Toxicology results from eve tarmeys autopsy showed it was actually fentanyl that killed her, a pain medication 30 times more powerful than heroin. Around 3 30 in the morning Court Documents say ross saw the teen slumped over in bed and knew she was dead, but instead of calling 911 the paperwork says ross spent an hour and a half cleaning up the motel room and disposing needles in a dumpster. Tom attorneys for Nathaniel Kibby have a long list of requests for the judge in his kidnapping and Sexual Assault case. Kibby facing 205 charges related to the 2013 disappearance of a young girl in conway. The defense has filed a total of 16 motions related to evidence, testimony, even the lead prosecutor. Wmurs Kristen Carosa joins us with their arguments and how prosecutors are responding. Reporter tom, eleven of the 16 have been released as well as eight objections or responses from the state. They will be taken up next week at three scheduled hearings in laconia. The defense in this case is asking the judge to recuse associate attorney general young, lead counsel for prosecuting Nathaniel Kibbys case citing that shes a possible conflict of interest. The defense says kibby threatened young during a recorded phone call to another person while at the Carroll County house of corrections. The state says the matter was referred to the Cheshire CountyAttorneys Office and the attorney general had no involvement. It also argues, quote, the state is unaware of even a single case that supports the conclusion that a threat directed by a defendant to a prosecutor warrants a disqualification of that prosecutor from an unrelated criminal matter involving the same defendant. The defense is also asking for a private review of written evidence they say they havent been allowed to see. The state has provided more than 32,000 pages to the defense, but hundreds of those pages were blacked out. The state says kibby was notified those pages were being with held because they contain information about a pending investigation independent from the kidnapping and assault case. In other motions, the defense says pornography disks allegedly obtained from under kibbys home in goreham are not relevant to this case and should be thrown out. Kibbys attorneys also want to suppress statements he allegedly made to New Hampshire state trooper the day he was arrested, saying his miranda rights were violated. The state says kibby tried to start a conversation with the trooper as he was taken to conway and because this was not an interrogation kibby was not entitled to miranda warnings. Again those are just some of the motions that have been filed by the defense. All 16 will be taken up this coming tuesday, wednesday and thursday during scheduled hearings out of Belknap County superior court. Year. Tom in commitment 2016, republican president ial hopeful rand paul is the latest candidate to file for the New Hampshire primary. Jennifer senator paul spoke about the merits of early contest states in the selection process. I think that folks in New Hampshire would be very quick to tell you that they want to know a lot about the candidates before they decide, and thats one of the beauty of having the president ial primary begin in a smaller state. Jennifer senator paul then had lunch with voters at wmurs candidate cafe. Josh mcelveen tells us what the senator does in his free time. The rules of the senate are such that they tell me i cannot Practice Medicine for money. Last year they had a detached retina, so they sent me down to washington. He heard i couldnt charge anyone . Reporter another example of how New Hampshire voters pay attention. Josh mcelveen, wmur news 9. Mike a fair amount of sunshine for a time today, clouds building in through the afternoon. Right now those clouds are northern New Hampshire. The winds very active as well. Thats driving in some colder air just off to our west and eventually that colder air makes so that will do a couple of things, one drop the temperature of course, secondly its going to change rain showers over to snow showers in the great north woods and heart of the White Mountains as we go through the night. Notice back to the west more showers, they continue to build in. Again the best threat for those due to a west to northwesterly wind will be up across the mountains and the higher terrain in the great north woods. In central, southern New Hampshire that wind tends to be a drying air flow for us and that will tend to dry out the showers as we go through the balance of the night. Winds again very active out of the west, temperatures running a little above the average today, but with those winds turning around to the northwest and still maintaining these speeds right now, and continuing overnight, were going to see a much colder air mass by early tomorrow morning. Now temperatures still run a little above the average, but certainly just cold enough to change rain over to snow in parts of northern New Hampshire. A lot of cold air bank told our north and west, this is ours for saturday. Slightly milder air will build back in as we go into sunday. By then a little bit more sun tomorrow will be south of the White Mountains. Rain showers change over to snow, could be a coating to an inch or two by tomorrow morning, most of that lining up across the heart of the White Mountains in the higher terrain. For tonight, mixed showers changing to snow up north. Clearing skies in southern New Hampshire by morning.
