critical question of what he did during the evacuation. after first saying the collision threw him into the water, the captain now says he tripped and fell into a lifeboat while saving others, after surrendering his own life jacket. the captain's at home, but he may not be there for long. charges are expected against as many as three of his officers for negligence in the operation of the ship and evacuation. the captain may soon share the same fate, especially with a story that has holes as big as those in the "costa concordia." chris cuomo, abc news, giglio, italy. >> well said, chris. holes as big as the ones in the boat for sure. tripping and falling into the lifeboat, it all seems so ridiculous. again live pictures from the italian coast this morgan. >> and the number of missing did go down by one. it's now 21 because a german woman who was on that missing list showed up in her native germany. so there's a little bit of positive news. but yeah, we're reaching almost a week now in that recovery effort, and it's hard to fathom that anyone would still be -- >> alive at this point. again, be sure to tune in to a special edition of "20/20" tomorrow night. it's called "cruise ship confidential" as abc news of course continues its coverage of this ongoing disaster in italy. that special will air friday night, 10:00 eastern, 9:00 central. a dallas attorney is facing felony charges this morning after she boarded a plane carrying a loaded gun. judith kenny says she forgot that the gun was in her computer case. perhaps more troubling, though, is that security screeners actually spotted the gun but not before kenny grabbed her bag and vanished into the crowd. uh-oh. airport police eventually tracked her down and removed her from the plane. well, we're learning some new details about that horrifying propeller accident that severely injured former model lauren scruggs. for the first time the pilot is telling his side of the story. here's abc's ryan owens. >> reporter: hi. i'm lauren scruggs with "lola" magazine. >> reporter: six weeks after model lauren scruggs walked head on into that airplane propeller, so many are still wondering how could it happen? the pilot is providing details. kurt richmond told investigators from the national transportation safety board he warned the 23-year-old to stay away from the front of the plane. richmond says he leaned out of his seat and placed his right hand and arm in front of her to divert her from the front of the plane and the propeller. he continued to keep his arm extended and told the passenger that she should walk behind the airplane. the pilot could not say if scruggs heard him over the roar of that propeller. he just landed at this small airport north of dallas after taking the online fashion editor on a quick flight to look at christmas lights. he says he kept the engine running because he was just stopping long enough for scruggs to get out and a new passenger to get in. richmond told investigators he watched her leave the plane, turn to his left to look for the next passenger, when he heard someone yell, "stop. stop." and he immediately shut down the engine and saw the passenger lying in front of the airplane. >> letting somebody out of the airplane at night especially with the prop running or the engine going is not a wise idea. there's no law against it. but most pilots would not do that because one of the things that scares you the most is the idea of somebody walking into that propeller. >> reporter: as you might remember, lauren scruggs lost her hand and her eye in that accident. she continues her rehab. and her mother recently posted on the website that her pain is at times excruciating. ryan owens, abc news, dallas. >> actually, the first pictures of her since the accident are now being circulated. and you'll see them later this morning on "good morning america." so you can check that out. well, when the stock market opens this morning, it will be at something of a milestone. it's good news. the dow jones industrial average begins today at its highest point since last july, the 25th. it jumped 97 points yesterday to close at 12,579. strong reports about housing and manufacturing fueled that rally. >> opened my 401(k) statement last -- over the weekend. not pretty. so good that it's up. stay up. fingers crossed. >> that's why you just don't open that. >> i know. >> just shred them. >> i regret it now, trust me. well, the stock market is a lot like an elevator. up and down all day long. but unlike the stock market, elevators can get stuck between floors. >> and that's no fun. especially if you're in a hospital minutes away from giving birth. that's what happened in tacoma. nurses were moving katie bagger to the birthing room when the elevator suddenly stopped. >> ah, but baby blake was obviously in a hurry. and the doors opened just in time for dad luke to cut the umbilical cord. final stats, seven pounds 15 ounces, just shy of the 14th floor. aw. >> we do these stories, kids born in a subway, born in a cab, born in the elevator. >> kids are born everywhere. that kid's coming he's coming. >> i want my kid born in the hospital bed. >> that's