a gubernatorial candidate. he gave the nod to the current lieutenant governor, ben bowling instead of kuchinelli, virginia's attorney general and the tea party favorite. the endorsement comes two days over whether to have a gubernatorial primary in 2013 or a convention. cu -- kuchinelli supporters want a convention. and in arizona, they chose another to replace giffords. ron barber, with the former congresswoman by his side, he thanked her for her support. >> gabby, we have loved you, and we're -- and we're so grateful for your leadership and your dedication to our community. >> barber was there when giffords was shot in the head a year and a half ago and in that attack that killed 10 people. she resigned her office earlier this year. >> and time to talk about the weather. it's nice outside. >> and a gorgeous, gorgeous day. the temperatures are down and feels like the humidity is down, too. what are we looking at this evening? >> reporter: observant on your point. the humidity is way down. way, way down from where we were yesterday and that is with that tropical feel. >> yeah. >> and all of that heavy moisture is blown off to the east and to the southeast, making it comfortable. the winds are gusty, up over 20 miles per hour for most of the afternoon and coming in out of the north and we're going to go to the sat rad and show what you we see here and this is one feature, the swirl in the clouds and that is not important for us today, but for tomorrow. we're going to have a few more clouds than what we had today and there may be a spotty sprinkle here or there and that does not mean a bad day. 81 degrees. gaithersburg, 75; dulles, 79 and down in fredericksburg, the temperature is at 81 and just a great evening out there and we're talking about the dry conditions. 77 at 7:00 and to 9:00, temperatures fallling into the lower 70s and in some suburbs, the upper 60s and that may be a pretty descent night to turn off the air conditioning and if you haven't already, enjoy the nice fresh air. in the suburbs, the temperatures are drop into this 50s and that five-day forecast and that is looking good. father's day this weekend. >> love it. see you soon. thanks. weather not good in other parts of the country. the huge fire in northern colorado is blowing is wyoming tonight. the third largest in colorado history, burning 73 square miles. it's killed one person so far and right now, it's about 10% contained but firefighters have been making slow progress. investigators say a lightning strike touched off the flames. and in new mexico, almost 1,000 firefighters are trying to beat back a flames of a 56- acre fire that damaged more than 200 homes and other buildings. they're making better progress than the folks in colorado. this fire is about 35% contained. there are at least 19 large fires burning in nine states right now. and coming up, a woman is gunned down inside the hospital. and a search ends for a gunman accused of murdering three people near auburn university. and also ahead, we're learning about how george zimmerman's wife tried to hide the true status of their finances. [ male announcer ] romney economics. it didn't work then, and it won't work now. . the hunt is on in buffalo, new york, for a person who shot and killed a woman inside the hospital. happened around 8:00 this morning at the erie county medical center. the police say the woman was shot several times and believe that she was targeted. the hospital was locked down for hours while police look for a shooter. leonard turned himself in to police last night. he is accused of shooting six people near auburn university over the weekend after a fight over it woman. and three of them died. two were former auburn university football players. the current player, eric macks recovering from a gun shot wound. the university's head football coach said they all stunned. >> and the whole auburn community and family is devastated. and the passing of three young men is hard to put into words and difficulty that a lot of people are facing right now. >> two other men have been arrested in connection with the case. one on charges of hindering prosecution, and another for allegedly providing false information to police. we're learning more about the arrest in george zimmerman's wife. shelly zimmerman was charged yesterday with perjury. investigators say she transferred small amounts of money to hide the true status of the couple's finances while they were trying to get him released on bond. george zimmerman is charged with second-degree murder in the shooting death of trayvon martin. shelly was released on bond. meantime, a judge revoked george zimmerman's bond and he remains in jail tonight. coming up, deliberations continue in the roger clemens perjury trial. why it appears this case is put something jurors to sleep literally. and lance armstrong is facing an uphill battle. we'll tell you about the doping charges that could lead to his ban from the sport. and a heavy metal band teams up with the fbi after a student who went missing at a concert is found dead. details are next. . new trouble for the seven- time tour de france champion, lance armstrong. the u.s. antidoping association brought formal doping charges against him, according to "the washington post," who broke the story. a letter support to armstrong states blood samples collected in 2009 and 2010 were, quote, fully consistent with blood manipulation, including epo used or blood transfusions. the charges are not criminal and could lead to a ban from competition and strip him from his title. on twitter, he called it a latest effort, a witchhunt and said that, quote, i have never doped and unlike many of my accusers, i have competed as an endurance atly for -- athlete for 25 years with no so to speak in performance, passed more than 500 drug tests and never failed one. and today, jurors asked for a master list of exhibits as deliberations continue in the roger clemens' perjury trial. the eight women and four men met for 3 1/2 hours this afternoon. and clemmens is accused of making false statements to congress and two yourors were dismissed. lawyers previously raised concerns about the woman's attentiveness during the trial. and more emotional testimony in the sex abuse trial of former penn state assistant football