we'll be live with the fans early this wednesday morning, we'll be live with the fans early this wednesday morning, june 23, 2010. captioning funded by cbs feeling like summer here on the corner of 59th and 5th. good morning, i'm harry smith. >> i love it when it's summer. i'm in. >> feels good. >> early this morning there is a group actually looking to sue mcdojm mcmcdonald's, the toys in the happy meals, that's what the kids want. >> yes. >> to keep them happy. >> yes. >> not so much. they're saying this is unfair and deceptive marketing. they think it's illegal to market this to kids so perhaps turning into an unhappy meal. it's interesting. >> when the kids were small, we had shelves full of those small little toys. >> yes, can you find them at every tag sale. the showdown at the white house between president obama and stanley mcchrystal, u.s. commander in afghanistan. chip reid has the latest on that. good morning. >> reporter: good morning, harry. general mcchrystal has apologized for his comments in that "rolling stone" magazine article and he said he used poor judgment, but that may not be enough to save his job. >> whatever decision that i make with respect to general mcchrystal or any other aspect of afghan policy is determined entirely on how i can make sure that we have a strategy that justi justifies the enormous courage and sacrifice those young men and women are making over there. >> reporter: press secretary gibbs made the president's mood very clear. >> i gave him the article last night. he was angry. we're calling him here to see what in the world he was thinking. >> reporter: what got mcchrystal and his subordinates in trouble is a series of comment in a "rolling stone" magazine, mcchrystal says, are you asking about vice president biden? wus that? his aide says, biden? did you say bite me? president obama chose mcchrystal to lead the afghan war in 2009. during his tenure there's been an additional 30,000 troops deployed as well as an increase in u.s. casualties and waning public support. this is not the first time he's been in hot water. he was scolded by the white house for promoting a surge in afghanistan before president obama completed his policy review. senators mccain, graham and lieberman in a joint statement said, we have the highest respect for general mcchrystal, but deem his comments as inappropriate and inconsistent with the traditional relationship between commander in chief and the military. however, john kerry, chairman of the senate foreigns relation committee, cautioned restraint. >> my impression is all of us would be best served by backing off and staying cool and calm. >> reporter: afghanistan expert michael hanlan says despite his gaffes, general mcchrystal should keep his job. >> i would hope the white house should be forgiving. having said that, i can understand why people would be very upset about this. >> reporter: the president and general mcchrystal are expected to attend monthly meeting on the situation in afghanistan and pakistan in the situation room this morning at about 11:30. before that meeting the president will have his one-on-one with general mcchrystal and we expect a decision some time after those two meetings. >> chip reid at the white house this morning. thank you very much. also in washington is cbs news chief foreign affairs correspondent lara logan. good morning. >> good morning, harry. >> let's talk about this because in terms of strategy, president obama has put all of his eggs in general mcchrystal's basket. this becomes a very difficult decision for the president. >> it is a very difficult decision. what i'm hearing from a lot of people is that it's time for the president to clean house. that his entire team, civilian and military, is dysfunctional. and he needs to do something about that. and this is, perhaps, an opportunity for him to do so. it's no secret that there has been a lot of bad blood between general mcchrystal and u.s. ambassador karl eikenberry. and ambassador eikenberry has been briefing against mcchrys l mcchrystal, leaking against mcchrystal. that is not conducive to a winning strategy and the president needs to do something about that. >> it's interesting because as you read this article, then there's also bad blood with richard holbrook, the ambassador over there. there is a lot of dysfunction but going back to the whole idea of the strategy, the mini surge as it were in afghanistan, this is mcchrystal's baby. is there somebody else who can step in and assume that role? >> well, there are two skooldz of thought on that. one is that it is mcchrystal's baby. he's central to the strategy. he's fought for it. he's the architect of it. you can't do this without him. he's critical to it. on the other hand, this is the military. there is a command structure that is set up there, a regional commanders across afghanistan carrying out this strategy on a daily basis. the feeling is that when the command changes, you continue with the mission. that doesn't mean it doesn't get paralyzed in the interim because you don't know what the new guy is going to do. you're looking at it, am i going to be next? commanders are reluctant to move forward, take risky decisions in a climate where there's political uncertainty. that's bad for the troops on the battlefield, in the line of fire. >> it's interesting, you talk about mcchrystal and he comes across as this guy who is very smart and very disciplined and you read this article and he doesn't come across, and his aides don't come across, as particularly disciplined or very smart in light of the fact there's a report in their midst for days and days and days. >> i know. it's staggering. i have to say that any reporter, anyone who knows general mcchrystal is absolutely stunned by this lapse of judgment because it's so unlike him. it's so uncharacteristic. this is a man who leads by example and is known for his personal discipline. so, the question really that a lot of people are asking is, how did this reporter get inside the inner circle of trust? and did he violate the trust? i mean, there really is an interesting question here. something doesn't add up. it's completely inconsistent with people that know about general mcchrystal and it raises some very interesting questions that haven't been addressed yet. >> lara logan, thank you for your insight this proesmorning. appreciate it. we turn to the battle over deep water drilling. yesterday a judge struck down the obama administration's ban. cbs news correspondent mark strassmann is in grand isle, louisiana, with more. good morning. >> reporter: good morning. for the obama administration the ban is needed and the real issue is safety. but for so many coastal communities here, the bigger worry is jobs. it's the new fight over deep water drilling in the gulf. interior secretary ken salazar says he'll issue a new ban to replace the one a federal judge struck down yesterday. >> all right. >> reporter: that ruling thrilled todd hornbeck, who sued the obama administration to get drilling rights back and won. for now. >> i think that everyone will be cautious in seeing how quickly we can get back to work. >> reporter: his shipping business ferries supplies to deep water rigs. to everybody at this port, america's hub for oil drilling and production, any ban is a potential jobs killer. 