a bold call. >> it's happened twice. and i just know next time -- >> and you want more kids, don't you? those tax returns. he's saying not till april, till most of the primaries are over. his lead in south carolina is now down to ten. newt gingrich has apparently cut that in half almost. we could be by putting millions of his money offshore. >> and there are new signs that the controversy over his finances may be hurting him in the polls. we begin with abc's chief investigative correspondent, brian ross. >> reporter: mitt romney's big money supporters say his wealth is a sign of success. >> he's what we aspire to be. >> hi there. >> reporter: but his wealth, how he made it, and the relatively low tax rate he admitted he pays on it -- >> closer to the 15% rate than anything. >> reporter: -- have become a big campaign issue. >> his personal finances are a poster child of what's wrong with the american tax system. >> reporter: for example, abc news has found that millions of dollars of romney's personal wealth is in investment funds set up in the cayman islands, the notorious caribbean tax haven where secrecy is the rule. nothing in romney's financial disclosure statements reveals his connection to the caymans. but we tracked at least 12 of the funds he lists set up by his former company, bain capital, and potentially involving as much as $30 million, tracked them all to an address in the caymans. a post office box at the central post office. this is the bain capital address, right here. post office box 908. tax experts say such offshore accounts allow u.s. taxpayers access to a number of tax loopholes and keep secret which companies the funds invest in. as we learned from bain's registered agents in the caymans. >> you can't talk about -- >> no, unfortunately not. >> nothing at all? >> nothing at all. >> reporter: the romney campaign says the candidate would pay the same taxes if the accounts were not in the caymans. and romney says he follows all tax laws. >> if there's an opportunity to save taxes, we like anybody else in this country will follow that opportunity. >> reporter: but a larger issue involves how bain and others use such offshore accounts to help foreign investors avoid u.s. taxes. >> the treasury leases an estimated $100 billion a year because of tax havens. >> reporter: romney's critics are already crying foul, saying he has to release more than just the latest tax return to give a full picture over the years of how or whether he has taken advantage of the provisions in the tax code which benefit the super rich. brian ross, abc news, new york. >> also on top of that a new poll sews that former speaker newt gingrich is gaining ground. in less than a month he's actually cut mitt romney's lead in south carolina nearly in half. rick santorum, meanwhile, has about 16%. ron paul roughly the same thing. rick perry is trailing behind the rest of the pack with just 6%. and that new poll also found that president obama and mitt romney would be in a dead heat if the election were held today. the obama campaign has now launched its first major tv ad for the president. viewers in the battleground states of iowa, michigan, north carolina, wisconsin, ohio-s and virginia could see the ads pop up as soon as today. things are getting interest iin. it will be interesting what the romney camp response is to that story about his money in the cayman islands. they say that money isvery same if those funds were established in the u.s., these are not tax havens and it is false to say so. but i think it's been well known for years the super rich do hide their money overseas. >> and they did say that they store those funds in the cayman islands to help attract money from foreign investors. and he did mention in the piece that it's taxed the same in the cayman islands as it would be anywhere else. but still, that's a lot of loot. >> it is a lot of money. nice problem to have, i guess. well, president obama is hearing it from all sides after rejecting plans for an extensive oil pipeline through the heart of the united states. it would run from canada through six states all the way to oil refineries in texas. but mr. obama has blocked it, saying there's not enough time to evaluate the project ahead of a republican-enforced deadline. while the president faces criticism for killing jobs, environmentalists praised the decision. and now to that cruise ship disaster off the italian coast. the ship's captain is now being quoted as saying that he tripped and fell into a lifeboat as the disaster was unfolding and that he never intentionally abandoned ship. he's still under house arrest during all this. prosecutors are planning to challenge that, though, saying the captain has admitted to being reckless with the ship and that he is a flight risk. meanwhile, italian cave experts are expected to begin recovery efforts on board that ship again this morning. they are facing, though, some dangerous underwater obstacles of everything that was displaced during the disaster. 