A transgender woman claims dc correction officers deliberately placed her in a cell with he sexually assaulted her. Her efforts to get justice went nowhere for nearly four years. But now a big development. News4s Jackie Bensen is outside the dc federal courthouse with the exclusive story. Jackie . Reporter doreen, this new ruling is from a federal judge, and it allows the victim to sue the district and two Corrections Officers for placing her in a cell with an inmate who had previously been investigated for because every day i think about, i was traumatized. I was raped. I cant i cant deal with it. Reporter those are the words of the victim, known only as jane doe, when she spoke to news4 in 2013, shortly after attorneys began representing her in a lawsuit that faced many that correction officers actions on the job are protected by immunity. Two of the guards were prevented from going to trial on constitutional claims that they violated the eighth amendment. Reporter in july of 2012, jane doe was serving time in the dc jail for a probation violation. Court documents noted her file transgender. Ks means keep separate. She was initially housed alone in a protective custody cell. The lawsuit alleges on the night of july 17th, two Corrections Officers placed another inmate in her cell, a man who had a known history of violence in the dc jails. The guards knew what they were doing. This wasnt just an accident. Reporter the lawsuit claims that a review of security footage from that night during which jane doe says she was threatened with a knife and raped twice cell checks, standard procedure at the jail, were not conducted. Nobody came to check up on me, no nothing. Reporter a spokesperson for the Dc Department of corrections says the agency does not comment on pending lawsuits. The trial is scheduled for december.
