thank you, karen gray houston. the story you will see first on fox 5. a virginia man is suing the prince georges county department of corrections after he was locked up for more than four months under another man's name. it was a mistake that went uncorrected despite numerous pleas for help and two orders from a circuit court j. he lost everything while wrongly incarcerated and now, he said he wants an apology. paul wagner is no here with the story. paul? >> reporter: parker spent more than 127 days in jail trying to convince anyone who would lissen that he was not michael jerome lewis. a man wanted on two outstanding warrants who happened to use parker's name as an alias. despite photographs and fingerprints that would have proved his case, according to lewis and according to his attorney, no one checked it out until a judge issued a second order. claude parker showed up to work one day having no idea his world was about to be turned upsidedown. a record's check at the gates to andrews air force base told the mp on duty a man using the alias claude parker was wanted in prince georges county. >> when i got arrested, you know, i gave them all of my information, i.d.ering everything like that and imthinking i gentlemanning to jail until they got it straightened out. >> reporter: according to parker's attorney, that is putting it mildly. >> on november 13th, some two weeks after he was arrested issue he support a letter to the jail up the chain of command and asked for them to check his fingerprints and photograph. they sent him back a response saying basically you need to do that at the courts. we don't do that. >> reporter: in the jail he sat wondering, waiting, hoping for something, anything, to happen. >> one time i just, i just wait until the people bring the mail hoping that someone will look at my photograph, my fingerprints and find out -- man, i mean, every day i wait for mail, mail, mail thinking somebody had checked. >> reporter: despite his pleas, no one compared photos or fingerprints. this is what michael jerome lewis looked like when parker was taken into custody. if the prints -- prints were compared, joe lamari has no doubt that claude parker would have released him. it took a judge's order before someone realized that claude parker was not michael lewis. >> they have a tv parker -- camera in the jail and that is how he's presented before the judge. the judge said what happened to the fingerprints we orderd? they couldn't find them? by couldn't find the response. the jail people or whoever was there responding to the judge. and he ordered it again. >> reporter: although it took several more days, this time it worked o. lewis' picture, the jail official wrote on it not him. >> something had to be done about this. you know, you can't get away like this and you can't let them get away with this. if they get away now, it will happen again. >> since his ordeal, claude parker has been able to rebuild his life and if there is one thing he wants from the county, it's an apology. he was released from jail in march 2010, his trial is to start april 23rd. the spokesperson for the attorney and department of corrections declined a comment citing a pending trial and this is a final twist: michael lewis didn't pull claude parker's name out of the blue to use as an alias. the two were once acquaintances. maureen? >> interesting story, indeed. paul, thank you. a maryland man who wanted to wage jihad against the united states is sentenced in a bomb plot. the judge sentenced antonio martinez to 15 years in prison. he pleaded guilty to faking a fake bomb in front of a recruiting center in 2012. he believed it was real but he was working with undercover agents who gave him a fake device. a new day, a new twist. the baltimore county woman who claims show has the $105 million ticket now said that she lost it. and does not sound worried about finding it. show claims she hasn't checked the pockets of her mcdonald's uniform from the night she bought the ticket. and maryland's higng argume whether to allow divorce for gay couples. the state doesn't allow same sex marriages. a lesbian couple married in california was denied a divorce because their marriage is not legal under maryland law. the court of appeals will likely take months to rule. starting in january of 2013. same-sex marriages and divorces will be legal in maryland but opponents are trying to get a referendum on the issue on the november ballot. minority business owners are asking the maryland legislature to pass a bill for offshore wind. the law would force energy companies to get a small percentage of their power from off-- offshore wind. we're following breaking news from howard university that doesn't concern this video here. we just learned that student athletes who were recently declared ineligible by the university have now been re- enstated. howard temporarily withheld a number of student athletes from competition as part of an internal investigation of possible ncaa rule violations. a university spokesman said that all spring sports teams will compete as scheduled for the remainder of the season. and another big story we're following tonight. councilman marion barry's apology is quieting