21 people, including two americans, are still missing. at least 11 so far are dead. and one very interesting note in this story, too. a descendant of someone who survived the "titanic" was on board this ship and survived. just a fascinating historical note on that. also, those two americans still listed as missing are gerry and barbara heil of minnesota. hundreds of family members and friends came together last night for a prayer service right there at their church. they were called a couple who was devoted to charity. their granddaughter simply asked for prayers. dallas-based attorney general judith kenny says she is embarrassed and mortified, but it's a little more serious than that. she is also facing felony charges for boarding a plane with a gun in her carry-on bag. kenny says she forgot it was there. the question is how was she even able to get past security screeners? here's abc's lisa stark. >> reporter: it was a mad scramble at the dallas-fort worth airport after security screeners spotted a gun in a carry-on computer bag. by the time security agents went to pull the bag, it was gone, and so was the passenger. officers pulled security tapes to pinpoint the passenger and fanned out across all five terminals, shutting down terminal d completely, even boarding flights that had already loaded. they finally found their passenger. a 65-year-old woman on an american arnirlines jet bound f houston. it had already pulled from the gate and had to be called back. the woman, identified as judith kenny, her bag and a .38-caliber pistol were taken off the jet. she reportedly told agents she had forgotten she had it. every other passenger was rescreened. that flight took off over an hour late. ten other flights were also delayed. >> most of airport security is security theater. and that's unfortunate. weapons and other items have gotten through. >> reporter: since 9/11 there have been more than 25,000 security breaches at airports, including this one at newark international when a lovesick boyfriend snuck through a security exit to bid his girlfriend good-bye. thousands of passengers had to be rescreened. tsa insists most of these breaches were minor. the agency has also come under attack for being too aggressive, with invasive pat-downs of children and the elderly. as for the woman in texas, she faces state felony charges of carrying a weapon where it's prohibited. she also faces thousands of dollars in federal civil penalties. lisa stark, abc news, reagan national airport. >> and last november a couple of elderly women made headlines because of how tsa agents treated them at new york's jfk airport. now the tsa is apologizing. the agency says screeners violated procedures when they asked to see medical devices that the women were wearing under their clothes. they claim they were strip-searched and are still disgusted. >> i think it's terrible. people from government should get involved and they should straighten it out and they should send people to classes who would learn how to deal with the public. >> that's exactly what's happening. the screeners will get training on handling procedures with medical conditions. and rob, as incomprehensible as it sounds, one of the women claims that the tsa forces her to pull down her pants including her underwear to see what was going on. >> see, it's the tsa, not the gyn. that's a little frightening there. but when you look at that number, 25,000 incidents? i mean -- >> since 9/11. >> since 9/11. that's kind of scary. in the ten years that the number would be that high. i know it seems invasive, but to play devil's advocate just for a second, if it's keeping us safe, better safe than sorry. and look how much still gets through even with those kind of extreme measures. >> now the pat-downs of the kids and the controversy -- >> oh, man. we'll see. let's shift gears a little bit now. michael jackson's doctor, conrad murray-s now off the hook for more than $100 million in restitution for the singer's wrongful death. jackson's estate was claiming that's how much the pop star would have earned from an upcoming concert tour. but jackson's family now says going after murray just isn't worth it. murray is serving time for involuntary manslaughter and says he is flat broke. well, they are still surveying the damage in kentucky and southern indiana after five twisters touched down. the destructive storms knocked out power to thousands. the strong winds uprooting trees and damaging buildings. but there appear to be no serious injuries. >> thank goodness. now for the rest of the into the fight of his life and he's getting a whole lot of attention. >> this player from texas isn't just racking up football awards. he's also battling cancer. ktrk's art rascon has the story now from suburban houston. >> i go like four weeks where i go once a week and it's just a long day at the hospital getting chemo. >> reporter: addison marshall will head back to the hospital for chemotherapy. during spring practice a few years ago he noticed pain in his ribs. that pain was caused by leukemia. addison's fight with cancer meant he had to give up playing football for a while. but it didn't mean giving up being part of the team. he kept working hard, hoping to get back on the field, and to serve as an inspiration for