it budgeting 101. what parents need to tell their college-bound kids can, especially in these tough times. plus, surprising new details tonight in that tragic accident on a baltimore county light rail track. >> now abc 2 news, the latest at 11. >> the families of two young men killed on the light rail are taking the mta to court. good evening. i'm marybeth marsden. after taking over the investigation, baltimore county police have determined that criminal charges will not be filed in connection with the july accident. but the lawyer for the victim's families say this is just the beginning of their fight. delia goncalves is live at the light rail to explain the next step. delia? >> reporter: the family's attorney tells us he is planning to file a civil lawsuit against mta for negligence on the part of its train conductors. police are calling it an unfortunate accident that killed two 17-year-olds. >> the operator says he didn't see him. we don't have any evidence that suggests otherwise. >> they are disappointed. >> reporter: the families of conner peterson and kyle wankmiller declined comment, but a lawyer for the families says it still come downs to a light rail conductor having eight seconds to save two lives. >> if he had been watching what he was doing, these trains can be stopped in 200 feet. and he would have been able to stop the train. >> reporter: on july 5th, the soon to be stepbrothers were walking on light rail tracks when a southbound train passed them by. >> a conductor saw them and beeped the horn and is required to phone headquarters and phone other conductors and notify them there are children on the tracks. they didn't do that. >> reporter: attorney jay miller says videotape shows the teens then moving to the opposite tracks, not realizing they were walking directly into harm's way. >> all traffic became northbound. these two young men believing they were on a track where they would be able to see the train coming to them, were walking on that, and unfortunately they had no knowledge that the trains would actually be coming from behind. >> reporter: seconds later, they were struck. not once, but twice. the initial impact, and then as they were lying on the tracks. connor died within hours. kyle lost his life the next day. >> these accidents are avoidable if people are doing what they're supposed to be doing. >> reporter: attorney miller tells me he hopes the mta will spare the family the long and painful process and just settle out of court as they have in previous negligence suits filed against them. we should tell you the conductor's toxicology reports and cell phone records came back clear. we're live in lutherville tonight, delia goncalves, abc 2 news. the search continues tonight for a woman who struck a baltimore city police officer with her car after he pulled her over. it happened in the 3,000 black of mckeldry street. the driver put the car in reverse and hit the officer, and another woman in the car tried to get out at that point, but the driver pulled away, dragging her. both were taken to the hospital with minor injuries. and we're learn mortgage tonight about the young woman killed when a stolen car slammed into hers in west baltimore. police say they were not chasing the car that caused keira mckay's death at the intersection of west lexington and north calhoun streets. but members of mckay's family have their doubts. >> reporter: an initial investigation suggests the carjacking suspect t-boned keira mckay's car at anywhere from 70 to 100 miles per hour. the 23-year-old victim was a randallstown high school graduate, and had recently enrolled at catonsville community college to pursue a medical degree. she leaves behind a 6-year-old daughter. >> it was a lovely family, a caring family. she was coming from a doctor's appointment. and like i say, it happened. >> reporter: but how did it happen? police say the unidentified suspect had carjacked someone earlier, and members of the regional auto theft task force spotted the car on lexington street, but were ordered not to speed after it. but members of the victim's family are left with an agonizing question. why, if police were instructed not to give chase, was the suspect traveling so fast in that vehicle? >> no i don't believe believe the chase because they couldn't have arrived at the scene that fast, and if they were to chase and have the suspect going as fast as they claimed he was going, he should have been able to bail out of the car at an earlier time, maybe ten blocks away. >> reporter: the family is prepared to wait for an investigation into the incident to take its course. and members are balancing their grief with their frustration over how the case has been handled thus far. they say the family didn't learn of her death until five hours after the accident. and they are angered that they have not been permanented to identify her body. >> you don't know for a fact that it's her even now? >> no, other than the fact they gave us her license and it was her vehicle. but again, it could have been someone else driving the car. so we don't know. >> reporter: in randallstown, jeff hager, abc 2 news. >> police are withholding the suspect's name, but they say she an 18-year-old baltimore man. at last word, he was in serious condition at shock trauma. it's expected he'll face charges, including manslaughter, reckless endangerment, and auto theft. graphic and disturbing images to show you now. but images that police hope will help them catch whoever is responsible. this 8-month-old kitten named gabriel was found this week badly burned and beaten on garrison avenue. a witness says several kids threw bricks and rocks at the cat, and then set it on fire. the kitten was able to put out the flames by rolling around, but a witness says the kids lit her on fire again. the snyder foundation is also offering a $1,000 reward for anyone who comes forward with information that leads to the conviction of the people who did this. if you have any information, you're asked to call the barcs animal shelter at 410-396-4695. and that cat was found not too far from where officials are already investigating at least two other gruesome cases of animal abuse, including one you first saw here on abc 2. a cat's tortured body was found chained down. it apparently had fireworks set off on its head. tonight frustration is brewing over a pretty hot topic here in maryland. governor martin o'malley says he is a bit annoyed about the slot machine slowdown in anne arundel county. the county council has tabled the discussion about whether to rezone land near the anne arundel mills mall. the property could be used for the state's largest slots