In just the last hour, weve learned the victims mom will face charges of premeditated murder after her sons body was found at a home on post oak circle. Thats off maitland avenue south of 436. News 6 reporter Troy Campbell has been getting answers about this all afternoon and joins us now live. You talked with police. What are they telling you right now . A lot of investigating all afternoon. The crime tape you see behind me, this has been here roughly five hours now. The home at the end of the street. Police now charging a 59yearold woman with the shooting death of her son, saying she killed her son while he was in the shower. They have been now been identified as 59yearold virginia ortega. Her son, 29yearold blake howard, dying of multiple gunshot wounds. Relatives must have said something that alerted the relative that the son might have been killed. Police are saying the mother was holding a gun in her hands when they forced their way into the house after she refused to answer the door. Investigators say they are aware of a violent history between the mother and son, but they wont give the details as to what that is. Detectives also saying its unclear when the man was killed. The son was shot multiple times while in the shower. One of the family relatives knew that there was some type of disturbance, called and asked that we respond to the residence again, at this time, the son, 29yearold blake howard, his body is still inside the familys townhome behind me. Police still waiting for a search warrant to go in and to continue their investigation and retrieve his body. His 59yearold mother, virginia orr ortega, has been charged with his murder. But he wasnt the only one who showed up. The deputy who ortiz is accused of hitting, sergeant marcy pierce was at the Orange County courthouse as ortiz appeared today. Amanda castro was also there and she joins us now. Coming face to face with the judge and sergeant marcy pierce, four days after the Orange CountySheriffs Office says he deliberately ran over the deputy in a stolen car. He could have killed me. Ortiz is facing charges of attempted murder and aggravated battery on a Law Enforcement officer. The Sheriffs Office says pierce was serving a warrant on burglaryrelated charges friday morning. Thats when investigators tell news 6 ortiz ran her over, causing serious injuries to her head, back, hand and foot. He turned himself in to authorities monday. The teens mother was also in court today. She refused to talk to us. No comment. Do you have anything to say to sergeant pierce . Pierce in tears as she left the courtroom, walking on crutches and surrounded by deputies. Still in a lot of pain. News 6 reporter mark lehman shows us how a mistake by his attorneys is giving him another chance at freedom. The conviction reversal surrounds this order by circuit judge jennifer davis. She says wards original attorneys made errors in judgment when prosecutors used evidence violating his right to remain silent. Its been more than four years since we saw isleworth millionaire bob ward. He was sentenced to 30 years in prison after a jury found him inside the couples mansion, investigators say she was shot in the face at close range. Since then, hes been appealing his conviction. The motion states wards original attorneys should have objected when jurors were shown video and heard testimony about wards demeanor after his arrest. In her order yesterday, judge davis states, all postarrest silence is protected with or without police interrogation. With wards conviction vacated and reversed for a new trial, his attorney released a new statement to news 6 saying the judges order maintains what we have said throughout the proceeding. Now that the court has vacated wards conviction, hes presumed innocent and could be released. Today was the deadline set by congress for the president to submit his plan. One of the biggest questions, what will happen to the prisoners being held there . Right now, there are 91 prisoners at gitmo. The president s plan would countries. The remaining 56 will be moved to a facility here in the u. S. What about the cost to get all of this done . The white house says moving the prisoners would save 85 million each year. But it will take a onetime cost of 475 million to implement the plan. Its something the president says needs to be done now. For many years, its been clear the detention facility at Guantanamo Bay does not advance our national security. It undermines it. In the meantime, some republican lawmakers are coming out against the president s proposal. Marco rubio has been outspoken in the past about the administrations policy on cuba.