coach jerry sandusky. three alleged victims took the stand and all are telling similar stories of sandusky allegedly sexually assaulting them. and they're offering up football tickets and gifts to win their trust. reporter bruce gordon joins us live with what went on in court today. bruce? >> these stories day after day are enough to turn your stomach. i am curious what the reaction has been from the jury through the stories? >> ality one point, laura, there were tears and that seemed funny. today, for example, the day ended with testimony from a penn state janitor, who recalled the shocked reaction of his coworker who said he walked in on sandusky and a young boy naked and engaged in oral sex in a campus shower facility in 2001. the eyewitness has been in frail health for some time and couldn't come to court and that followed three more direct accusers coming to the witness stand and that is a similar theme. vulnerable young boys and men, many with no father figure to speak of, befriended through sandusky, he flowers them, lavishes them with attention and gifts. the next thing, there is horseplay of an increasingly sexual nature and some sort of sexual conduct and contact that has been tough to listen to and tough for the witnesses to get their stories out on the stand without breaking down. >> and i will bet it's tough. let me ask you, also, what is the reaction of jerry sandusky himself? and that is as he sits there and faces the accusers. >> he left court with an orange load of files and looked like he didn't have a care in the world. hard to imagine. in court, there is little emotion and an occasional smile as some of the early reminiscees of the relationships are described. the friendship and the gifts and i, frankly, have sign sadn his face and burying his head in his hand and he's been a flat aspect or a smile, depending on what is coming out of the witness stand. >> and he took a stand yesterday and in 2001 by mike mccreary and what she a -- he saw in the showers in 2001 and tell me about his father's testimony today? >> and basically backed up what his son said and this is one of the more introgging elements of the case. you will recall the actual alleged victim in this instance give came forward. mccreary said he walked in on the shower scene and what he described as a sexual molestation going on between sandusky and this is in 2001, and it was clear that whatever he told university officials and later joe paterno the then head coach for penn state, no one followed up in any particular way nor, frankly, did mccreary call police or stopped months later to say, gee, i saw this guy raping a young boy. how come i am seeing him wandering around campus? there are plenty of questions about the conduct of lots of folks involved in that case. >> and bruce gordon, thank you very much for reporting to us tonight. >> sure. and academic leaders at the university of virginia are fighting to keep their president who plans to resign in august. this week, the school's board of visitors announced theresa sullivan would step down due to, quote, philosophical explains. they sent a letter to the board asking it what happened and to reopen talks with sullivan and the faculty. and metallica is teaming up with the fbi to try to catch a killer. the band made a public service announcement hoping to find the man who murdered morgan harrington after one of the concerts. take a look. >> and if you have seen the person in the skip or any others, please contact your local police or submit your information online and remember any, information, no matter how small you think it s could be the crucial piece that investigators need to help solve the case. right now, there is up to $150,000 reward. >> and harrington disappeared during a metallica concert in 2009. her skeletal remains were found three month later in a field about 10 miles away from the concert venue. coming up on the news at 5, casey anthony breaks her silence after being flushed out of hiding. >>. and i shocking dash cam video showing a toddler being tossed from an suv during a high-speed chase. we're back in a moment. . shocking video out of texas where a toddler was thrown from an suv after it flipped over during a police chase. the dash cam video shows the suv after the crash. the driver trying to regain control of the vehicle. and you can see the 18-month- old child on the ground getting up and trying to walk away. one of the suspects rushed to the scene and scoops her up. four teenagers were later arrested and the toddler was not hurt. police say one of the teens was the little girl's father. >> oh, boy. after almost a year after being acquitted in the murder of her daughter, casey anthony is breaking her silence. the florida mother has been in hiding since her acquittal. cnns piers morgan had a 10- minute phone conversation with anthony and is no telling the world what he should -- she had to sea. >> i said one of the big -- what is the biggest misconception? she said there are several misconcessions. obviously, i didn't kill my daughter. >> that she is ashamed in many ways of the person she was. her daughter disappeared in 2008 and her remains found five months later. coming up, putting in some new rules in place to keep kids safe on the football field. and first, let's check in with lindsay. >> good evening, from redskins park. mike shanahan caused an -- the day before the minicamp practice and santana moss, a lean, mean, fighting machine and talks about his weight loss and why he had to do it into the season, laura. >> thank you. and this nice weather is not going away any time soon. glad about that and gary is back with your forecast. don't go away. it's a unique american sport, we're talking about pop warner football. it's been a growing concern about how dangerous it is for kids. tonight, the league is in the middle of a medical conference in chicago and we're talking with john butler, the executive director of pop warner live via skyp from chicago. thank you very much for talking with us. let me start off by asking this question. there is a lot of talk about concussions and how dangerous football is on the pro level and in the nfl. how much of your new rules changes were driven by the nfl? >> very little, really. the changes came out starting a couple