in the sports world. lance armstrong to be stripped of every one of his seven tour de france titles. while he's dropping his challenges to those charges, he's strongly insisting today he is innocent. >> in a powerfully worded statement armstrong says enough is enough and he refuses to participate in a process that, in his words, is unsided and unfair. we're going to get right to this story now. nbc's anne thompson joins us with details. good morning to you. >> reporter: good morning. what's really stunning about this, lance armstrong is a fighter, the tour de france and testicular cancer. now, while he's decided he's no longer going to fight these charges, he's also not admitted to doping and he refuses to participate in a process that he says in unfair. never a quittere lance armstrong was a historic seven-time tour de france winner, cancer survivor. now he says he's through fighting a battling that dogged him for years, charged with using banned substances. in a statement on thursday armstrong says, there comes a point in a man's life where he has to say enough is enough. for me the time is now. if i thought for a moment that by participate in usada's process i could confront these allegations in a fair setting and, won and for all, put these charges to rest, i would jump at the chance but i refuse to participate in a prooz that's unfair. the u.s. doping agency said -- >> he will be immediately disqualified from all events he participated in from august 1st, 1998, forward to the present and he will be permanently banned from any future competition. it's a powerful reminder to athletes that doping never pays. >> reporter: according to the anti-doping, armstrong stripped of seven tour de france's titles, olympic bronze and all the awards and money he won since 1998. a two-year federal investigation was closed last year without any charges. but months later the anti-doping agency said it had evidence that armstrong used banned substances including e-mails from former teammates lloyd landes, who was stripped of his 2006 tour victory and later admitted to doping. in an interview with ann curry in 2006, she asked armstrong if he had ever used performance enhancing drugs in any of h previous races? >> never. >> not once. >> not once. >> the 40-year-old armstrong, who retired from competing last year, lost the court battle on monday that challenged the u.s. anti-doping agency's authority. in his statement, armstrong said, i know who won those seven tours, my teammates know who won those seven tours, and everyone i competed against knows who won those seven tours. but it may not be over yet. the international cycling union could appeal the ruling. if it does, the case goes to the sport of arbitration for sport in switzerland and that could be months away. >> the saga is not over. >> not by a long short. >> appreciate it. >> we want to bring in allen abrahamson. good morning to you. >> good morning, savannah. >> you make an observation in your column that the hallmark of lance armstrong's career is that he is a fighter. are you surprised he decided to stop fighting? >> i am and i'm not. there is a lot for lance to gain from lance not going through this. usada lined up ten witnesses. this is not a criminal proceeding. if i lined up ten guys that rode with lance, i would say the odds are pretty good in my favor i would gain a favorable verdict. there's a lot for lance to say enough is enough now. >> he's attacking the legitimacy of the process. you know a thing or two about the process. that is a fair criticism? >> there's not much else for him to do right now. he's got to go out crying this process is not fair. but this is process is legitimate. this process has been going on now for 12 years. lance has been treated here like everybody else that has gone through this process. this process is the same exact process big commercial concerns use every day. it's tried and true. the federal court says this process is fine. this process is legitimate. it is what it is. >> do you think the net effect here is that people will just assume he is guilty? that if he didn't want to face this evidence, it must surely be devastating? >> i think people have their own opinions about lance armstrong. he's probably the most polarizing figure on the olympic or international stage. there are true believers one way or the other. i think people are going to hang seng what they think about lance armstrong. no matter what, people are going to think he did or didn't do it. it's just the way it is. >> do you think there's any potential for criminal exposure? we know the department of justice looked into this, decided not to file charges last spring. could there be another day in court somewhere else? >> i think if you were advising lance armstrong, one of the reasons you would tell him not to go through the process would be exactly that issue. if there were ten or more people lined up to testify, one of the things you would be worried about most is the possibility of exposure, criminal or perhaps broad civil liability, if a bunch of