15,000 jobs just at this port. >> what is at stake for all of you? >> for me, everything. >> reporter: sherman florence, this ship's chief engineer, says his wife is also worried. she works at a florida beach resort menaced by oil. now you're here worry being your job. >> yes, sir. >> reporter: what are you going to do? >> pray and hope for the best. >> reporter: the white house will appeal the federal judge's order, lifting the first ban. >> continuing to drill at these depths without knowing what happened is -- does not make any sense. >> reporter: that infuriates many people in louisiana, despite new waves of oil that keep coming ashore. >> i'm simply asking the administration, listen to the louisiana delegation, lose to the louisiana legislature, the people that live along this coast speaking with one voice. >> reporter: at least 120,000 jobs are on the line with this ban. communities like grand isle, for instance, have seen a lot of oil. even so, there's very little support to stop drilling for one more minute. >> mark strassmann in grand isle, louisiana, thanks. joining us from houston is the new point man for bp, bob dudley. good to have you with us this morning. >> good to be with you. >> cbs news has confirmed are you officially in charge at this point. it wasn't supposed to happen until august. what are we going to see that will change now that you're running this operation? >> originally the organization was to be set up for following the kill of the well. we got started earlier with the meetings with the white house now. we have a lot to do to get in place the transition of the claims process to ken feinberg. i'm going to be spending a lot of time in the gulf coast with officials in washington and around the gulf coast, listening very, very carefully to what it is that their concerns are, the people of the gulf coast, making sure we can respond faster and quicker. we set up an organization dedicated to being able to do that if a very sustainable way. >> there's so much confusion still at this point. it is now day 65, but so many different numbers floating around as to the oil itself. we heard last week tony hayward saying the well was still 97% full and it could potentially keep spilling for four years if these fixes don't work. sta realistic to have to plan for go like that, four years out? >> well, we have the capability to drill these relief wells. we'll be able to go down 18,000 feet. we've got two of them drilling. i fully expect the well itself will be shut off in august. then we'll still continue to have a lot of clean-up after that, but these fours years is -- >> you're competent the relief wells will work? >> that's right. >> there are also -- there has been so much criticism of the company, of the way this was handled. i know your first trip to the gulf -- to the area happened on day 49. you were there with our own harry smith. have you been back since then and what have you seen that you are putting, as your own personal top priority in this? >> my own personal prirority is to listen, listen to the people along the gulf, claims center, officials to make sure we can move resources and get them there as fast as we can to make sure we respond to the economic losses people are occurring as well as making sure bp puts all of its resources to the equipment and people out there that are working on the spill response itself. >> on monday bp told lundberg fuse y news you were looking for assets to sell. is there concern you don't have enough to fund these clean upefforts? >> bp is a strong company. we have cash flow around the world. what we want to make sure setting up this $20 billion escrow sta we have resources to do that. we'll look at our portfolio around the world. there may be assets we'll sell. we want to position itself to be able to meet those commitments. we can do that. we have to do it systematically. >> i want to ask you about the ban on offshore drilling as we know was struck down yesterday by a federal judge. i'm guessing at bp that is welcome news? >> well, we stepped out of that. we're going to step out of that healthy and spirited debate in the country. we know the workers offshore who have been put aside because of this moratorium, that's a hardship there and as a show of goodwill we put aside $100 million for the rig workers laid off. we'll have to see what the government decides going forward. >> bob dudley, thank you for being us with this morning. >> thank you. >> and, of course, the government is immediately appealing that decision. there is more news happening this morning. betty nguyen standing by with the rest of that. >> good morning to you at home. we begin with that huge wildfire in northern arizona. winds there have eased and there's growing hope that evacuated residents might be able to return home today. but the 14,000 acre fire is only 20% contained. its southern edge is about five miles from flagstaff. fire officials say it could take another two weeks to put it out. to politics. as the anti-establish mood dominated key primary runoffs, nikki haley, backed by the tea party, easily won the south carolina republican nomination for governor. she'll face democratic vincent sheheen in the election. if elected haley would become south carolina's first female govern governor. and tim scott was elected to run for congress. he used an anti-tax platform to defeat the son of late senator strom thurman. he was south carolina's first african-american republican in more than a century. it appears the man who went on a one-manhunt for onl osama bin laden will be released from jail. he was arrested earlier this month telling police he planned to find and kill bin laden. long-time bachelor prince albert of monaco is going to tie the knot. the royal palace announced he is engaged to charlene winstock, a former swimmer. they have not set a wedding date just yet. if you preordered the new iphone 4, you may get a nice little surprise in your mailbox this morning. the latest iphone officially goes on sell tomorrow, but apple is delivering some phones today. it may be to avoid a baglog of phone activations with at&t. they are already lining up. here's a life look outside our studio as people wait at the apple store on 59th street and 5th avenue. that might be a bit of a wait today. then there's this -- an attempt at a record-setting stretch here in new york city. thousands of yoga enthusiasts came together yesterday on central park's great lawn to set the record for the largest yoga class in history. among them, designer donna karan. 10,000 people were expected. judging by the crowd, they got pretty close to that number. here's dave price with a check of the weather it's 7:17. hope sunny skies are in your forecast. >> thank you, dave. just ahead, a cbs news exclusive tour of the prisony joran van der sloot is held. why one wash dog group is taking on mcdonald's over happy meals. she was the queen of country and we'll talk exclusively about mindy mccready and her road to recovery. this is "the early show" on cbs. ♪ ♪ do u gonna be there?