his teammates. >> if people didn't show up for summer workouts because they just didn't feel like coming, i tried to be like, well, i had chemo today and i still came. >> reporter: addison's hard work played off. he played in the last half of the last game for his foster high falcons. that hard work and determination led addison's coach to nominate him for the 2012 high school rudy award. it's named after daniel rudy rutig relative, the notre dame football player whose life story inspired the movie "rudy." >> oh, i was so happy to win, just shocked. just a mix of emotions. >> reporter: addison's mom of course is very proud of her son's achievement and gives credit to the foster high football team. >> i've witnessed what football means to these kids. and it's something you can't really articulate very well. but i think that's one of stormy conditions there have slowed down efforts to find those still missing in the shipwreck. >> also this morning another sign that mitt romney's victory this saturday in the south carolina primary is not a slam dunk. newt gingrich is up big-time in the polls. you're going to see why he is appealing to voters. >> new details about, you know, mitt's finances could hurt him a little bit. newt has >> the number of confirmed deaths is at 11 this morning and it's only expected to rise as the days go on. with the very latest on this now we are joined by abc's scott goldberg. good morning to you, scott. >> reporter: good morning, rob and paula. if the weather cooperates today, crews will start extracting the 500,000 gallons of fuel still inside that ship and divers will go back to the wreckage where they now admit they are no longer looking for survivors. while rough seas kept rescue crews out of the water and raised concerns that fuel might start leaking, back on land the "costa concordia's" first victim was identified. ♪ 38-year-old sandor feher from hungary seen here in a video he posted on youtube while he was looking for a job was an entertainer on the ship. one of his colleagues said feher was helping children put on life jackets before he went back to his room to get his violin and never came back. the ship's captain, francesco schettino, remains under house arrest facing possible charges of manslaughter and abandoning ship. but he's quoted in an italian newspaper saying he didn't leave on purpose. he now says he tripped and fell into a lifeboat which hauled him to safety while passengers and crew members fought for their lives. this video could support one part of schettino's story. it appears to show the same boat in august passing even closer to giglio island. schettino says he was following the planned route, but the cruise company blames him for deliberately steering off course. when divers are able to go back to the ship, they'll be up to their shoulders in dark water and debris. the grim reality, they're no longer looking for survivors. though in minnesota relatives of gerry and barbara heil are still praying for a miracle. officials are now saying 21 people are listed as missing and that includes the heils. one woman who had been on that list turned up alive back home in germany. rob and paula? >> wow, this thing continues to unfold. and people are going to have a hard time believing that he simply tripped and fell, the captain, into a lifeboat. that seems like the flimsiest story. >> after hearing the transcript yesterday, i don't really believe anything that comes out of this man's mouth. nor that he was actually trying to be a hero or save anyone when he had to be convinced to get back on the ship and i don't even think he ever did. >> no. it certainly is strange. again, you're looking at live pictures right now from the coast of italy. divers apparently getting ready to go back aboard that ship again. you heard it really is a rescue mission at this point. no longer looking for survivors. it seems increasingly unlikely. water a little bit choppy out there right now. but again, the mission continues. and be sure to tune into a special edition of "20/20" tomorrow night. it will be called "cruise ship confidential." abc news covers the disaster in italy, of course, in all detail. that is gaining serious ground on mitt romney. >> it's getting hot. new details about romney's wealth could get in the way of his front-runner status. abc's karen travers is following the campaign and has the latest. good morning to you, karen. >> reporter: good morning, rob. good morning, paula. the romney campaign sees the margin narrowing. this race may be closer than we think in south carolina. the race in south carolina is heating up. a new poll there has romney up ten points over his nearest rival, newt gingrich, who gained five points in two weeks. romney may be in the lead, but he's not easing up the pressure. he mocked gingrich's statement that he created jobs as a member of congress. >> congressmen taking responsibility, or taking credit for helping create jobs is like al gore taking credit for the internet. >> reporter: rick santorum's campaigning hard. he wants to be the anti-romney choice for south carolina's christian evangelicals, who could make up more