masked gunmen shot by police. a house filled with college students targeted by would-be burglars. that is what police say started the whole thing. when were called in, that is when the violence broke out. two suspects are dead, a third is in custody and the search for answers is beginning and wall wagner is live with more on. this. >> reporter: we got a first look at the police affidavit and what police say happened is there were 10 university students in this house on irving street, when three men entered the house, one with rifle, two with pistols and had masks on announcing a burglary and/or a robbery home invasion, however you want to describe it. and one student was able to get out, hit himself and called 911. the police responded and surrounded the house. >> about 10:30 last night, officers from -- to call for a burglary in progress, and this is a burglary for people in the house, a home invasion-type burglary. the officers get on the scene quickly and surround the house and observe what appears to be three gunmen, all armed inside the home. as the house is surrounded by police, the gunmen exit the house and shots are fired. >> reporter: police fire back, killing 21-year-old kaio and 19- year-old sealy. the third man, 22-year-old stefan fields, surrendered. law enforcement said fields had been to the house before and went back with the intention of stealing from the students. >> it was frightening. i was in the backyard putting out trash and all of a sudden i hear the shooting and i rush into the house. it was obvious. >> and there was was a party going on and they had targeted the party, from what i understand, to rob it and when officers responded, they saw individuals inside. >> reporter: and after one p.m., eight students were escortd into the house. the officials with them declined to comment. >> what i feel comfortable saying right now is that with the information we have, it doesn't appear that this is a random crime, and it appears that this place may have been targeted. >> reporter: two neighbors living inside of the house on irving street both say they heard six shots fired. they declined to go on camera but said the students who live there have not been a nuisance, since moving in last summer. the police affidavit that we just got a look at was filed and in support of an arrest of fields. he's the one person that survived this, basically this home invasion. basically, he was not -- he was one of the three that went to the house, according to police, and according to that affidavit, laura, there is new information we had not heart and -- heard. that this was going to for 30 minutes after the call was made to 911. according to the affidavit, the men were inside the house for 30 minutes before they all ran out of the front and shots were fired at police. police fired back hitting two of them and stefan fields was the one who was not hit by the gun fire and has been ordered held without bond tonight here at d.c. superior court, laura. >> all right, paul wagner, thank you very much. jack johnson used to be prince georges county executive. today, he's indicted accused of betraying the public's trust and trying to cover it up. beth parker is in the newsroom with new information on the case. >> reporter: well, conspiracy, extortion, bribery -- those are some of the accusations against jack johnson and that is laid out in an indictment returned by a federal grand jury. pay-to-play. that is the kind of government the feds say that jack johnson was running as prince georges county executive. a federal grand jury returned an it error-count indictment and the officials on official problems became public last september when a search warrant was at his house. >> and that is for people who know where to work. >> reporter: the indictment includes the text of a phone call from that unnamed candidate for office. he said this guy tonight, you have to make him and the -- and the liquor dealers. they're going to make -- they going to give you a huge amount of money. i got developer a, i got a lot of indian guys. all of that stuff, we going to tap into the money. >> this time. makes reference to millions of dollars in government benefits, and hundreds of thousands of dollars in illegal payments. >> reporter: u.s. attorney rod rosenstein said while the indictment doesn't name candidate a, their work continues. >> and this is an active and ongoing investigating, we anticipate additional charges. >> the indictment said johnson conspired with others to accept bribes in exchange for johnson and other public officials to use their influence, to benefit developers trying to buy land, win federal grants, get perms and do business with prince georges county. and, of course, you probably heard about another phone call. that is the one between johnson and his wife leslie. he's accused of urging her to flush a check down the toilet and hide money in her undergarments. agents later found $79,000 worth of cash in her undergarments. she was not indicted today and we did reach out to jack johnson's lawyer,bley martin and there is no word from him. johnson said all along that he's innocent. >> and let me ask you, we know the grand jury indicted him. what is next for him? >> the case could go to trial and there could be a plea. if johnson were convicted and you total the charges, it's a maximum of 115 years. and the attorney said he's like toy spend a significant period of time in prison. >> all right, beth parker, with that news of the indictment. back to you. warm temperature, sunny skies and the wind is causing a few numbers -- problems. the faa reporting that flights into dulles are seeing one-hour delays and fox 5s gary mcgrady is live with more on these will. >> gary, thank you. the first round of the 2012 budget battle began today. president obama support his $3.73 trillion spending plan to congress. the president said it contains $1.1 trillion in deficit -- deficit teaing -- savings over the next decade and republicans are slamming the plan saying the so-called investments in our future is that code for more spending. >> education is an investment we need to win the future and that isic innovation and infrastructure is an investment that we need to win the future. >> and to make sure that we can afford these investments, we're going to have to get serious about cutting