the controversy after his remarks about asian merchants in ward 8 in explaining his remarks on thursday, barry said he has serious questions about the health and cleanliness of some asian-owned food stores in his ward. tonight, the d.c. department of health is weighing in and tom fitzgerald has more. >> reporter: the councilman made it clear yesterday explaining this that he's not backing down from what he said is a serious concern. and that is he said some of the asian food stores are not clean enough and not healthy enough and endangering the health of his constituents. the d.c. department of health told us if councilman barry has the concerns so far, he's not sharing them with them. >> my history is completed. an excellent history. >> reporter: in explaining his remarks about asian businesses in ward 8, councilman marion barry said he's apologizing to anyone who was offended and has long had health concerns about some asian food stores in ward 8. >> we're not going have business people who come into ward 8, poor service and dirty facilities taking money out of our community and not contributing to our community at all. that is going to change. >> reporter: this is a store the councilman himself said is an example of how a food store should be run. martin's food town in martin luther king boulevard southeast where he himself said he shopped. the one part about his remarks that the councilman is not backing down from, what he said are health concerns about some of the asian-owned businesses in ward 8. but also on martin luther king boulevard is the china in deli cited by the councilman as a business that could do better and the cleanliness and the overall health of the food it serves. >> had has the department of health receive good complaint from councilman barry about the establishments in ward 8? >> not that i'm aware of. no. >> reporter: robert settler is a manager for the district of columbia's department of health and in charge of food hygiene inspection throughout washington, d.c. >> we're concerned about whether people are getting sick from the food they eating, and we just don't see the evident to support what is being said. >> i while mayor gray and the congresswoman has rebuked his remarks, he has gotten groups -- support from the groups like pan-asian american consumers. >> marion barry is not a person with a mean heart. i know him, knew him many years ago and think he's a big person. politics makes people do and say strange things. >> reporter: for its part, the department of health is hoping from now on that anyone who has a complaint about a food store will call them to report it. and we should tell you that we contacted councilman marion barry's spokesperson and asked him to provide us examples when the couple men or his office requested the health investigation into the ward 8 businesses and the spokesperson said while hosting an event. craig bosswell has the story. >> reporter: the labor department said the job market diminished in march adding 120,000 jobs and that is down from the 200,000 expected and the smallest monthly increase since october. >> and we do see jobs being created in manufacturing, leisure, hospitality and healthcare and business and profession. we know there is movement. >> reporter: the government said the unemployment rate dipped last month to 8.2%. >> our economy created more than 4 million private sector jobs. >> reporter: president obama commented on the jobless numbers while hosting a forum on the women and economy. a key voting block in the november election. >> a tremendous war chest and skill as a campaigner. that is the good news. the bad news, the disposable income good to see you. >> reporter: are people changing their driving habits because of the high gas prices? >> reporter: at one level, they say they are and we don't have enough to support that and some people are traveling and driving in great abundance. the thing is that $4 may be to them, since they have seen it three times before, this is the third time we have seen it, that it might be the old $3 gas as far as they're concerned. they adjust, some consumers are complaining about the prices and there is something so much of a psychological barrier. >> right. >> and people modify and change the behavior. >> reporter: what is to blame for the high gas prices now? >> that would be the speculative premium, as it's called. crude is trading over $100 a barrel and there is no real justification for prices at this level. think about it. when gas was $4 three years ago, the cost was a barrel of oil was $140. and something out of whack and out of sync, and it might be that all of the speculation that is going on is jacking up the price. we know that it contributes to about $28 to the cost of a barrel of oil. when it comes to popping, at the pop, it contributes about 58 cents. >> with gas being at the $4 mark, is this something we're going to see consistently? and not be lucky enough to see $$3.50 a gallon. is that what we're hear something. >> and we're saying pump prices continue to increase to the $4.25 rainfall nationally and with 6 cents away from the $4 point now across the country and we transcended that in the washington state area and the