people got up in court and said x, y, or z, a bunch of other people with a possibility of bringing charges against him or bringing lawsuits against him would be very, very interested in hearing what those people had to say. of course there would be that interest. >> last word on this. how devastating in this to the cycling community? he did so much for it with the tour de france titles to have them stripped. what is the impact of that? >> lance armstrong is an icon. lance armstrong is a legend. pick the word to use. for this to happen to lance armstrong, cycling needs to take a solid, hard look at theirself and say we are a sport with a serious, serious issue. we've got to start cleaning this sport up and it needs to start right now. >> allen, thank you for your perspective this morning. appreciate it. >> thank you. the other big story we're following, of course, is tropical storm isaac and where that storm is headed. al is outside our new window with the new latest on that. al. >> thanks a lot. we've got a lot going on with isaac. first of all, let's take a look at where isaac is located right now. current we can see on radar, on video, the storm swells are starting to come in. already reports of at least four inches of rain and another six to ten inches possible. check out the radar. you can see we are looking at some pretty strong echos coming through san juan. that's going to be making its way to hispaniola, port-au-prince, cities in haiti. right now 165 miles south of santo domingo, 45-mile-per-hour winds moving west at 15 miles per hour. you can see the tropical storm watches, hurricane watches and tropical storm warnings up for puerto rico, santo domingo, making its way on into cuba. we are expecting to see this system stay over land as a tropical storm cuts across key west around early monday morning as a tropical storm. then it gets out into the gulf. anywhere from new orleans to tallahassee within that cone of uncertainty, as a category one hurricane. the reason for that, the warm gulf waters. you can see those water temperatures, 80, 90 degrees out in the gulf. that's energy for the storm and that's what we're concerned about. so continue to watch it. tampa with the republican national convention is still not out of the woods, even if it's not going to get a direct hit, it's still going to get a lot of rain, matt, we're talking four to eight inches of rain possible. >> al, thanks. that's actually what we're talking about now. preparations are well under way in florida for isaac, including any potential impact on that convention about to be held in tampa. nbc's kerry sanders is there. kerry, what's the latest? >> good morning, matt. school officials in the florida keys have announced classes will be canceled on monday. here in tampa they have already started handing out sandbags to local residents. republican party officials say they have the possibility of postponing this convention if the public safety is at risk. with 50,000 people headed for the republican convention isaac could cause weather related problems even if tampa dodges a direct hit. already this week a thunderstorm with 60-mile-per-hour winds knocked down some of the tents that now crowd the tampa bay times forum that's hosting the republican gathering. party members knew this was the height of hurricane season but went forward with tampa as the host city anyway, in part because the area has not taken a direct hurricane hit for nine decades. the 1921 hurricane was a category three. it left the region devastated. were isaac to follow a similar route to tampa, it would be up to the mayor to call for an evacuation. >> the odds are very small it would happen. we haven't been hit by a hurricane for 90 years. we plan for this every year. that's what we live with in florida. >> reporter: eight weeks ago a storm named debbie caused flooding and major road closures that disrupted the region for three days. and that was just a tropical storm. police have trained for more than a year. they expect tens of thousands of protesters. with 4,000 officers on hand, many on loan from other florida sheriff's offices, the tampa police say they are ready. just one potential problem. if isaac hits hard, some of those loaned officers may have to stay home to help victims in their own communities. now, the tampa police chief says if more security officers are needed, the national guard justice in norway as anders breivik has been convicted of carrying out a massacre that killed 77 people in bombs and gun attacks. breivik was deemed sane and found guilty of premedicated murder. the maximum prison term allowed under norwegian law was 21 years. but breivik received a prison term that allowed authorities to keep him behind bars as long as he is considered dangerous. new details about james holmes, the man accused of opening fire at a colorado movie center last month. when holmes was a student, the school was concerned enough about his behavior to run a background check on him. in june holmes failed an oral exam, he with drew from school later. prosecutors