New Jersey Governor Chris Christie is shutting down road projects across the garden state. That after the gas tax failed to pass yesterday. The states current Transportation Trust fund lost authority to borrow money today. Christie backed the plan to hike the gas tax by 23 cents per gallon to fund road projects. That plan patched the assembly but remains stalled in the senate. Road work not considered essential will cease tomorrow night. We began to tell you this story last flight at 11 00 a problem with Philadelphia Police breathalyzer machines could be tainting hundreds of drunk driving cases in the city and tonight we know much more about the situation. Here is action News Reporter gray hall. Reporter Philadelphia Police are responding after they were alerted that hundreds of dui cases could be flawed because of an error with breathalyzer machines. Make no mistake about it it was an oversight on the part of the individual that was testing so i dont want to skate over that. It was human error. Reporter police say its not that the machines were not reading properly but say that someone used an expired solution when testing the devices that liquid solution is whats used to determine the accuracy of blood alcohol readings. If its outdated it could produce inaccurate results. That can virtually zero cases affected because the machine was still calibrating properly. The only thing that it gives attorneys in court a technicality to argue. Reporter the mistake will impact cases from january 17th to june 29th. Attorney joe kelly discovered the error and believes it could impact 500 to about 1,000 cases. He says the breath test results in question should be tossed out. Im not a physicist but i think that would affect if you use an expired solution the machine would be invalid because that violates regulations. Regulations say you have to have a valued solution. Reporter kelly says despite the mistake a person could still be convicted but it could mean a downgraded penalty or less jail time. Police say they corrected the problem the same day they found out about it and will take measures to make sure this does not happen again. By no means is this going to automatically say that every case that was generated during that time frame is not is bad because again, the machine itself is still accurately reading, calculating. Reporter the district attorneys officers did release a statement and said right now its reviewing hundreds of cases and will take appropriate action if needed once those cases are reviewed. Reporting in center city, gray hall, channel6 action news. Pennsylvania Governor Tom Wolf has said a special election to fill the congressional seat vacated by convicted felon chaka fattah. It will take place juice november 8 the same day as the general election. That saves voters an extra trip to the polls and the state wont have to spend extra money. Because its a special election its winner will take officers immediately instead of waiting to be torn many sworn in with the new congress in january. New at 6 oclock tonight these are tough times for Atlantic City. But for one historic Musical Instrument it is a time of rebirth. New jersey correspondent Nora Muchanic has that story. Reporter organist steven ball is at the keys of the legendary pipe organ in Atlantic Citys boardwalk hall. After years of neglect the organ is being lovingly restored by a small army of volunteers who have now repaired the left side of the massive instrument the second of eight chambers. For us its tremendously exciting. Its the first fruits of this 10 year, 16 Million Campaign to restore this thing. It hasnt really played fully since 1944. This organ is a national and even an International Treasure its the largest pipe organ in the world. Reporter starting in 1929 it took three years to build the great organ which was designed to accompany silent motion pictures. It is able to make sound effects and create all the sounds of an orchestra and playing it is a workout. Its one of the wonders of the world. Its the greatest engineering achievement in the history of organ building. Reporter the organ has more than 33,000 pipes some six and a half stories tall. You cant see them because theyre built in the walls but you can feel it when the organ is playing. Its amazing. I dont know what else to say. Its amazing the sound is incredible. Reporter members of the National Organ Historical Society are in awe. A miracle. [laughter] because i never thought id be alive and hear it. But to hear it is just a revelation.
