A Big Development with gay marriage in virginia. The commonwealths attorney general is calling a ruling on samesex marriage a victory for equality. A threejudge panel ruled the states ban on samesex marriage unconstitutional. Virginia will not start issuing marriage licenses to samesex couples just yet. Opponents have 21 days to file an appeal. One of the plaintiffs who filed the original lawsuit said this is a major step forward for her and her family. This is just a day to celebrate. We have just when i think about this we joined this case in september. Here we are not even a year later and this decision could go to the Supreme Court just so fast. Virginia attorney general says he believes ultimately the issue will be decided by the Supreme Court. A federal Circuit Court made a similar ruling last week in oklahoma. To the crisis at the border. It is hitting close to home. Earlier today clergy leaders in maryland met with martin omalley. Between january and early july more than 2,200 unaccompanied children arrived in maryland. Many are staying with extended family or foster care. The administration is proposing several sites for possible temporary housing facilities and that includes Montgomery County. School officials in Montgomery County are telling news 4 they have had more than 100 unaccompanied minors in the system last school year. Has filed a motion to stay a ruling that would allow just about anyone to openly carry a gun in the district. Over the weekend the federal judge declared the ban on hand guns in public is unconstitutional. To the trial of the decade in virginia politics. Jury selection is underway as prosecutors try to prove corruption by Bob Mcdonnell and his wife. Right now a Recovery Team is searching for a man who fell into a reservoir just south of the pennsylvania line. They have identified him and no word on what the man was doing near the dam. Talk about that and whether people can get married in the meantime. It probably will be appealed. One of the odd things about this is the state of virginia declined to defend the law so the fight has been carried on by two county clerks including the clerk of court of Prince William county. They said they likely will appeal to the fourth circuit. Until they make that decision as a legal matter samesex marriage is not legal in virginia. However, we could see the same thing happen that happened in colorado where the Appeals Court said this is the law and county clerks decide to issue marriage licenses anyway. The state probably wouldnt stop them but as a matter of what the law is right now the courts ruling doesnt go into effect until we know whether there is going to be an appeal or not. If they decide not to appeal it starts a clock. The earliest people can get married legally in virginia is in another three weeks. If county clerks want to try i dont know who would stop them. They are not being encouraged to do that by the people behind the lawsuits. I think what is interesting is this is the second federal Appeals Court to reach the same conclusion. We had the court in denver uphold rulings saying bans were unconstitutional in utah and oklahoma. So what do we make of this . A trend or is it absolutely going to go up to the Supreme Court at this point . It is a bull dozing trend right now. Every federal court that has looked at this question in the past year since the Supreme Court struck down part of the defense of marriage law has reached the same conclusion that bans on samesex marriage are unconstitutional. Normally the surest bet is when there is a split among federal courts when some parts of the country have one set of laws and other sets another the Supreme Court wants to harmonize them. If they are all coming up the same it is not a certainty the Supreme Court would jump into this although some involved think it might. Interesting. Thanks so much. The National Weather service confirmed a tornado touched down in revere about 15 minutes outside the city and uprooted trees and blew roofs of off of several businesses and homes. There are no reports of serious injuries. We are getting a look at what it was like when a tornado touched down in virginia last thursday morning. The first case was detected in africa nearly four years ago. Until recently most contained to rural areas. Now the most recent outbreak spread to four african countries. More than 1,000 people have been infected since march. Symptoms of the ebola virus are similar to the flu, high fever, headaches, vomiting, diarrhea. Some patients lose the ability to form blood clots so they end up hemorrhaging blood. The death rate is between 60 and 90 . That means that some people do survive the virus but it is unclear why, who survives and who doesnt. One of the biggest questions is how contagious is the ebola virus. We know it is only spread through bodily fluids, blood, urine and sweat. You can only catch it from a person actively if you are in close contact with an infected victim there is a high risk of getting sick. Within the past 15 minutes two Montgomery County detectives arrived here in the parking lot about to enter the crime scene, that townhouse behind me. They believe they know what led to this murder, a domestic dispute turned deadly. Police were led to the murder scene at this gaithersburg townhouse by a call from a parishioner at the church the couple attends. Detectives found the body of 47yearold june carly. Police tell us her husband, 51yearold cola beal called the parishioner saying he believed he had killed his wife. The parishioner gave police beals cell phone number. They called beal who told police he was in norfolk, virginia. Norfolk police picked him up. Took him into custody without incident. We were able to get a search warrant for the home and investigate the scene fully. Reporter beal is awaiting extradition to Montgomery County where he could be charged with first degree murder. Neighbors who live along hall mark court did not know the beals well. Tony hanford has lived here 20 years. I was a bit shocked and stunned and sad. Its a sad situation. Reporter records indicate police had been called to the beals townhouse before to break up an argument between them. The information i was provided and the records we had is that one time last year we were called to that address for allegation of domestic violence. Reporter police tell me the officers at that time spoke with the couple and resolved the dispute. No written report was filed. However, this sunday, yesterday, 10 30 a. M. They were called back here and discovered the dead body. We reached out and i called the church the couple attended. I was told they know nothing about this and declined my request for an interview. Developing right now in new york city an accused child molester is dead after getting into a shootout with law enforcement. It happened this afternoon in Greenwich Village as police tried to arrest the suspect who was wanted for the Sexual Assault of a child in california. Two u. S. According to the Court Documents the victim was heading back here to her hotel after celebrating her birthday. It was during that ride back here that she says she was sexually assaulted after she passed out. The 25yearold new york woman had gone to the lux lounge on new york avenue in northwest to celebrate her birthday with friends, but that celebration turned into the worst night of her life. She says the uber driver hired to take her back to her hotel on rhode island avenue on northwest sexually assaulted her. The woman told detectives she had several drinks here to celebrate her birthday. According to these Court Documents she says she doesnt remember much and that some things are a blur but she definitely remembers she was sexually assaulted. She says she passed out and when she woke up the driver was rubbing her breasts. She fell back asleep and woke up when she heard the doors lock. The cab was stopped and the driver once again was touching her and pulled down her underwear. The victim says the driver refused to let her out of his car. She sent two Text Messages to a friend who had arranged the cab ride. When the friend called her phone she says it startled the driver and he agreed to take her to the hotel. That driver reshad chakari charged with Second Degree sex abuse. He told police he had been driving his camry for about a year and says the woman was super drunk and when he dropped her off he says she was happy, appreciative and thanked him. He denied touching her inappropriately and said she must be making a mistake. We spoke to women who are concerned. I take uber more often because it is easier and convenient and love it. I never thought about the risk i guess and i should be more aware of it. Reporter uber released a statement that says in part it is our policy to immediately suspend a drivers account following any serious allegations which we have done. And then it actually sounded like there was debris falling. I mean, it was the craziest thing i had heard. Reporter thompson went straight to the beach where life guards and firefighters were treating more than a dozen patients. They had people with oxygen masks on. The National Weather service says over the past three decades an average of 51 people have died each year from Lightning Strikes. A large number of the victims have been male. The court ruled the states ban on samesex marriage is unconstitutional. In the decision denying samesex couples the choice prohibits them from participating fully in our society.