casino, but indecision is causing a delay. and that's keeping the slots issue there at a stand still. >> make a decision. right now we have that indecision kind of gumming up the works and keeping that largest number of slots licenses from moving forward. >> the council won't be talking about the potential rezoning until the fall. county officials have told the baltimore sun that their zoning decisions have no impact on the state's licensing process for slot machines. they're fixing baltimore city hall. the outside, at least. repair work that is expected to total nearly $400,000 is underway. workers will restore damaged masonry and marble, clean and retrofit wires and it's expected to be finished by the end of the work. the last time work was done on the exterior of the 134-year- old building was back in 1975. and speaking of repairs, yet another city water main is in need of work, and this time more than two dozen homes in northeast baltimore ended up with flooded basements or worse. here is the scene in and around the 2800 block of kirk avenue after a 16-inch main broke earlier today. one house had water up to the first floor. the age of the pipes is being blamed forker the break. >> in wintertime, you get the ground moving. you get freezing and thawing and shifts of the old pipes. and where they're joined together, they move that one little bit, and they tend to break there. and they've been in the ground so long, it's bound to happen. they're giving out from old age. >> the city and the red cross are helping the homeowners affected. water and electricity is shut off in the area, but it's expected to be back on tomorrow. well, it was a gorgeous, gorgeous friday of weather across the baltimore area. nice cool evening on the way for you. but get ready having to crank up the air conditioner once again. a few spots only into the 70s today, including just over the boarder in york. temperatures tonight, look at this. we have already cooled off to 68 now at bwi. and these temperatures headed way down there. i think we're going to the low 60s later on this evening. but all in all, a nice-looking night tonight. overnight 62 degrees, partly cloudy, mild and pleasant. state officials have confirmed a fifth death died to the h1n1 virus. they aren't saying much other than the victim lived in the suburban d.c. area had had existing health problems. meanwhile, studies of an experimental swine flu vaccine will begin next week at the university of maryland medical center in baltimore. officials say 67 young adult volunteers and 67 senior citizens will get a detailed screening and/orienttation on monday. if they give their consent, they'll get three shots three weeks apart to test the effectiveness of the experimental vaccine. a crack in the crown. a former miss maryland is in hot water tonight. tia shorts pleaded guilty to obstructing a police investigation in a drug case. she had originally been charged with conspiracy to distribute cocaine and drug possession. her boyfriend, his brother, and their 67-year-old mother were also arrested in the case. 2004's miss maryland will be sentenced in november. autopsy reports tonight show cocaine contributed to the death of television pitchman billy mays. the 50-year-old died of a heart attack back in june. a florida medical examiner's office says reports show that mays had used cocaine days before his death. they go on to say that although mays died from heart disease, cocaine use was a contributing cause of death. if your son or daughter is headed off to college this fall, one of their most important lessons might be taught before they ever leave home. and it's the city version of old faithful. why hydrants and pickups don't mix. and it has been one loud summer so far here in [ closing bell ] >> a big day for your money after a rocky week. the dow closed up nearly 114 point, closing at a new 2009 high. the nasdaq gained 27, and the s&p ended the day up more than 13 points, also an '09 high. a lot of gains to go around locally with joseph a. bank posting a gain of more than 7%. under armour closing up more than 4 1/2%. and t. rowe price didn't disappoint either, gaining more than 3 1/2% to close out the week. gains on wall street are just another sign that the economy is slowly getting back on track. but one of the biggest indicator seniors unemployment. and while the nation is still shedding jobs, the trend is clearly slowing down. here is how lost jobs have stacked up month by month since january. the u.s. labor department says we started the year by dropping nearly 750,000 jobs. and as you can see, as each month passed, the rate of job loss slows down. in july, nearly 250,000 jobs were lost. and that's actually better than many experts had predicted. just about everyone has a pinch in these tough times. if you're a parent with a student headed off to college this fall, you likely know that feeling all too well. all the more reason, as terry owens tells us, to teach your son or daughter some lessons about money management before they ever set foot on campus. >> reporter: emily knows firsthand how much fun college can be, and how tempting it is to forget finances. >> in college, because there is that sense of freedom, kids can overspend is. >> reporter: but emily knew from the start that her parents couldn't pay for everything, so she found a job. >> when things got tight, i had to pick up another job outside of that. >> reporter: then she set up budget and followed it. certified financial planner phil cook says she learned a valuable life lesson early. >> the budget for a student is the holy grail that they must live by day in and day out. and if they don't, and they blow the budget and miss two or three days of meals, they'll probably take that lesson to heart. >> reporter: cook points out it doesn't have to get that desperate if parents have the money conversation with their kids before college even starts. >> make sure that the child understands that the bank of mom and dad will be shutting down over the next few years, and that they're going to have the responsibility of handling their own finances. >> reporter: teach them how to make a budget. then go shopping together, so they learn about smart buying. and encourage them to avoid credit cards so they don't use what they don't have. if the plan is for the parent to chip in for things like spending money or apartment rent, consider sending monthly checks instead of a lump sum to cover an entire semester. >> that way if there are any problems or issues, you can identify them early on and work to correct them. >> reporter: emily's advice to recent high school graduates about to hit the college campus?