than half of saturday's primary voters. >> this is a race where the people are going to speak and there's going to be a big surprise in south carolina on saturday. >> reporter: there's an intraparty tax war brewing on the trail. romney revealed for the first time his federal tax rate. >> it's probably closer to the 15% rate than anything. >> reporter: romney's worth an estimated $250 million. but since his income comes primarily from investments, he's taxed at a rate of 15%. the average rate for those making more than $1 million is more than 29%. gingrich addressed his taxes, too. >> we can confirm that i paid a 31% rate. >> reporter: but he was quick to say he wasn't going to criticize romney on this specific issue. >> my goal is not to raise mitt romney's taxes. it's to let everybody pay mitt romney's rate. >> reporter: but the clock is ticking, and romney's rivals are well aware that if he wins saturday's south carolina primary he is much closer to wrapping up this nomination. rob and paula? >> also right now -- you want to go first? >> imagine, if perry and santorum drop out how close this really could be in real life. >> and apparently some conservatives are telling rick perry look, now's the time, he's not doing well in the polls in south carolina and there's rumors now that he would endorse gingrich, though, if perry drops out, he would endorse newt here. speaking of newt, his ex-wife is going to give an interview to "nightline" -- >> his second ex-wife. let's clarify. he's had three wives. >> he's had a few. will appear in an abc news exclusive on "nightline." she says she has plenty to say. that should be very interesting a glimpse into newt's personal life there. >> that's tonight -- >> that's tonight on "nightline." check it out. we did mention romney's taxes just a minute ago and the questions of how he gets off paying so little. his campaign confirms that romney has money invested in the cayman islands but insists he gets no tax breaks there. but our abc news investigation found that romney does have the ability to pay a lower tax rate by investing in funds offshore. >> as so many super rich folks tend to do. despite all that, though, romney still remains a strong challenger for president obama. the latest poll finds the two candidates would actually be neck and neck if the election were held today. the obama campaign has now launched its first major tv ad. viewers in the battleground states of iowa, michigan, north carolina, wisconsin, ohio, and virginia could see those ads pop up as soon as today. and mr. obama is taking plenty of heat over his decision to block plans for a massive oil pipeline. it would run through six states from canada all the way to oil refineries in texas. but the president rejected it, saying there's not enough time to look into alternatives before a looming deadline being forced on him by republicans. house speaker john boehner accused the president of selling out american jobs for politics. and of course that number about how many jobs it would provide is always in question. inflated and -- >> criticism from the republicans. environmentalists, meanwhile, are pretty happy for obvious reasons. on capitol hill now, it didn't mean a thing, but the republican-controlled house has put itself on record as being opposed to raising the government's borrowing limit. the nearly party line vote is a non-binding disapproval of president obama's request to increase the so-called debt limit by more than a trillion dollars. the measure is all but certain to be killed by the senate next week. a sad picture. kodak is filing for bankruptcy. the pioneer photography company waited too long to acknowledge the digital imaging revolution and has been struggling for years. last night kodak said it plans to continue operating during bankruptcy and hopes to emerge from it next year. in the past nine years kodak has closed factories and film processing labs and cut 47,000 jobs. growing up that's all we ever had, was film. >> got to keep up with the times, or else. well, they are digging out in washington after a powerful storm dumps some snow on that state. it was a tough day of driving for commuters in the seattle area, which saw the most snow there since 1996. and now they're worried about warm weather melting that snow and causing flooding on top of everything else. there are also avalanche warnings at some of the higher elevations. and in idaho snow finally fell for the first time this winter on boise. the city picked up about six inches. that was enough to cause more than 100 accidents, though. all that snow is expected to be washed away, though, with rain predicted most of today. old man winter making his presence felt. >> i can't wait for the white stuff to fall. >> you movies. of course that did not sit well with some folks. then he kind of had to relates a statement to tmz after that interview with "men's journal." and he says, "to speculate about such a situation is ridiculous to begin with and to suggest i would have done anything differently than the passengers on that plane was irresponsible. i deeply apologize to the families of the victims that my answer