argue the events leading up to the july 20th massacre could help them pinpoint to a motive. a girl reported missing more than two years ago has now been found in illinois. just 15 years old when she disappeared, the girl told police she escaped after become held captive for years and being repeatedly sexually assaulted. police also recovered her young child, who she says was the product of rape by her captor. a 24-year-old manned has been arrested. an ambassador in iraq faces hit-and-run charges after a vehicle collided with his truck. he faces intoxicated driving charges. the lopping time diplomat arrested the 14th and registered blood alcohol twice the legal limit. he was awarded presidential medal of freedom in 2009. wildfires scorching california, more than 60 homes destroyed and threatening more. firefighters on the scene battling the blaze. a bizarre and terrifying video from boston when a woman carrying her 4-year-old child walked straight off the platform falling onto the tracks below. she told transit officials she thought she could board the train across the tracks from her platform. good samaritans jumped in to save the mother and her son. she and her son are fine but she says she's never taking the subway again. now headed to the stock exchange. good morning. >> reporter: the markets on track for the biggest lost all summer as wall street braces for back to school news rush which could face news whether they will stimulate the economy further. greece and at the london olympics, you'd think nothing would make gymnast gabby douglas nervous. she admitted throwing out the ceremonial pitch gave her the jitters. gabby gave a wild throw but won the crowd s.e.a.l. that helped pull off the raid. many, especially in the military community, are not happy about the book. jim miklaszewski is at the pentagon. >> reporter: navy s.e.a.l.s are committed to keeping their secrets secret. it's not surprising this morning many of them feel they have been betrayed. the raid that killed osama bin laden was loudly heralded as the single biggest success in decades. you didn't hear it from the navy s.e.a.l.s who carried out the mission until now. "no easy day." the firsthand bt of the mission that killed osama bin laden was written under a pseudonym, a former member of seal team six who now lives in alaska. according to the publisher, the author gives a blow by blow narrative of the saul. he was one of the first men through the door and watched bin laden take his last breath. u.s. officials tell nbc news many in this s.e.a.l. community are outraged one of their own would break the seal of silence. brandon webb is a navy s.e.a.l. and author. >> i have friend at the command of team s.e.a.l. six definitely feel this was a betrayal, that one of their own got out and immediately, you know, essentially is looked at selling out. >> reporter: it wouldn't be the first big leak of information about the bin laden raid. >> i think it was so famous a raid, so successful, that the temptation to leak on the part of everyone involved, including the political leadership, was infantrymenous. >> reporter: in fact, the white house was accused of collaborating with a famemaker who made a movie about bin laden to give president obama a political boost. the white house denied it. if the book contains any leaks, they could be criminal. books written about secret or classified information must first be reviewed and cleared by the military or appropriate agency. military, pentagon and cia officials tell nbc news, the author did not submit this book for review. but prosecuting such cases can prove difficult. and in this instance, unpopular. >> to drag this person into court, the one person who risked his life to make sure this operation succeeded, that seems to me to be a huge roadblock for the prosecution. >> reporter: in response to the book the top commander of all special operations bill mccraven sent out this open let tore all his forces saying when it comes to talking about special operations, whether the motive is personal, political, or even profit, the best policy is to keep your mouth shut. savannah. >> jfrom the pentagon. a fresco making headlines for all the wrong reasons. duncan is in london with this story. good morning. >> reporter: good morning, matt. this 19th century painting of jesus looking slightly worn hanging on the wall of a small church, needed a little help. instead the fresco got a makeover from an elderly woman that didn't restore it, kind of ruined it. it was described as a romantic, gentle depiction of jesus and had huge sentimental value to the parishioners of this town. now the 100-year-old fresco looks like this, delicate brush strokes gone hidden under thick layers of paint all under the hand of this woman. >> we felt everything was falling down and fixed it. the fresco was looking a little worn after a century hanging in the damp church. jiminez said she had the permission. >> no, of course, everybody in the church could see me doing the painting. what's more upsetting, the artist's family had just