Amy purdy will be here but right to the latest on robert durst. Police in los angeles filing murder charges against the millionaire heir last night. He could now face the Death Penalty for killing his best friend susan berman. His lawyer vowing to fight those charges and could be in the middle of an extradition battle facing new charges in new orleans. Matt gutman is there. Good morning, matt. Whats so stunning for the man in the jail complex behind me is that after decades of suspicion those charges, the capital murder charge out of los angeles and the weapons charges here came raining down on robert durst in the space of just a couple of hours. This morning, robert durst facing the possibility of the Death Penalty charged with first degree capital murder overnight for allegedly executing his friend and confidante susan berman. The lapd telling abc news an anonymous viewer of hbos documentary series the jinx calling in the fateful tip. The indictment alleging durst was lying in wait for berman and that she was killed specifically because she was a witness to a crime. Authorities have long suspected berman may have had information about the 1982 disappearance of dursts first wife kathy. The crime for which durst has long been suspected but never charged. Then barely an hour after those charges, the Orleans Parish d. A. Slapping him with weapons charges arresting him at this hotel. He checked in with a fake i. D. , police say, packing a. 38 special and small amount of marijuana. Durst who was also acquitted in the death of his neighbor in 2003 waived his right to extradition in this new orleans courtroom monday. The millionaire shackled hands and feet in an orange jumpsuit came to this spot and looked at the judge. The judge asked him questions. He answered yes or yes, your honor. Judge Jeanine Pirro tried to prosecute him for the disappearance of his wife in 1982. He lies every time he opens his mouth. Hes gotten away with it because of money. Hes not going to get away with it this time. Reporter his lawyers see it differently telling reporters. He didnt kill susan berman. Hes ready to end the rumor and speculation. Reporter as for the series itself police not confirming whether revelations like that apparent confession will be used as evidence. There it is. Youre caught. What the hell did i do . Some questions about the whether the admissibility of that tape or not but one of the interesting things we learned in one report is that the l. A. Prosecutor saying they didnt even rely on the tape in order to bring the charges. We talked about this before. The letter that when you compare a letter that was sent to the Police Department where it was clear the person knew susan berman was dead and you compare that to the handwriting of robert durst. Dead match. Almost identical with the same misspellings et cetera. Thats got to be the key piece of evidence that changed everything in connection with this investigation. When the police say, this had nothing to do with the documentary. Let them say the timing of the arrest wasnt typed to coincide with the time of the last episode. But to suggest that it had nothing to do with the documentary is of course absurd. Not credible at all. The reason they were able to get this incredibly important piece of evidence is because of this documentary. The key phrase in the criminal complaint susan berman was killed because she was a witness to a crime. The police and prosecutors trying to establish motive. Again, lets be clear. Witness to a crime doesnt mean she actually witnessed the crime. What theyre saying is that she was a witness they wanted to speak to who had information about the crime. Remember the police reopened the investigation in 2000. Only months before susan berman gets killed. The police decide they want to talk to susan berman. Weeks before susan berman goes to the police she gets killed. Okay dan abrams, thanks very much. Now to that scare in the air. The pilots on a flight from washington to denver declaring an emergency after an unruly passenger caused a dustisturbance shortly after takeoff. We turn to that high drama at the Boston Marathon bombing trial where police delivered extraordinary testimony about their harrowing shootout with the tsarnaev brothers. Abcs tom llamas has the latest. Reporter monday in court jurors learning how this once peaceful street in watertown, massachusetts, turned into a combat zone. [ gunfire [. We have reports that they have explosives here at the scene. Reporter police locating the tsarnaev brothers in this boston suburb four days after the bombings at the marathon. A tracking system equipped in the Mercedes Tamerlan had just carjacked less than an hour earlier led police to their location. Prosecutors say the brothers squared off against police using these pipe bombs. This photo shows tamerlan and dzhokhar crouching behind the stolen suv. Police say the two were steadily shooting and hurling bombs at several officers for about eight minutes. One of those officers involved in the battle testifying that tamerlan the older of the two brothers fired first. One watertown resident telling the court he saw dzhokhar light a fuse and hurl a backpack at police. That backpack kerning out to be a Pressure Cooker bomb. The whole house shook, shook like it was an earthquake. Reporter the battle happening right in front of lorettas home. She may be called in to testify. He hurt so many people and so many families that have been destroyed. Reporter one eyewitness telling the jury when police took down tamerlan he saw dzhokhar jump into the suv, speeding towards his brother. But dzhokhar ends up running over him. Tamerlan would die within the hour but dzhokhar escaped the standoff until he was tracked down inside this boat 16 hours later. State police tells me that theres definitely move many in the boat. Reporter the jurors briefly leaving court on monday to get an upclose look at that boat stored offsite with dzhokhar present. Court ending monday with this image, dzhokhar no longer on the run, instead surrendering with his hands up. And we want to point out, tamerlan had been shot several times when dzhokhar ran him over. This morning jurors are going to hear from the owner of that boat who went to go check on it once the watertown lockdown had been lifted and pulled back the cover, looked inside and saw one of the Boston Marathon many boers hiding there. Nurse edie sax found face down in her pool at her home. The 50yearold still wearing her scrubs and lab coat. Edie was a superb swimmer. Reporter her husband steve a radiologist feared shed had a heart attack and fell in. That was april of last year. But this morning, police and saxs family say her drowning was no accident in i would implore anyone who had any information regarding my mothers murder to come forward and please help us. Reporter what changed . A lot, Houston Police say, once they took a closer look. First there were signs on saxs body that she had been hit in the face and held down in the water. Whats more neighbors say they spotted two unidentified men near her house at the time of the crime. Detectives dont know who did it but they think they know why. We will turn our attention now to a Maryland University where five female lacrosse players have been suspended for allegedly sending threatening messages about freshmen members of that team even coaches. Abcs linsey davis is here with this disturbing story. It is. Good morning to you. These texts are vicious and graphic, some too explicit for morning television. In a group text chat titled sophomores rule they wrote threats about their freshmen teammates because they were bitterly jealously allegedly. The lefthanded shot a score. Reporter instead of fierce competition on the field. A shot and a score. Reporter this morning its allegations of hateful competition off the field against their own teammates that has several lacrosse players sidelined. Five players on the university of maryland Baltimore County womens team are now suspended after a series of threatening texts emerged. Texts they allegedly wrote about their freshmen teammates. There were extreme threats of violence. It was ugly. Reporter 16 pages of screen shots of the texts were anonymously sent to the baltimore post examiner. In them the students allegedly posted messes like can we just kill them and kill the freshman. One writing during practice seeds be apriling for her teammates shins and head. A player who saw the texts turned them over to coaches who then alerted school authorities. The five girls accused of posting the messages including three sophomores one junior and a senior were all banned from playing in last wednesday nights game but were allowed on the sidelines to cheer. The allegations from the sources i received were that they cheered when several of the freshmen players either fumbled or were injured. Reporter according to the baltimore post examiner the texts may have been a reaction to reduced playing time in favor of the younger recruiting class. A pr firm issuing this statement on behalf of four of the five suspended girls. Words cannot express our sense of regret and disappointment in ourselves. The university telling abc news that the umbc Community Highly values civility and respect and we take this matter very seriously. It isnt who umbc is at all and certainly is disappointing. Reporter the school is still investigating but in the meantime the team is practicing without any contact drills. The university Officials Say this is an ongoing situation and dont have any specific time frame for how long the suspension will last. They hope to do a quick but thorough investigation. Some of the kids parents saying they dont feel this is harsh enough and feel these girls need to be expelled but the school say had gone is certainly enough. Thank goodness someone saw that.