state of maryland. on they have found the gun used in a shooting rampage in a california college. the person was charged with five counts of murder and three counted of attempted murder. they found the weapon along the shoreline at the tribbary a half mile from the school and matches the serial number of the gun purchased by go. a tragedy in texas after a man opened fire without warning inside a wal-mart killing a police officer. the police responded to a call for a drunk man in a store in austin at 2:30 this morning. the man immediately pulled out a gun and fired. the senior officer was shot in the neck and died at the scene. two wal-mart employees were able to tackle the shooter and held him until another officer arrived. and coming up at the bottom of the hour, the latest out of virginia where a navy fighter jet crashed into an apartment complex. and a new study shows banned antibiotics are showing up in poultry products. we'll have the details. and the irs arrest odd-- audits are going up. what triggers uncle sam to audit you.  . >> our top story tonight, seven people, including two pilots have been taken to hospitals after a navy jet crashed into an apartment complex in virginia beach. authorities say the fiery crash destroyed three buildings and caused significant damage to two others. witnesses saw fuel being dumped from the jet before it went down. both pilots ejected safely. and it was not your typical rescue call in prince georges county. yesterday, fire crews in the small town of croon rescued two pigny goats after a worried citizens alerted them that they were running loose in traffic. firefighters today are looking for the owner of the goats, rather than turning them over to animal control. one of the firefighters who rescued the animals is caring for them until the owner comes for them. a health alert tonight. a new studdie from john's hopkins in arizona state university found unwanted items in the chicken you might be buying from the grocery store. they found antibiotics that were banned years ago by the fda and traces of pain relievers and caffeine. here to talk about the study is dr. dave love from the john's hopkins center for a liveable future. thank you for being with us. >> sure, thank you. >> and does this mean it's in all of the chicken we're eating, including organ snick. >> not necessarily. when these are fed to chickens, they usually clear the body quickly. in this study, we looked at chicken feathers and these drugs don't clear feathers quickly. we used feathers as a way to understand and look at what chickens were fed previously on the farm before they get slaughtered. >> and where would we find the chicken? how widespread is it? >> reporter: this could be from any chicken in the united states. our sampling strategy was to collect these samples from six states around the country. >> even if it's listed as organic s it possible that these additives could be in the chicken? >> that is not likely. under the usda organic standards, antibiotics are not allowed in those chings. >> if it says no antibiotics, we're assured that as far as you're concernd? >> that is true. >> okay. >> and how widespread is this issue? can you give us a perspective on the amount of antibiotics found in the feed? should we be concerned and how concerned should we be? >> this issue points to the larger issue of how we raise animals. chicken are raised in confinement, 100,000 or more can be in one barn and they live in dirty conditions that are unhealthy for the chicks and -- chickens and that is why antibiotics are used, to keep them healthy and to make them grow faster and this gets back to how we produce animals and the risk to courages on the shelf might be minimal from -- and actually, we looked at chicken feathers and can't comment on the meat. >> the overall concern, explain that again, dr. love, i think that is something not everyone is aware of. the overuse of antibiotics is a real concern right now and that is with the superbugs more doctors are seeing out there. >> that's correct. the use of antibiotics on the farm may not lead to residues in the meat that you find at the grocery store, but chickens and the bacteria in them development antibiotic resistance. that means they resistant to the drugs they're given. if humans, through their interaction with the environment, water, soil, farm workers could take the bacteria home with them and pass them to the family and that is the community exposure we're concerned about. >> the point here about the study is to bring awareness to the consumer? >> i think it's twofold. certainly, courage awareness is one issue and we want to bring this issue up with the fda and ask them -- we found these banned drugs in chicken feathers. one, why were they there and two, what kind of oversight can we have to assure this doesn't happen in the future? >> dr. dave love, thank you for shedding light on this. >> you're welcome. still no official cause in the salmonella outbreak. 