donated money for a professional restoration. it was bad enough she painted the tunic of the granddaughter but got worse when she got to the face because now the inting is destroyed. experts are doubtful it could be destroyed. >> famous. might consider leaving it alone and not interfering anymore. >> reporter: known as behold, the man is now known as behold the monkey. there will be a meeting with experts to see if it can be saved. some suggest before painting over she scraped away parts of the original. >> duncan, thank you very much. this is not good. >> i can even look at it. >> but she doesn't be at all upset about it. >> she said, we fixed it. she fixed it. >> here is the before. again, it's got some problems, there's no question. here is the after. >> is nothing sacred? apparently not. maybe they can fix it, unfix the fix. >> somebody needs to say, oops, my bad. still ahead a british newspaper defies the royal family, being the first there to publish the photo of prince harry in las vegas. more on that but first this is "today" on nbc. first, tropical storm isaac still posing some risk to the tampa area, of course the site of next week's republican national convention. >> big concerns. as we know a couple mondays -- months ago, tropical storm deb y caused problems. isaac while not making a direct hit will cause a glancing blow and cause problems.5 mimes south of santo domingo and moving west with 145 miles per hour. you can see on the radar, already heavy rain moving into puerto rico and that will spread into his paniola where there are still hundreds of thousands in tent cities across that island. the path of the storm the way we look at it right now. hurricane watches up for his n panola and tropical storm warnings as you move into cuba, bahamas and kamen islands looking at problems, as well. saturday it's over land, 2:00. still a tropical storm and sunday it makes its way out in the water by early monday morning it's coming across key west as a tropical storm but then it gets out into the warm waters of the gulf. it starts to strengthen and it become esesse ess a category 1 between new orleans and pensacola around 1:00 a.m. as a tropical, or a hurricane. we are not looking for a lot of wind, but a lot of controversial photos of prince harry. the royal family has attempted to keep them out of the british papers. this morning one paper has made the decision to show them. stephanie gosk at buckingham palace with more on this. good morning. >> good morning, matt. people in this country are really scratching their head when the british media decided not to run with these photos, especially when anyone with the internet and five seconds on their hands can get ahold of them. it's been three days since prince harry's wild vacation was exposed. two photos taken in his hotel suite spread as fast as the internet could move them, lightning fast. it took a day for "the sun" to reveal the prince himself. the managing editor, he felt he needed to explain. >> this is about freedom of the press. ludicrous situation where a people can be seen by hundreds of millions of people around the world on the internet but can't be seen in the nation's favorite paper. >> reporter: the palace went to the british press complaints commission to argue that the photos were a violation of prince harry's privacy. the british media listened. not a single major news organization has used the photos. in a statement today "the sun" argues the 27-year-old's behavior in las vegas was not that of a man jealously guarding his privacy. neither were his security detail, the two metropolitan police officers on guard who let cameras or cell phones into the suite. >> this is a vip room with a potential head of state, and you just don't do that. that should have been checked, bagged, secured outside the room. when those people left, they would have gotten all their belongings back. >> reporter: prince harry's friend arthur landon with prince harry says he believes it may have been one of the guests invited into the room, an $8,000 a night suite like this one at the wynn hotel. l landon who says he was not in the suite that night said, "some people have been hinting that it was one of his friends who took the pictures. but that is absolutely not true. none of his friends would do that. we are very careful. he went on to say whoever did sell the pictures to the press were, in his words, despicable. prince harry will resume his military duties next week. the defense says they won't comment whether or not he will be reprimanded. either way i'm sure the prince will be happy that this vacation is [ male announcer ] eggo nutri-grain waffles. you know it's made with 8 grams of whole grain and is a good source of fiber. all they know is it tastes great. eggo nutri-grain waffles. braef back now at 7:46 with a key call made by a major league umpire. you may remember this guy. the call didn't happen on the field. we'll talk to jim joyce and the woman whose life he saved in a moment. but first their story. >> ground ball, right side, cabrera will cut it