It wasnt until four years after gray died that a lawsuit was filed seeking damages on behalf of his wife and daughter who wasnt born until after his death. Its the timing thats an issue here. Because the statute of limitations says these types of wrongful death suits must be filed within two years. Tonight his wifes legal team tried to convince the Iowa Supreme Court that those rules should be changed. Musician paul grays wife says even though the couples daughter wasnt born before her dad died. His loss will always be with her. 2 57 52 this child has life, born and lives everyday without her father, theres no father to be with her for birthdays and christmas. His wifes legal team is fighting for damages on behalf of both of them. But because that wrongful death suit was filed two years too late. It was dimissed in district court. Thats whats brought the case here to the Iowa Supreme Court. Where the justices will be deciding if the rulebook needs to be rewritten on the stautue of limitations for wrongful deaths invovling a doctor. 3 26 01 its been on the books for 20 years, to change it now, is that its not practical for most victims to start an investigation right after a death. 3 32 12 everytime someone dies to say look at the medical records .