93 people across the country, including here in the country v gotten sick. the cdc said that officials have not pinpointed the cause but most people reported eating sushi within a week of getting sick. so far, 10 people have been hospitalized and no one has died from the bacteria. and tonight's consumer alert. check your protein drink if you have a point allergy. odwala is recalling the monster beverages. four people who have point allergies have had severe reactions. they recalling the bolts. it's working with the fda to investigate the cause of the allergic reactions since the drink contains no peanut or tree nut ingredients. the deadline is quickly approaching. the last thing anyone wants to hear is audit and that is increasing across all income levels. fox business brenta buttner shows us how. >> reporter: the deadline for filing your tax return is fast approaching. to reduce your chances of being audited this year, you will need ton what the irs considers big red flags. you may be able to claim a deduction for expenses related to your home office, including home insurance and some utilities cost. be prepared for the irss attention. >> if i have a big screen tv in there and invite friends to watch football and so forth, can't detect it. people need to be careful. >> you have to have great documentation and photographs, even, of your home office to ensure if do you get audited, you have the backup to prove you that did the right thing. >> reporter: and your commute is not deductible. but, you can claim a vehicle if you use it for income sources. >> the general test is that is there request hope of making a profit? you can take the deductions and if in all honesty, it doesn't look like something is going to make you mean, they >> yeah. >> and that is going to be breezy tomorrow and that is great for easter-egg rolling. and probably too dry. it's a beautiful friday, as well as pass over and easter weekend is upon us. that definitely got here fast. we have everything in bloom around the city. the azaleas are coming out and that is looking pretty. the weather is going to match up as well. 63 is average for this time of the year and that is where we will be tomorrow and should have a good amount of sunshine and that breeze is back. easter sunday, we have hung with the temperature all week. 68, could touch 70 degrees and a lovely day. there might be high clouds passing through and won't do much to obscure the sunshine. we're expecting it to be a dry day and talk about monday, too, for the white house easter-egg roll and a couple of showers here and there and nothing widespread. temperaturewise 62, degrees and dulles at 60, below average. bwi marshal, 61 degrees and later tonight, take a jacket. it's going to get colder. the sun will go down at 7:37, and the temperatures will start tanking quickly and the breeze will continue, too, and it will feel colder. 62 in d.c.; 59 for annapolis and gaithersburg; 66, count yo -- quantico and to the south and west to the monasses area. the winds are gusty to 25 and earlier today up to 30 miles per hour. we have a big area of high pressure building in and can you see the winds gusting as high as 28 miles an hour in cumberland and they will eventually get better as we go through the overnight, and then we get chilly. i think d.c.'s going to -- i think d.c.'s going to have one of the coldest nights in awhile, down to 37. a lot of places close to 32 degrees. and in a few spots, we could see some upper 20s if the wind dies down. so, we'll call it a cold night and showed you this awhiling on. we have a fairly widespread freeze warning now and everything is in light blue and includes howard, montgomery, fairfax and that portion of arlington. tonight might be the night when that happens. a weak area of the low pressure is moving off of the coast and to our south. this storm is moving up the atlantic and can you see that here in the future cast. as it does that, that is cranking in the wins to the north and east and that is where it gets to tomorrow. at the same time, we're going to have the high pressure building in and while that is still a sunny day for us in d.c., it will be breezy. and we am roll this into sunday morning, 9:00 a.m., the bright start to easter, although probably chilly, not as cold as tonight will be, though. and a few clouds might float by during the day and we think as we get into easter evening, everything is going to be nice. watch for monday, though, talked about the white house easter-egg roll and there is some snow through pennsylvania and the higher elevations and that is kind of drying up, a spotty shower is all we're expecting here locally on monday, and unless that changes. there will be some are widespread showers through pennsylvania. and we're in good shape as we look at the five-day forecast. the only thing i would say is with the time for us to get rain, we have little in the forecast. some spotty showers on monday, maybe, maybe a couple of showers scattered around next week and that is looking like a bunk of storms coming by. >> and you have to bring the may flowers. >> yeah. >> and that will. we need more april showers. >> okay. >> we have to work on that. i'll put in the order. thanks, sue. the talk of the town on tmz. kim kardashian and kanye west dating. she was coy about it on "the today show" today. tmzs gary joins us live from l.a. good to see you, gary. you guys broke the story -- . >> hey, how are you doing?