off. galarraga, he's out. no, he's safe. >> until this week baseball umpire jim joyce was best known for a bad call he made in the ballpark two years ago. one that cost armando gal rarra, a young pitch he for tdodgers a place in history. he apologized and explained himself on "today." >> it was one of those plays that was very close. i had been telling myself that, you know, one more out and this kid has a perfect game. when that play happened, it exploded, and i came up with safe. just a day after the call heard around the world, an unexpected act of forgiveness that stunned everyone. that same pitcher walked out onto the field and shook joyce's hand on the plate. a simple but symbolic gesture that left the veteran umpire in tears. this week another call made by jim joyce is getting attention, one of life and death. when joyce showed up for work monday, he saw jayne powers, a longtime diamondbacks employee collapse. he quickly jumped into action and began performing cpr until an ambulance took her to the hospital. joyce was honored for his actions wednesday night. he's with us along with jayne powers. good morning to both of you. >> good morning, matt. >> good morning. >> jayne, how do you feel? i know you were released from the hospital, i believe, just a day or so ago. how are you doing? >> i'm a little sore but i'm glad i'm sitting here talk you to you. >> i can imagine. you went to work, told some friends at work you weren't feeling too well. do you remember what happened next? >> i remember telling my friend, it was during our preshift meeting before we were going out to the stadium. i told her, i said i wasn't feeling well. i said if i pass out -- that's all i remember. i remember my friend saying, does anybody know cpr. does anybody know cpr. i had a look of stress on my face, obviously, because i was hearing everything but nobody was responding. and then jim was walking down the tunnel right where i was, and all of a sudden he came out of nowhere and he said, i know cpr and he took over from there. >> jim, had you ever performed cpr in an emergency situation before? >> just one time, matt, almost 30 years ago. >> did it kick in as instinct. i know you learned it as a lifeguard when you were 16. did it just kick in? >> yes, it did. it was nothing more than in steenextinct -- instinct. i knew jayne was in trouble. when i checked her vitals, there was no pulse. i knew she was in a lot of trouble at that particular time. literally it was instinct that took over. >> just like we hear all the time, you did cpr to the song staying alive. >> i said it in my head. i don't know if i was saying it out live. i know it was in my head. that's the new cpr, that's the rhythm you do the chest compression to. >> you were rushed to the hospital. do you have any idea how long you did cpr, by the way? >> we kind of figured it was probablyomewhere between four and five, maybe six minutes. >> jayne you got rushed to the hospital. they im planted a pacemaker. was this a heart attack? was this a seizure? what have they told you? >> no. i went into cardiac arrest. i wasn't really a seizure. it was an erratic heartbeat that was malfunctioning in my heart, which caused me to go into cardiac arrest. >> jim, i know you had the chance to go to the hospital and visit with jayne. what was that like for you? >> i think it was pretty emotional for all of us involved. my wife kay was with me and jayne's brother john was there. i said a couple words and then the emotions just took over. i think it was maybe 30 seconds of downtime after that, because we all had to take a couple deep breaths and just catch ourselves. >> jayne, we are so happy you're okay. we're happy jim was walking down that hallway. it's another example. umpires are often the unsung heroes of major league baseball and now for a completely different reason. jim, it's good to have you in the headlines for all the right reasons. >> thank you, matt. there's also one thing i like to convey to everybody out there, cpr can be learned by anybody and it only takes one time. even if you never use it again but that one time, it might be the most important time in somebody's life. >> absolutely well said. jim, thank you so much. jayne, continued recovery to you. >> thank you so much. still ahead, we've got a live concert from train coming up after your local news. morning, everyone. the u.s. anti-doping agency says it will strip seven-time tour de france winner lance armstrong of his titles and ban him from competitive cycling. this after he announced he was ending his fight against the agency saying, quote, enough is enough. the usada claimed armstrong took performance enhancing drugs. he denied those claims. isaac closing in on haiti and the dominican republic where tropical storm warnings in place. isaac expected to dump heavy rains on the region. right now it's on track to hit the gulf coast. a drug resistant super bug is blamed for the deaths of six people at the national institute of health. nbc's tom costello in bethesda, maryland with more. tom, good morning. >> reporter: