A brooklyn jury is deciding the fate of an nypd officer accused of accidentally shooting an unarmed man in a brooklyn stairwell. Steve lisa evers is live outside the courthouse where both sides made closing arguments. Reporter ive been in the courtroom all day. The judge ordered the jury to consider the facts and only the facts in this high profile case side. Now whether officer peter liang is found guilty or not guilty could very well depend on what the jury thinks about the gun. Nypd officer peter liang walked into the courtroom with a pba escort showing little emotion. Hes charged with seconddegree manslaughter for the november 1994 shooting of akai gurley in houses. Gurley was struck in the chest by a bullet fired by liang that ricochetted off a wall. His defense attorney argued in closing statements it was an accidental discharge. What peter says is i had an accidental discharge. Im fine. Now, that doesnt make any sense whatsoever. Right . On. His first reaction walking back discharge. Discharge. The gun fired. It fired. Something to that effect. I fire saying i fired a shot. Before they left the hallway when they were talking about calling the sergeant, he said im fired. Reporter prosecutors insisted that guns do not accidentally go off. In a dramatic courtroom demonstration showed what it takes to pull the trigger. The ada says pressure must be applied to the trigger. Peter liang was on the 58 floor of the darkened 8th floor of the darkened stairwell with a gun and a flashlight. He heard a noise. Instead of pointing his flashlight at that noise, he pointed his gun at it and he pulled the trigger. And he shot akai gurley. The bullet hit off the wall near where he stood. It ripped through his heart and ended in his liver. Thats why were here today. Reporter the officer took the step of testifying on his own behalf and was the defenses only witness. To have his fun gun out and the death is a tragedy but not a crime. What happened here is a tragedy, a terrible tragedy, but its not a crime. Reporter prosecutors counter that officer liang was trained and had a flashlight and after he fired the bullet, delayed checking on gurley as he lay dying. In his testimony, he says he panicked and did not give gurley cpr, check for a pulse or breathing or call for an ambulance. The jury has five charges to consider. They were actually given a verdict sheet that has not guilty or guilty for each of the five charges. The most serious one of seconddegree manslaughter. If officer liang is found guilty, he could be looking at up to 15 years behind bars. Live in downtown brooklyn, im lisa evers, fox 5 news. Back to you. Steve thanks. Dari thank you. Steve if you get a concussion, a study explains why rest is so critical to recovery. This is where were looking at thats the hard part, keeping kids down once theyve been hurt. Dari this is confusing. I have to interrupt quickly. I thought if you think possibly that someone hits their head and might have a concussion, you dont want them to go to sleep or rest. Can you make the differentiation. After someone is diagnosed with concussion, as a Sports Medicine doctor, we institute a graduated return to play protocol. What that means is they have brain rest. Theyre not having screen time or texting or watching tv. That allows the brain to rest. What weont want them is for them to go to sleep if there are signs of a brain bleed. Thats the difference there. This study, its really backing up what weve been doing for a long time, which is keeping somebody out a minimum of a week after a concussion so theyre able to rest and their brain is able to heal and they dont get multiple hits backtoback. Steve right. Right. Times worse. Its tough keeping kids from the field. Its important to do. Doctor, we appreciate it. Dari thank you. Steve all right, nick. More snow on the way.
