The south jersey man accused of killing his own threeyearold son was back in court today as his attorneys tried to get a grand jury indictment thrown out. Reporter the attorney filed these motions aimed at getting the grand jury indictment thrown out and his client released from jail. Frankly something that rarely happens. He argued that the medical examiners investigation was flawed from the start. With his client david creato sitting beside him the attorney argued that the medical examiner dr. Gerald fygan misled the grand jury by implying he had gone to the crime scene the day the boy was found dead when instead it was a few days later when which he said mom priced the investigation going forward. Hes a disgrace. He has a horrific past as a medical examiner and now here he is doing frankly a terrible job that he has to cover by going to this grand jury and at best misleading them. Reporter david creato reported his son missing on the morning of october 13th 2015. Few hours later brendan was found partially submerged in a creek threequarters of a mile from his fathers app. Hits socks were clean and authorities said someone placed brendan in the water. Today the prosecutor argued this was a comprehensive grand jury investigation and the me did nothing wrong. In other news a bucks county couple is behind bars tonight accused of abusing their own infant twins. Tullytown Police Detectives say michael and alyssa shales caused significant injuries to their two Young Children less than four months old. It was back in late march when mrs. Shales reportedly called 911 to say her child was showingy choking. The baby was rushed to the hospital for treatment but on examination police say the child had multiple broken bones in the process of healing. The babys sibling was also found with similar injuries. Both were reportedly malnourished as well. Theyre facing several felony counts of abuse. Philadelphia police are looking for the gun plan who shot a 17yearold young man 10 times. He was the victim of an apparent drive by at moore and hollywood streets in south philadelphia about midnight. Police rushed the child to the hospital in critical condition. And the search continues for clues about what sparked an Early Morning fire here in center city. Firefighters knocked down the flames on a back deck in the 200 block of south tenth street. No injuries reported. A man was rescued from a pickup truck that crashed into a creek in delaware county. From chopper6 you could see the truck partially submerged in an extension of the darby creek near the 500 block of Stevens Drive in tinicum township. Police say the driver lost control of his vehicle on i95 and it went into the Shallow Water near exit 10. The driver was taken to Crozer Medical Center with nonlifethreatening injuries. Lawmakers in new jersey are debating whether to raise the state minimum wage to 15 an hour. The democrat led Senate Labor Committee started discussing the legislation today. The wage rate is currently 8. 38 an hour which works out to a salary of 17,400 a year for full time. New jersey voted back in 2013 to correlate the minimum wage with the rate of inflation. And since then has remained low, wages havent risen much. Governor Christies Office called the democrats bill a job killing measure that could destroy the states economy. Dui arrests are on the rise in pennsylvania according to state police and police have noticed a troubling shift of the 18,801dui arrests in 2015, one out of four were for drivers under the influence of drugs. There are so many things that you have to Pay Attention to when youre out there. Theres the puzzle of course but then also where you landed on the wheel and like the used letter board and the scoreboard and theres all these things to keep checking. The outdoors at any time yesterday with those winds it made it feel closer to the upper 40s at times throughout the day and again trying to rebound a little bit here this afternoon. But may so far in philadelphia as you know has been really chilly. Weve had six days with High Temperatures only in the 50s for the first half of the month. We havent had that many days that were stuck in the 50s for highs since 1978 and at this point temperatures are averaging close to 4 degrees below normal and more than likely may will go down as below normal overall for the month and if that happens it will be the first time in 13 consecutive months where temperatures have been above normal. 65 in trenton right now, 66 allentown and reading, 66 in wilmington. And even at the shore temperatures in the mid 60s because of that wind coming in out of the northwesterly direction. As we look at satellite and radar clouds in northern new england. In fact northern maine they have three to 6 inches of snow covered the ground up there. For us, clear skies today but notice clouds already marching in from the ohio to tennessee valley. A few showers in our Northern Kentucky so yes, we do get wet as we go into your tuesday. But for tonight, its clear early, some clouds building later on, 46 to 51 for the overnight low so a good 10 degrees warmer than it was last night. The front comes in from the north. At the same time a Second System comes in from the tennessee valley. The two will semi merge here so he showers move in in the morning right through the afternoon about a quarter to a half an inch of rain expected with a High Temperature a little cooler at 62 and then this low will be very slow to drift to our south on wednesday. We start west on wednesday morning with some early showers and then as that continues to move to the east, a high of 66 will dry out in the afternoon with a little sun on wednesday as High Pressure comes in from the great lakes and the Northern Plains and this is a pretty strong high so as that builds in for the end of the of week its looking real nice here thursday and friday. It is monday night and the big story on action news tonight is breaking news about the crash of amtrak 188. A crash that killed eight people a year ago and injured more than 200 in the Port Richmond section of philadelphia. The ntsb will issue its official report tomorrow. But we now know that the report will say that engineer Brandon Bostian lost what is being called situational awareness. The report will say that bostian was distracted by radio traffic concerning a rock falling incident involving a septa train. As for speeding up to 106 miles an hour approaching that curve, the report says bostian may have thought he had already passed the curve. The ntsb is releasing the report tomorrow in washington and action news will be there. In federal court in philadelphia today, testimony has begun in the political corruption trial of congressman chaka fattah. Action News Reporter vernon odom is live outside the courthouse.