hey, natalie, good morning to you. hospital infections are all too common. experts say if a super bug can get loose here at the nih here with all they have to bear, it can happen anywhere. it happened here at one of the nation's elite research hospitals outside washington. a drug resistant strain of pneumonia kpc. first showed up last year in a 43-year-old female patient, immune compromised. while she was treated in isolation and released, two months later things got very scary. the super bug began showing up in the bloom stream of other patients. >> during the course of this outbreak at nih, this bacteria developed resistance to all known antibiotics. >> from june to december, a total of 18 patients infected, 11 died, though five died from their underlying diseases. it wasn't until researchers tried something new, 20th century detective work, and decoded the bacteria's dna that they were able to identify it and stop it from spreading. >> we were frightened to death about the organism. we made a full-court press. we closed units, we constructed walls. >> the center for disease control says the kpc strain first showed up in 2001 and has since spread to every state. each year one in 20 patients develops some sort of drug resistant infection in the hospital. nearly 100,000 die. kpc is just one of many bacteria that is now drug resistant. while doctors are desperate for new antibiotics to fight the bacteria, there's nothing in the immediate drug pipeline. >> if we lose the ability to treat these organisms that are so common with the available antibiotics, we go back to the dark ages in terms of people dying of simple wound infections. >> reporter: doctors at the cdc say if you or a loved one have to go to the hospitalf you're admitted, try to limit the time you're in any hospital and insist anyone who comes in the room, especially classified information, the author could be prosecuted. a girl reported missing more than two years ago has now been found in illinois. just 15 years old when she disappeared, the girl told police she escaped after being held captive for years and repeatedly sexually assaulted. they recovered her young child which she says is a product of rape by her captor. a 24-year-old man and his mother were arrested. new details. holmes as a student at university of colorado, the school was concerned enough about his behavior to run a background check on him. in june he failed an oral board exam. he then with drew from the school three days later. prosecutors argue events leading up to the massacre can help pinpoint a motive. wildfires scorching northern california. more than 60 homes have been south, southwest of santo domingo and 50-mile-per-hour winds and moving to the west at 15 miles per hour and already seeing heavy rain making its way into puerto rico and as it does, that rain is starting to see into his p panola. now, this is the path of the storm coming up across and between kingston and on into cuba. saturday morning it's still a tropical storm, makes its way over cuba so that's going to inhibit the growth and the intensification, but then as it makes its way back out into the warmer waters of the gulf, it comes across as a tropical storm. key west makes its way and water temperatures in the mid up toer 80s and that's more intensification and more fuel for that system and comes onshore some time early wednesday probably as a category 1 storm. that's what's going back and we had a great time. >> i think it is sometimes overwhelming for people that may not interact with that large of a group to have everyone there and especially at a wedding where you have -- you're all dressed up and trying to keep everybody in order and keep them all in their right place and the right timing. it's definitely a lot of organized chaos. >> michelle, i've got to ask you, i read this this morning. i'm sure you've heard this before. it is a staggering fact. with 19 kids, have you been pregnant a total of 144 months of your life. that is 12 years. do you ever think about that? >> i do. i really do. i think it will be a sad day for me whenever i know that we're not able to have any more but we'll look forward to grand babies. we're definitely enjoying the ones we've got right now so hopefully we won't have that empty nest syndrome. >> i don't think you're going to have an empty nest for a really, really long time. jim bob, we talked about this last hour. i asked you guys, is it a matter of welcoming a child if it happens to come along or hoping to have more children you guys said we're hoping to have more kids. a lot of people might scratch their heads and say, really, is 19 not enough? >> yes. we really consider each child a blessing from god. each one of our children are glad to be here. aren't you guys? >> yes. >> they love their brothers and sisters. we've heard it said, if you learn to get along with your brothers and sisters, you can learn to get along with anyone. life in a big family is really preparation for life out in the real world. >> you have the two grandkids now. michelle, are