back on those things that would be nice to have but we can do without. >> and republicans plan to offer their own spending proposal for 2012. dire warnings for schools today. the school board unanimously approved a $2.2 billion budget proposal for next year. the county said that is money it doesn't have. officials say anything less than that will meet draftic cuts in the classroom and sherri ly is live with more. >> reporter: the school board's vote is what is considered the first move in a complicated chess mask. it must get past the county executive and council and both have said that the school system, which made up 57% of the county's entire budget this year, will have to make due with less. >> and from -- what was your perspective. and by state law, the county must spend the same amount as the previous year and called maintenance of effort. more students equals more money. >> here in montgomery county, our situation is dire and some pediatricians believe that should happen if the safety can't be proven. fox 5s money reporter melanie alnwick is looking at a new report today. what you have learned? >> reporter: expect this to be a big fight. energy drinks are big mean. the fastest-growing segment of the u.s. market. some say kids are drinking too much of them. energy drinks have become a $9 billion-a-year industry in the u.s. but not everyone is cool consider with their caffeinated kick. >> from the school system's standpoint, we need to protect the kids. >> reporter: fairfax county public schools was one of the first in the d.c. area to ban energy drinks in sports programs. athletic training administrator said that there had been is incidents of overuse. >> and the combination of the two, many times was not a good mix. >> reporter: the ban is now in effect in all of virginia schools. a paper published by the american academy of pediatrics backs up much of their concerns and what doctord for a few years now. >> and that may help. >> reporter: researchers looking at published articles found that around a third of 12 to 18-year-olds said that they regularly drank the stuff and that high doses have led to medical treatments for liver damage, kidney failure, breathing and heart problems and seizures. >> it's very misleading and has a lot of misinformation contained in it. >> reporter: the american beverage association said that most energy drinks have less caffeine per serving than a cup of coffee and that most kids are not guzzlers. the spokesperson and registered dietician said that parents and young people should pay attention to labels. >> and that is important to educate yourself and -- >> the paper's authors are recommending more study and perhaps regulation: u.s. poison control centers have not been able to opinionpoint how many energy drink overdoses there have been and that is important to know and poison centers have a special color story for energy drinks and there will be a better way to track the issue going forward, will in. >> any idea how much caffeine we're talking about here? >> oh, no, he did not. >> what did you do for your honey? >> i can't say, it's a surprise. >> oh, there you go. >> nice way out of that. is that good? you have to agree you like it when they score. that was a nice effect. >> yeah, good stuff. >> and the pride of san mark os, texas. >> there he is. >> and brought some of that texas weather. part of the day today. >> and windy and warm. yeah, and then in texas, if it's known for the kind of weather if you wait five minutes, it will change. >> there you go. >> and that is what happened out there as you know and this is what is happening out there right now. and that is windy, been windy all day and it's getting colder now with snow to the northwest and into western pa and there is some snow. we start with the wind advisory and that is to lead everyone know and wind gusts still and i think we could have wind gusts, exceeding 40 miles an hour and with 50 miles per hour winds and limited back farther to higher elevations and between 40 and 45 is about as much as we're going to get. in town on the hour, anyway, gusting to 41 miles an hour and with gaithersburg, 23 and you can see the rest of the numbers. martinsburg is up over 40 and with some rind withs. lins, it's going to be colder tonight and tomorrow and things change and we'll have several days here and by can have two days and three days, really, this week with temperatures up over 60 degrees and we managed with 70 for a high today and that is not a record. the record high temperature on this date, 73 degrees and that is going back to 1990 and they set a record high temperature and on this day, it was warm. look at frederick, down to 46 degrees here and they were up close to 70 degrees and this is a fairly significant cold air mass and this started to to come on across and snow is flying out there. and that is with 36 degrees now and beckly is 42 and i think we will be warmer than 30s and into the 40s for highs tomorrow and that is still going to be windy tomorrow, for the first half of the day and that is going to make it feel colder and that is this side of bit bug and some rain, too and that is a mixture out there and in terms of building in, though, and this is going to pass on by and there is this initial front moving through and dropping the temperatures this evening and tomorrow. there is a little re-enforcing band of colder air coming out of the great lakes and that is not going to have much of a bearing and that is with upper 20s in the suburbs and breezy at noon and some high temperatures in the 40s and breezy and into wednesday and on thursday, the high pressure scoots over and brings around the return flow and on thursday, friday, we may be pushing 70 degrees again and remember, breezy and colder for tomorrow and do not think tomorrow is going to be like today. you will be in for a shock and as you're going out this evening, you need to put on a jacket. laura, there is your forecast. >> and -- >> i will take it, thanks. and shock value may describe the 53d annual grammy awards that aired last night and we're not talking about the red carpet outfits and sarah frazier is here to talk about the surprises last night. >> and there were so many. and i have a list here, too and i want to start with lady gaga and -- >> in the womb. >> what do you make of that?