of years ago with the new awareness and a concentration on concussions and interviewed a concussion rule in september of 2010 and in the state of washington and the new rules evolve from now research coming out of virginia tech in february of this year that show the two areas of greatest concern and practices are the number of heads -- hits a child or flayer gets during practice and, cent of all, the full- speed head-to-head contact you mentioned in the nfl and we interviewed two rules for virginia tech research and the first is to limit the amount of time allowed in contact drills and scrimmages and the second, reducing and creating a level of force generated by reducing full speed head-to-head drills where the players start no more than three yards a part. >> and you mentioned the new rules pages -- changes. were doctors consultd? where did you get the rules banning a full speed and head- on blocking. where did this come from? >> and that came out of the research from virginia particular. >> uh-huh. >> and that was reviewed and discussed by our medical advisory committee. and between february and now, and we thought it was a great starting point. certainly, the 1/3 of the time and practice the full-speed contact and, second of all, the drills are no more than three yards a part and there is no specific basis for that decision because we're the first in football to initiate any rules like that. and we think it's a great starting point and as we get feedback and new medical research comes out, it will address that at the time and change further, you know, and if warranted at that time. >> and all right, john butler, thank you very much for joining us and talking about this important issue. he is the executive director of the pop warner league. thank you very much, john. we appreciate it. >> thank you. the nfl regular season is less than three months away and that is not stopping the redskins from getting ready as they hit the field for mandatory minicamp and lindsay murphy has more. >> reporter: hey, laura. mike shanahan scored serious brownie points with the team. he's cancelled tomorrow afternoon's practice session, that doesn't mean that players don't have to be here and they will show up, have meetings and do all of that. the reason shanahan did this is because some of the players are banged up. the other reason, they have had a good minicamp and offseason workout and the 33-year-old moss has something to prove and he knows what works and what doesn't in the nfl. he knows he has some competition this season. and he spent his offseason losing weight. losing 15-pounds to try and keep up. last year he started strong and struggled later in the year after breaking his hand. he's one of the best wide receivers in franchise history and he still has something to prove this year in the 12th nfl season. >> santana's entire offseason, he came in possessed and he was ready to go. he saw it physically and then to see him in the meeting rooms, he's been great and so attentive and that showed. he's not thinking out there and feels confident and feels confident and with the knowledgeableon, fence and there is no hesitation. >> i felt like i was at my best in my 190s, you know. the last few years, i played in my 200s and after the knee surgery. that could have been why i never went down. i kind of stated that, you know, not being out here and i got comfortable and had a great year with it and said i can't do that and there is something i wanted to do and felt like i couldn't do it and i was winded and stuff like that and i talked to ray during the season and i want something to do in the offseason to come back healthier and lighter. we put a plan together and i came back and i am loving, you know, how i feel right now and the way it's supposed to be. >> and it's -- his hard work is not unnoticed. shanahan said that he looks as good as he did three years ago. that is a good complement. bryce harper proves he can hit big-league pitching and handle little league questions. >> looking forward to that. thank you. and the university of north dakota will no longer be called the fighting sioux. the vote comes after a lengthy debate on the topic, causing the vision between fans alumni, residents, and local tribe. those supporting the name say despite the outcome, they have no plans to get better than where we have been and temperatures now, 81 degrees and we should be, basically average is 83 degrees or so this time of the year and in gaithersburg, great; 75 and 79. monasses, 81 and in to fredericksburg, they cooled off and annapolis, 80 degrees and across the bay for the eastern shore, the temperatures in the upper 70s, too and there is no complaints, a few clouds out there and that is nots a problem, no chance of showers and storms and there is that slight chance tomorrow that we could have a couple of sprinkles or a spotty shower here and there and with this one feature to the east of us, the area of low pressure which is sitting and spinning out there and the next 24 to to36 hours before it shifts to the south and as it shifts, it's no longer a player for our weather and tomorrow, we'll have enough of the area here that it will bring around more clouds and, again, a possibility of say shower or two or a sprinkle or two tomorrow afternoon and evening and that should not be a big deal. tomorrow, we're not talking about perfection like we had to today. the clouds moving out this evening and some more overhead and look like it going to be nice. the overnight is good, too and some clouds overnight tonight and coming in. the suburbs with a chance to drop into the mid- to upper 50s and farther west and northwest you go, the cooler it's going to be and in town, we're talking about only mid-60s or so, the wins calming down -- winds calming down and five to 10 miles per hour. tomorrow morning, we'll have clouds, the temperatures in the upper 60s and some clouds around at noon. 76 and that is going into the mid- to upper 70s tomorrow and with that increase in clouds and some sprinkles possible late tomorrow afternoon and evening. again, the high temperatures tomorrow and instead of the lower 80s, we're talking the upper 70s and this is the future cast tomorrow morning and notice some clouds around. and not everybody is going to be