you getting that grandma experience, something that feels different than the mothering experience we know you certainly have? >> definitely. it is the most wonderful thing. i've heard people say it's great. now i know what they were talking about. having these grandchildren is such a joy. they are precious. it is such a sweet relationship. >> [ romney ] i'm mitt romney and i approve this message. this is an nbc news special report. and good morning, everyone, i'm matt lauer alongside savannah guthrie. we are following breaking news right here in new york city. a deadly shooting outside of the empire state building. >> it happened just in the last hour or so at the intersection of 34th street and 5th avenue. if you know new york city, you know this is a very popular spot for tourists. >> and a very busy spot at this time of the day. nbc's jeff rossen has made his way to the scene. he joins us now by phone. jeff, what can you tell us? >> reporter: hi, matt, let me set the scene. i'm at the corner of 34th and 5th avenue right in the heart of midtown manhattan right outside the empire state building where of course it was busy when this shooting happened a short time ago. the latest information we have from the nypd is that four people have been shot, and at least one is dead, and that person who is dead, we're told, is the suspect. the gunman here. other details are still coming in, but just to set the scene, the nypd has now shut down the very busy 5th avenue, if you've ever been to new york city, you know how devastating that is for the city. from 42nd all the way down into the 30s. so we're talking about a mile stretch or a half-mile stretch of 5th avenue. police are investigating the scene. there are witnesses who have been pushed back. and witnesses are reporting that the shooting happened basically out of nowhere. police are still trying to figure out what this person's motive was. but once again, to repeat, four people shot according to the nypd. at least one of them dead. and again, that number could rise. depending on the conditions. and that person who was killed is the gunman, we're told. >> and jeff, let me add a little bit because according to jonathan dienst who is a reporter for wnbc and who does work for us here at the "today" show and nbc news, we're hearing that the shooter was, in fact, an employee of the empire state building or at the empire state building. he's being described as a disgruntled employee, and yes, we are hearing that, in fact, he is now dead. i understand there are two, jeff, separate scenes there. is one where the victims of this shooting were hit, and is the other where the gunman was apparently apprehended and then later shot? >> reporter: i actually see clusters of in several different locations, at least two of them, matt, and that would make sense. oftentimes in these situations bullets fly, especially when they are flying through streets in different locations. so what officers and investigators are going to try to do now is try to immediately find those bullet casings to figure out how many shots were fired, where people were hit. so it would not surprise me. and especially from what you're reporting and from what i am seeing, that there are multiple scenes here. but yes, there are clusters of officers in several locations up and down fifth avenue. >> and we don't know whether the shooter in this situation walked out onto the street and targeted individuals for a reason or just began shooting indiscriminately. but he could not have picked a busier place at this time of the morning in new york city. any busier than the area around 34th street and 5th avenue, the empire state building. jeff, i know you'll stay on the scene and learn as much as you can. thanks very much. >> reporter: thanks, matt. >> we want to talk to james boulden now. he was walking in the area when the shooting began. he's on the phone with us. mr. boulden, thank you for being with us. >> thank you. >> tell us what you saw this morning. >> well, i was walking, like, i got off the train on 33rd street, 2 train, and i was walking on 33rd. by the empire state building. i got by the loading dock. i actually work in the building. and i heard three or four shots and just a whole bunch of people running towards me. so i'm on the phone with my wife. and i'm telling her, i don't know what's going on. a whole bunch of people running towards me. and i just happened to run across the street. and i see somebody laid down dead on the floor. >> the person that you saw, and this may be a hard question to answer, do you believe that was the suspect, or do you think it was somebody who was shot by the suspect? >> actually, it's being said that that's the person that was shot by the suspect. and i took, like, a couple of pictures of it. >> where exactly did it happen? we're trying to get a sense of where the shooting actually took place. do you think you know? >> it took place on 33rd street between 5th and 6th avenue. >> you said you saw a lot of people running away from the scene. i take it it was very, very crowded at that hour. >> yeah, very crowded. everybody was basically going to work. at this time of the hour, it's always, like, heavy, heavy traffic on the sidewalks. >> did you see anyone wounded? >> yes. it was the guy that was on the floor. he was bleeding, like, from his neck area. >> and any other victims that you saw? >> one more guy was dead on 5th avenue between 33rd and 34th. >> how quickly did police arrive? i imagine you stayed for a little bit? >> well, i'm still here. because i work in the building. the police came fairly quick. they actually were on the scene fairly fast. >> have you talked to anybody that you work with? we have a report from our local reporter, jonathan dienst, that this may have been a disgruntled employee at the building. have you heard anything like that? >> i haven't heard anything like that. i haven't -- like everybody's just in shock. >> have you been talking to anybody else on the street there with you, people who watched this and saw this? have they described what they saw? >> just a few people. like, it was like a few. it was like a little group of people that was actually on scene. and everybody was just taking pictures and filming, like, the situation. >> mr. boulden, thank you very much. we'll ask you to stand by. if you're just joining us, this is a special report because there's been a shooting this morning outside the empire state building or near the empire state building in the heart of new york city. it's the area of about 5th avenue and 34th or 33rd street. there are varying reports as to the number of people who have been wounded in this shooting. anywhere from two, we've heard as many as eight or ten. however, one thing that seems to be confirmed at this point is that the person who did the shooting was, in fact, shot and killed. so at the moment, we can confirm, according to the fire department of new york, that one person is dead. we do not have any numbers beyond that. you can see that the police have closed down the area on 5th avenue and 33rd and 34th street. obviously, trying to piece this together. we've heard reports that there are personal belongings in the street in several different locations. and that's pretty much what we have at this point. we've been told that the shooter may have been a disgruntled employee of or at the empire state building. >> as we mentioned, this is a developing story. we have widely varying numbers. but the latest we have from the fire department of new york was that eight people were being evaluated. that's their term. the new york police department confirmed for us that indeed the suspect is dead. but that four people have been shot. so obviously, we continue to watch this unfold. >> and you can imagine the chaos that this must have created at just after 9:00 local time in new york. not only were the streets immediately closed down by the responding police, but we work just about ten blocks or so, 15 blocks from that area. i could hear helicopters here hovering around the area, circling. obviously, they were trying to make sure that no one else was fleeing from that area. but at the moment, it appears that they do have the person responsible for this, and he has been killed. again, no word on the condition of any other victims. but we're going to be trying to find out more about that. >> all right. we want to get back to jeff rossen who's actually at that scene. jeff, do you have any more information for us? >> reporter: yeah. police are still obviously fanned out and more are showing up by the carload. you can imagine, and matt just alluded to this, what this is doing to new york city traffic. i mean, this has brought the city to a standstill here in midtown. even just to get here, the street is closed at least seven blocks in both directions. we couldn't get down. we had to run down the street. there are literally hundreds of people standing behind police barricades just trying to get a look and, you know, crosstown traffic is an absolute mess at this point. and there's no traffic heading southbound on fifth avenue which, as you mentioned, is an incredibly important thoroughfare in the city at this time of day when this shooting happened. there are detectives showing up who i've worked with in the past who still don't know anything. there's a bit of chaos at the scene, controlled chaos, just trying to figure out what the motive could have been, exactly where everything happened. that's why we mentioned there are clusters of officers at different locations trying to figure out okay, where did the bullets land? where were people hit? trying to put this together. and that also helps them treat the victims as well. >> jeff, we had mr. boulden on talking to us by phone just a couple of minutes ago. he was an eyewitness to this. and one of the things he said caught my attention. he said he walked around a corner and saw someone lying on the floor bleeding from the neck area. i notice he didn't say on the street. do you know if the shooting began inside the building and then worked its way out to the street?
